Town of Durham An Ordinance Regulating the Parking of Vehicles

Section 1: Snow Removal

No vehicle shall be parked at any time on any public way so as to interfere... —__ — with the plowing or removal of snow by the town or a private contractor acting on the town’s behalf. The town may cause any such vehicle to be removed as provided in section 4 of this ordinance.

Section 2: No Parking Zones

No person shall park, stand, or stop a vehicle in any of the no parking zones designated by the Town of Durham. Any vehicle which is parked, standing, or stopped in a designated no parking zone may be removed as provided in section 4 of this ordinance.

Section 3: Camping on Public Streets

- No person shall camp or permit any other person under his control to camp on any public way, no parking zone, or municipal parking area.

Section 4: Towing Vehicles Illegally Parked

Any vehicle parked in violation of this ordinance may be towed to another location at the discretion of the Head Selectman, Road Commissioner, or any authorized law enforcement officer at the expense of the vehicle owner. The vehicle owner shall be liable to the tow truck operator for the reasonable cost of towing and storing his vehicle. The tow truck operator may refuse to deliver possession of the vehicle until such charges have been paid in full. If the motor vehicle operator offers to remove the vehicle after the tow truck operator has been contacted, the motor vehicle operator shall pay the tow truck operator the reasonable cost of his services. If he refuses to do so, his vehicle may be removed and retained by the tow truck operator in the manner previously stated. The owner of any vehicle which is towed pursuant to this ordinance shall be responsible for the reasonable cost of storing the vehicle. The owner of the area where the vehicle is stored may refuse to release the vehicle until such fees are paid.

Section 5: Penalty

Any person who violates the provisions of this ordinance shall be subject to a fine of not more than $200 payable to the Town of Durham. The penalty imposed may also include reimbursement to the town of any expenses incurred by the town in enforcing the provisions of this ordinance with respect to the vehicle in question. The ordinance may be enforced upon complaint filed by the Head Selectman, Road Commissioner, or authorized law enforcement officer. The effective date of this ordinance is December 9,2008
