7,725 words in 17 windows of five minutes. Each timestamp opens the recording at that second.
We started it and it's on his computer. Yeah, true. And he has his computer. Well, it's not it's in his office, but the supplement to this. I'm assuming that it's got a password. Yeah. So, I was looking at this. I was like,
I hope I brought the rest book. I can't find it. automatically get you should be a politician. Not exactly. last time. All right. So we have to go through the application. We started started doing that. which you guys are going to approve and it says that um
and move the table until the next meeting. It just would be it would be good to be able to look at what we wrote you did write down the stuff that they requested if that helps. Yep. looking for the this is what I wanted right here.
Oh, you I'm good. Yep. Here we go. It's just I wanted Well, you know what? All this stuff right in the You know what? You people might be in luck. Oh, where do we have a coffee? That's not what I want. of that stuff because my folder was so thick when we came to the ordinance rewrite meeting that it's probably on my desk.
Okay. I did that once before, too. That's from Okay. But I Mindy, this is mine. I want it back at the end of the Oh, [laughter] no. This is too much pressure. As long as my dog's not here to eat it. [laughter] Okay. which has happened.
I don't know why I was possessed to do this possessed cuz you have good for sight and you know that not really we would need people don't a hand don't appreciate me. [laughter] Oh, okay. This was Mark reads and you were doing it and I just sort of kept
Okay. And then it the last page Ann moves to table. We didn't even finish this because too much kind of was missing. Well, that looks like it's not applicable anyways. So, that's written. Well, and I can just add stuff to the word document. The only thing is do we happen to have a notebook just when we do the findings of fact so I can hand write I don't have a notebook like a blank piece of paper.
I have blank paper. Okay. I'm not offering to record. What's that? Yeah. Not offering to record them. I offer you a notebook. You're not doing what? I'm not offering to record them, but I give you the notebook. A notebook handy [laughter]
cuz usually I do it on the computer. So I'm just going to have to I'll just do it by hand. So, it's today's 97, right? Yeah. But it's not paper. And it's going to be um John. Yes. And then this for accessory apartments. Okay.
So, we don't even have our I know about. Okay. Wow. I might even have that. It's like vacation. All right. That's all I know about. Um, thank you. We do we have to go through go through the checklist just Well, we could probably just do the
the stuff that we the ones that we have it written down, right? Yeah. I have it I have it written down what Jill just gave me. Um okay. And I was just going to put my initial time. This is in our notes. Jill, dang it. has suddenly started her
waiting for state peritting. I saw her the other day activities and Mark Kelly for her state licensing fencing or anything. That's fine. Oh, you had the rest. She said the fencing was I have the rest of the notice the lumber is still wrote.
Yeah, about the abutters. Yes. Yeah. Okay. That was from the last meeting. All right. I have to unfortunately I have to unfortunately go in and help um Alden. So that is we don't have to start right at 7:00. You know, we could go to commercial.
Okay, [laughter] it's fine by me. Takes the pressure off. That's right. But I want to get home and watch Clinton and uh Trump. Is there a debate tonight? totally out of loop. Out of loop. They're not even They're not even in the same
They're not even looking at each other, [laughter] right? Let me check. Oh, we just Should I sit here so it doesn't look weird? [laughter] much room up here. You got a whole pile of papers here. All right. So, I'm reading the approval criteria. You have the
I'm writing it down. Do you have the check criteria list? I do that I can read. Yes. Okay. Although it would be nice if I could write on it cuz I do. We have a I know I have some we have some copies. I have cards here. Maybe make a copy.
But if you approve the minutes first then we can go forward. Now I've lost it. I just had it. You know what I'm saying? Papers. Papers. minutes was what transpired last meeting. Yeah, that was so long ago. That was [laughter]
John. I just I literally just like just had it in my hand. What? Approval criteria form. I just had accessory approval criteria. Oh, I have Okay, I've got Jill's copy, but I I have I'm going to make another set. That would be awesome. John,
I'd love to have one, too. I'll make two but now I've like misplaced it amongst all my papers. Did she email the meeting minutes? Did she hand them? Yeah, she did. application checklist. I'm such a mess without Paul here.
[laughter] need to the one that I just connect to the Wi-Fi, but I can't use the Wi-Fi. least that I could read if need be. I know it's in here somewhere. Darn it. All right. staple together while I'm copying. There's three different documents
out in the cold either. There's no staples in this stapler. Are you kidding? It's not a stapler. There's no staples. It's a paper weight. [laughter] It's just a pound. It's not me. I'm like scared I'm going to end up with like Jill's copy and somehow it's going to be like in my stuff [laughter]
and your dog's going to eat it. And my dog's going to eat it. Every time I leave the house, I have to like pick up every baby toddler toy, anything cuz if I don't, then it's like the stuffed animals like in the middle of the rug like slobbered.
The book is like ripped to shreds. No, it's not. He's naughty. That puppy. H. Not puppy anymore. How old? No, he's four and a half. Yeah, we have a new puppy. Oh, you do? That's always fun. Yeah, she's pretty busy. She pure bred shepherd.
Yeah. Yeah. Put ours to sleep. Um, what, like a month ago? I'm sorry. You had a shepherd, didn't you? Yeah. Yeah. And I was going to rescue a dog, but every time I showed him dogs, he just wasn't. He wanted another shepherd.
Plus, it cost 500 bucks to rescue a dog, which is it's crazy now. Jeez. You know why there were no stables? Somebody had to go into the supply room and get the whole box was gone. Yeah. Where'd you get the dog? Um, it's from a breeder in Texas, but actually
boss is the head of maintening not. All right. I guess it's been a long time since I've used a stapler. Can we just get some paper clips? [laughter] Staples in the stapler. It's not empty anymore. Just gems or the wrong.
Maybe that's why it was empty cuz it's broken. Oh crap. The stapler looks like it may be older than I am. So, John, one for Minnie. Staples here. Down. Okay. We're getting here. Got staples coming at me, though. They're flying out now.
do we want to go all back all the way through the application? Yeah. Okay. I think I'm afraid so. not marked though. Oh, sorry. Applications. You want to go through the applications checklist? Yeah, I think we need to cuz we don't have the one from last meeting.
Um, or do you have it? Have it. Yeah, I guess we could go. Oh, 716. Okay. The stuff that Yes. Yes, I got you. The stuff in the uh So, the stuff that's incomplete. finish up with call it complete and then go for approval of material.
I stole a pen. You could have you could steal that. Okay. Okay. We're ready. Are you ready? We guess so. [laughter] All right. And you all got your agendas, right? Uh did not. Okay. You didn't. Was this supposed to be in the packet?
No. No. handed out tonight. It's probably under your binder. You can have another one. Well, that one. Do you have your minutes? There's only three of us. So, here. I was wondering the minutes we're going to approve. Is that it
over there? Yeah. Okay. Okay. All right. I sat in the wrong spot, didn't I? Huh? That's cuz I sat on this side this time. Yeah. Now you're getting this soft corn. [laughter] All right, give us a minute. Okay. Hm. And Paul, too.
Yeah. Yeah. You know, his brother died. Yeah, that's what you'll know. He was in Texas. has to be recused. Excused. Okay, we're live to call this meeting to order. Um, planning board September 7th, 2016. To start with the pledge of allegiance
America and to the republic for which it stands, one nation under God, indivisible, with liberty and justice for all. Mindy and John and myself. Um, any amendments to the agenda? Seeing none. Okay. Acceptance of minutes. We need to approve the July minutes.
Um, go through them quick, I think. anything uh need to do about minutes. No. Move to find I move to accept the minutes for the July 6th meeting. Second. All those in favor. step on up and uh continue with your conditional use application.
through the application submission requirements again that we previous meeting 4 B I believe correct um incomplete four 4 A address owner's name of engineers or surveyors are both pertaining property owners. That was Yeah, B was complete. I'm sorry.
Yeah. Speak up a little bit. I can. Okay. So, all right. Sorry. Um, so the first item that needed submit was the owner's [clears throat] name uh for who is preparing the plan, which is a plan prepared by the owner. Yep. And submitted. So 4 Agree
is now complete. Yes. Yes. 4 B was names and addresses of abuing property owners which was complete at our last meeting. We had people Great. Barry Cooper. here. Okay, that's we'll find that Aries. Complete. Yes. 4 D uh sorry, B.
Yes. location of the site within the town as required. That should be the new supplement. there's a couple different. There's the one that shows distance. previous application? Yes, we did. That's what I thought. I don't have
right? materials and now I they're hiding now. to the deed. This is my paperwork your lot lines. You've given us an address for the location. Yeah. I think we're pretty well established that you're 432 Stack Road, [laughter]
Here it is. Okay. So, that was part of the original application and you've highlighted your property. Yes, sir. 23 29A is our this just we confirm that Paul has that as a part of it. And if we have that, I think we can establish it's complete.
Yep. Which letter was that? This is the uh which lettering general location 4C 4C sketch map showing the general location of the site within the town required. Okay. It's now complete with the tax map. It is. Yeah. You have it in that app that package Mindy?
I do. Okay. Great. At least have that one back so you don't didn't realize it wasn't in my binder still boundaries of all contiguous property under control of the owner applicant regardless whether our parties and we deemed that was not applicable for D at the last
you mean J 4 D 4 D boundaries of all contiguous property under control of the owner. I think the complete is the line above it. Correct? Am I? Yes. Yes. Right. All right. So 4 E zoning classifications of the property and the location of the zoning district boundaries was established as complete.
Yeah. Yeah. 4F the bearings and distances of all property lines of the property to be developed and the source of this information supplemental information today. land, right? These two deeds. Yeah. No, one was just um Paul wanted to make sure you know you guys too that that there wasn't any setbacks or anything like that.
Deed restrictions. So, that's the full deed file for the property. Yep. You have two two descriptions. SK Exhibit A um is 2.8 acres. Yeah. That's um and then you've got this deed. searched description not verified. Yeah. Initially the that was the original deed when it was deed out.
Um what was the deal? There was some way in the then then there were they were doing um uh Betty was doing the ones in the back. In order to do that, she had to give me more road frontage. So then that changed the deed. So the the second deed is actually the
an amendment basically, right? It's the initial the the right one. The first one was the very first one. Okay. [clears throat] So, it's actually 2. What did you say? 2.9 or 2.8. 2.8. 2.8. distances of all property lines of property you developed and the source of this information. The board may require formal boundary survey when sufficient information is not available to establish on the ground all property boundaries or zoning classifications.
Dee it complete. Yes. without the engineered survey. required by this ordinance was waved at the last meeting. The location dimensions and ground floor elevations of all existing proposed buildings on the site. house the edition.
Yep. Oh, ground floor elevation was in the Where did you get it? Oh, was he in the initial? I actually have a copy right here. I believe it was from TJ. We had the builder. Okay, there you go. You guys can take a look at that. I have extra copy.
messes us up. Mhm. [laughter] So, this is the building elevation. Ground floor elevation would be if your slab is at 31 ft above sea level. Oh. Oh, I got you. Oh, isn't that why we have the topographical one? I think so.
Yeah, but I don't think it shows it. Yeah. Um, but I think we can establish that you're above sea level, right? I think we're and you're you're not in flood plane, right? I don't see where it is problematic in this application.
When you're near flood plane, that's when I get noticed, right? We're going to complete. So, we're going to find that the application is complete of the location, dimensions, and ground. We're waving ground floor elevation.
Yeah, kind of backwards. I know. I'm like off. I'm a little unclear of which. So we found we had previously found that complete right the no the the check mark is above the letter the line that we're checking if I'm reading this right is is above the letter not below
so we previously found 4G incomplete but we found H complete the last time we found based on our minutes 4G was what we found as incomplete. the location of all building setbacks. Yeah, that's in the new supplement um of paperwork, too. The setbacks I believe that was one of the things we had on our list to take care of.
Okay. So, we waved. ground floor elevations we previously found to be complete, but it's 4G, the location of all building setbacks according to our minutes that needs to be and that's what it looks like you've submitted here.
Okay. Okay. That's what you wrote down, right? I just want to make sure. I'm not I'm a little unclear of what the official record is going to be, but I just want to make sure that who if I'm my checklist is supposed to be that I want to make sure I'm checking the right
well when you get into I can do it on the word. Yeah, that will be the official. Yes. building the third one. The third um map. So, there's one distance here from the new structure to the the property line. It's 85 ft. What's the setback requirement? Is that okay?
Uh 20. Okay. This side. Okay. There's a sufficient information for us to consider the application. Yeah. All right. So, so G is complete. G is complete. Dimensions is complete. We already established is complete. Location dimensions of driveways, parking areas, and walkways. Location of intersecting roads and driveways within 450 ft. We found incomplete
supplemental. Yep. Yes. Yes. drainage courses, wetlands, stands of trees and other natural features with a description of such features to be retained in any landscaping plan any buffer areas required by this ordinance shall be shown on such plan. So the direction of drainage represented
it's on the fourth page there. Yes. And we also have a topographic plan that shows the grade, general slope and grade of their lot in the neighboring property. direction. Yeah. Okay. Yeah. Sorry. We'll put some arrows on.
We tried really hard. [laughter] All right. It slopes away from the house all the way around. Right. Right. We can sit on Lake Nol. Mhm. So we can deem this complete. Yes. Yes. Um the direction of drain Oops. Yes. It's a similar read. I guess the direction of drainage across the site both existing proposed is complete. Location dimensions of existing and proposed signs is not applicable as found our last read of this. Um oh location and dimensions of any existing easements, copies of existing covenants or restrictions. We are submitted a deed and we are now complete. Does not show any easements.
Location and type of exterior lights. So you get outside light plan. So complete I think you let's see quantity locations and storage containment of hazardous materials petroleum products in excess of 50 gallons is deemed complete at our last week.
Utility plan in addition to provisions for water and waste disposal, location and nature of electrical, telephone, wires, other utility services to be installed on the site was deemed not applicable. State approvals was deemed not applicable. schedule of construction including anticipated beginning and completion dates was deemed complete. Was that before we had our little delay? [laughter] Um, accurate cost estimates was deemed complete. Detailed description of the proposed conditional use was deemed complete.
following supplemental information provided as part of applications for projects involving six or more dwelling units. make a motion to find that the application is complete. I'll second all those in favor. All right. you with us, Jill?
Yeah. [laughter] Yeah. I do have one question. Okay. Okay. Um seven. Yes. However, B was nonapplicable. Correct. So, wouldn't there need to be not applicable? Was it not in the minutes from the first time? because that's where that's when we made that determination from what I see here.
I mean, it talks about a corporate annual report. So, right. Don't think they have a corporation. Right. [laughter] Right. Okay. I see that. Yeah. and number nine totally complete. Is that what you're saying? Not applicable.
Totally nine. Totally non-applicable. Correct. All right. Yep. Love it. Okay. Do you want to go through approval criteria? Will not do we want to will not result in undue water or air pollution. I would say that's complete.
Right. Right. I have to write it down. I I move that uh it is not going to result this project will not result in undue water or air pollution. Second it. All those in favor? Sorry. Here we go. [clears throat] So, do you want me to read these as motions and then you guys second?
Might be easier. Might be easier. Might be easier. All right. Yeah. Um I move that the project has sufficient water available for the reasonable foreseeable needs of the proposed use including fire protection will not cause unreasonable burden on existing water supply if one is to be used. This criteria shall include the use of the aquifer and the applicant must show its use will not harm the wells of those currently applying relying upon said aquifer.
I'll second that. Those in favor. will not cause unreasonable soil erosion or reduction in the capacity of the land to hold water so that a dangerous unhealthy condition may result. I'll second. All those in favor? highway or public road congestion or unsafe conditions with respect to the use of the highway or public road existing or proposed.
I'll second it. All those in favor? adequate sewage disposal in conformity with the main state plumbing code and other applicable regulations. I'll second it. All those in favor, through all of these things? No, we didn't.
No. No, we didn't. We didn't do completely. We didn't do completeness. So, we didn't go into this. No. I mean, do you want to we want to discuss the application more? Is that what you're saying? I mean, if all we did before was find that the application was incomplete, then I I guess I don't recall
Yep. reviewing this. You know, I don't know how many people are going to be living in this organ. Yeah. And I don't know how many people are living in this apartment. I guess I just trying to get like 15 to 20 in there. [laughter]
I'm just kidding. It's a the plan's a onebedroom. We're kind of go and we wanted to ask you guys, we're kind of going back and forth and if we want to do a twobedroom, is that something we have to go back through up? So, the accessory apartment criteria I believe for sorry what
it's a separate one right that we have to do single apartment single family character but I believe that's does not allow for a twobedroom okay I just wanted to make sure before we you know made any changes to plans only one main city
I guess I'm not sure if that's I know that we've talked about it previously but I'm not seeing it here but I'm wondering if it's somewhere also an ordinance. Single family dwelling, a separate secondary dwelling unit located on a property with a single family dwelling. And then
utilized for rental purposes as well as in-law accommodations. Main entrance didn't stipulate. I read through that before. It stipulates on size as in it can't be a certain percentage of your main dwelling, but I didn't see a stipulation.
The impact might be on which would be a Paul code enforcement issue is your septic design. That could be your limiting. Gotcha. On that the number of beds. So, we just talked to him afterwards. Is that how many how many um
just make sure we don't find anything else in here that in the septic system form. How many bedrooms does it allow for? How many do you currently have? One, two, three, bedroom. Three bedrooms. I think it's it is only four, but it could be five.
I'm just curious. What's it? We're fine keeping it as one bedroom. We just wanted to see if there were options. Probably it would have to say the 405 bedroom capacity. have this thousand gallon 10,000galon. apartment. Okay.
So, I guess that's what they did there. One bedroom there. That's what this survey was based on. Does it? Uh, so that's what we have to Okay. [clears throat] On the application itself, threebedroom plus one bedroom. Okay. Yeah. To do that, you'd have to rebuild you,
I think. Okay. Now, is that something that an option that we can do later on or no? We're fine with one. I was just wondering if the pool of renters is decreased. You know what I mean? If you just have one bedroom, basically, we'd have to get a a another plan drawn up
and redo the whole thing. Okay. Another septic plan drawn up for a five bedroom is essenti essentially this is a fourbedroom. So, yeah, it might wind up being a bigger tank. We're good where we are. We're fine. Just a question.
[clears throat] So, number five, their sewage disposal is in conformity. We want to look at number six, proposed development. We have adequate fire to protection. I certainly hope so. Right. [clears throat] Who seconded that?
We haven't. We're We're discussing. Okay. Right. I'd be in trouble if not, right? Yes. You'd be in trouble. We're done in trouble. sure. So, we want to finish making these motions through this and then we need to go through this criteria which I think is the meat of probably our conversation.
Okay. Is checking Yeah. the square footage and right we good with that? Yeah. Okay. We come up on unless we come across a stumbling block but I think okay um move that the proposed development will have adequate fire protection.
I'll second that. All those in favor the town's comprehensive plan and all other applicable town ordinances. Oops. Did I Oops, I'm sorry. will not have undue adverse effect on scenic or natural beauty of the area. Aesthetics, historical sites, or rare and irreplaceable natural areas, any deer wintering areas identified by the main inland fisheries and wildlife and other agency, or any public rights for physical or visual access to water bodies.
I'll second that. All those in favor? the town's comprehensive plan and other applicable town ordinances. Is quite I'll second that. All those in favor move that the applicant has adequate financial and technical capacity to meet the standards required by this ordinance.
I'll second that. All those in favor whole or in part within the 250 ft of any pond, lake, stream, or river waters will not adversely affect the quality of such body of water or unre unreasonably affect the shoreline of such body of water. This is not resource protection
at all. Correct. According right. Little residential, right? Yeah. It's kind of waved, right? Wave that. Oh, or not applicable. It's not applicable. Right. Not applicable. Yeah. Yeah. Sorry. Sorry. Na. So, number number 10 is not applicable.
Second. I second. All those in favor? with existing activities adversely affect the quality or quantity of groundwater. All those in favor [laughter] I just have to glance. The applicant will determine based on FEMA agency flood boundary and floodway maps and flood insurance rate maps whether the site of the proposed use is in a floodprone area. If it the site is propo if the site or proposed use of it is in such an area applicant would determine the 100red-year flood elevation and flood hazard boundaries within the site. Proposed use shall include condition of plot approval requiring principal structures on any lots of proposed use be conducted shall be constructed with their lowest level including the basement at least 3 ft above the 100redyear flood elevation.
Not applicable. We did they of the flood map. Yeah. And I don't think I don't think that's on our application checklist, which it probably might be a modification we make in the future. Let's the application. There's a question in the application. Is this property in a flood zone?
No. Okay. And they said no. Okay. So, move to findable. Not applicable. I'll second that. All those in favor adverse impact on spawning grounds, fish, aquatic life, bird, or other wildlife habitat. I'll second that. All those in favor.
glare, or vibration to disturb the peaceful enjoyment of adjacent property. All those in favor? burden on the ability of the town to provide municipal, governmental, or educational services. As long as you're not actually 15. [laughter]
Hopefully not more than two. have no more than two there. Seriously, I'll second that. All those in favor. with that motion for the entire motion? Our approval criteria is complete for the Kelly application. I'll second that. All those in favor?
conditional use or accessory apartments. So, explain the entrance. This the first item is the dwelling will have one main entrance. So remind us again how the entries were working. So if you grab the plan done by um Miss
Sylvester the elevation. So the dwelling is going to have two separate distinct entrances. So take a peek at that one or one excuse me one separate and basically it's broken out about 10 ft over it. Yep. elevation. Correct.
And yours will go up through the mud room. Correct. around the basement access and secondary. Is there a secondary out for the accessory apartment? Accessory apartment. Love the windows. I guess the windows. Yeah. All right.
They have to be the egress spinners, right? Mhm. Gotcha. main entrance and all the barriers appear subordinate. You found it. [laughter] I know. I took mine out and I didn't even So, this door here goes into the apartment and this door here goes into our house. Okay.
to be our personal space that we're adding on to our existing house and the accessories kind of onto the mudroom, but with no entrance to the apartment from the mudroom, if that makes sense. that door is going to be your new main entrance, right?
Okay. Entrance leading to the language of this always like has me scratching my head was like what were they trying what was the intent here? Entrance leading to a foyer with entrances leading from the foyer to the dwelling unit is permitted. [laughter]
outside stairways. So that's great. That's good. We've got that part of it. what that second sentence is supposed to mean. I'm not really makes no sense but still so I guess the I guess so the question is is that entrance shown subordinate
right I mean on at least on this elevation it looks like this is the main the looks like this entrance looks at least equal to I mean I think of a red typical residential house. The front elevation of my house has two doors. I've got my front door steps to it, and I got a door that goes in my garage, which is the one I use 99% of the time.
And we actually, if you look at the front of our house, you can't really see it in the existing elevation cuz it's kind of cut off. There's a second front door on the front of our existing. So, we do have two front entrance doors, then a third to the apartment, basically.
Yeah. Got it. into a garage, I think. Right. I don't really look subordinate, right? Yeah. If you've got a porch here, but yeah, I I don't find that problematic. So, the other piece that we need to review is um 1500 square ft of floor
area, which what's the existing floor area? E like of our house right now, but this one. No, we need some dimensions. Oh, it's um 42 by 26. So, um let's see. And it's just a singlestory ranch, right? It's a raised ranch.
Raised ranch. So, it's So, you got daylight basement basically. Is it finished? Finished. Wow. Yeah. Somewhat. It's in the process. You said 26 by what? 42. So, you have two floors finished. Yep. 24. But there is some um a little like utility room where we have our furnace and boiler. But
a laundry room, you know. I don't know if you want to consider we use it. It's like full daylight on one side. Yeah. What did they count it on? Did you see on the um was 11:52 from the when we got it reappraised? Did you guys have that maybe
1152 per floor? Even if you went 70% to account for the the utility room 806 this 115 considered floor space for an accessory apartment? So the accessory apartment's really only 700 and What was it? No, I think it was 8. Yeah, 780.
790 or 780. It's 26 by um what was the plan? 26 by 26 by 30. [clears throat] And the L is part of um ours. Okay. So the L is part of your so some ft of floor area in your main house which I think what's what's the what's added by the mudroom for square
should be 24 by 16 total right for the mud room well the mud room and the sun the other part the the L part the L part is um 12 by8. Yeah. Is that right? 12 by 8. The 22 plan. And then the other part is um 12 by 12 x 16 I think.
12 x 16. Yeah, it is the tiniest writing. Let's see. Let's see here. So if it's 26x 42 on your existing grit. Yes. So we could call it 1.75. You're probably using 3/4 of your your basement. Yep. That brings you up to 1911 there.
Okay. So you we're over the 15, but right but 50% shall not exceed 50%. So we need to order we need to add in 12 by 8 which is 96 be another plus 96 2007 and that is there 8 by 8 that goes around the corner by 8. Okay. So that's another 64.
64. So that's 271 square ft71 26 for the apartment 26 + 306 So yeah you're watching it. So 780 square. What did he say? I'm going to be tired. Hold on. So this is all just none of the garage area. It's going to be No. Just the just living area down there.
Yeah. Just that upper just that that one floor 780 ft. The mud room is not common space. You said Okay. So, dimensionally they're in compliance, I'd say. So, floor area. Yep. I think they're well well done. Okay. Only one accessory apartment per lot, which is fine. Shall be made part of the main residence attached to the main residence by a fully enclosed breezeway not exceeding 20 ft or located in a separate building whose primary function is not as a dwelling unit such as a garage or barn. It's attached to the main dwelling,
right? It's the cleanest way permitted non-conforming structure. Sorry, what shall be not permitted in non-conforming structure or use? [clears throat] nonconformity use of the premises as opposed to nonconformity non-conforming dimensional requirements.
it's a permitted use, right? A house in a residential area. Okay. So, do we want to move ahead with motions on this? You guys have additional um what are we looking at for total acreage 2.8 eight. [cough] [clears throat]
rural residential square feet. However, it says houses in existence the time of the passage of the original ordinance will be allowed to convert to a two family at 45,000 square ft for the second unit where it meets all of the other criteria. Not more than 50% living space. Septic is in conformance. The lot size has not been reduced.
is that it's 2.1 acres is 90,000. It's 2.06. 2.06 is is the 90,000. Yeah, it's Yes. Is this in the growth? Is rural residential in the growth district? It's way away from the growth. What's that name? Is it in the growth district?
No. No. goes on to say multiple family housing density is 110,000 square ft for a duplex. apartment. You need less than an accessory. [laughter] Really? Then that makes sense. Nope. But my contention is I know we voted on this before.
Yeah, it's it should have been more clear in the first place, but problem. Hm. Well, and then it actually goes on to say, "Additionally, accessory apartments shall be allowed as conditional uses in rural residential." That's
which is making it sound like Yeah. That overrides the condition. Overrides anything, right? Yeah. You know, but it's not clear. not knowing exactly We don't have their tax card, do we? The tax what? To what? the text card to tell it says so many acres that the town hasn't recorded it.
I don't believe we do. I don't know if this matters. I know Paul had found the original application that was approved. I don't know if the ordinance has changed over that time, but when this when we when we originally filed for this back in what was it 201? No, 2011.
It was approved by the board. So, I don't know if that can help you guys out a little bit or to solve that discrepancy, but changed. I think the issue has been that the ordinance has been a little vague. [laughter] Yes. Too vague. 310= 77
map. different on the tax card? Oh, so which map's that one? It's just tax. Oh, it says 2.8 from that. It could be different on the tax card. [laughter] No, if anything, usually less. Oh, must be missing something because
You're not getting 2.8. Oh, 775 Does part of that include a right of way? Well, that was what I was wondering before. Yeah, there's a 50ft right of way. Okay. I thought I had Is it Doesn't it say 350 ft road frontage on that?
Well, no. 559. Oh, it was road frontage. Right. She had to give me an extra the extra I think it was. I don't know. You have me confused. But the second one on there is the new deed because I had to give them a right of way.
right? October 2015. Do you see? That's the first one. bounds here, I come up with 121,139. 80. Oh, a lot is at 2.06 106 is 90,000 square ftus. 31,000 over. to be 2.8. So, Mhm. Um, at 310 ft. Did I put it? Where is I can't I don't know where to put it.
But you guys don't own the right of way. I believe they own the right of way. Daddy does. Yeah. But I'm not I don't I don't know. Do you know? It screwed up because the way that they filed it, they didn't file it with a lawyer like they should have. They filed it by themselves and there had to be amendments made and it just clouded they clouded the waters with all the deed work like as you can see by trying to sort through those
and then what happened when Betty part when Betty par parcled off some of her other land they ended up having to change her initial I think it was a two two acre that's what she initially went from two point 2.1 in order to have the road go I had to have more the other way
cuz she was losing road frontage basically for giving them that right. Yeah. Okay. So that makes sense that that 50 foot right cuz this was is theirs but we have a way to use it. Is that right? Yeah. Okay. square 300 by 310.
L is the additional. Yes. Yeah. these meet some bounds here. I come up with uh 126. You said 12 I bet we can go go I don't have any service. Those you're going to say for some reason at 45,000. I think it's just I think it's like 448
is it's a weird number. It's not 45 cuz a 90,000 square foot lot which is a minimum is actually 2.06 acres. Okay. It's weird. times three. applying for cell tower in this town. So if you get that car I know. I just had no [laughter]
cuz I can't get anything. Bradberry Mountain area is the worst out behind there. Yeah. Yeah. Looks like it should be working, but it's not. Yeah, I'm showing 4G, but yeah, same here. So, it looks like probably they're short of the 45,000 square ft.
They're short of the full 3 acres, but acres? It'd be 90,000 plus another 45,000 on top of the 90 which would be how many acres do your parents have 45. Didn't it say 45,000? So it's 90,000 plus 45,000. Okay. I just don't know how many what that comes out to. They've got 2.8 acres.
How? Yeah. Okay. By this by this uh measure they have 121 and they would need 135. Yeah. But they're clear of 110 which is what's required for duplexes. Yeah. I to read is that if you are initially building a duplex you would be required to have 110,000 square ft
and then if you are have an existing single family and you want to convert to a two family then you have a higher it it doesn't make any sense am I is that but And but then it seems like it reads that accessory apartments are exempt
right when it has this 43,560. That is Yeah, that's an that's what an acre is. Yeah. So, let's go dig back into that. apartments on the square footages? It's on page 41. 44 to 42. Okay. Number or letter E. Doesn't matter.
Do you think she wants? It's not add more than 50%. conditional use in rural residential transitional self. So that should not be part of C, right? That should have been D. [laughter] I don't know that. I don't know why that's
age 42. Sorry. I don't know why it's tacked on the not reduced since March of 1988. Additionally, the accessory apartments shall be allowed as conditional uses in I don't even know why that's there. Mhm. Well, I think it's trying to get into
rural residential, so it should just if it wants to exempt accessory apartments from this, it should just say that. I don't know why it has criteria. Yeah, I mean I I I think I mean it all goes back I think somebody was trying to get this consistent with the comp plan which was to allow some of those uses to reduce sprawl. Right.
Mhm. To reduce spraw [laughter] which was what the state wanted us to do in the first place. Right. of bringing it in line with the comprehensive plan or I mean I think this is why we're doing a conditional use on the apartment is because that was the intent
because it shall be permitted. I have read it for many years now. All right. So the other dimensional max block coverage 25%, they're not even close to that. It's not a multif family. know that's [laughter] which is why it doesn't make any sense that an accessory apartment would have to be under
I mean unless unless it's trying to incentivize the development initial development of duplexes as opposed to adding an accessory apartment to an existing single family home. But I don't would not not really because you can only have one duplex on a lot on a lot
and they're all residential. So they're equivalent. They are kind of the same, right? I mean, or like you can fit more. I guess it is. Yeah. Right. More beds on a duplex. to these criteria for accessory apartments. It says you get one per lot. Yeah. Right. met the rest of it,
accessory apartments shall be allowed as conditional uses. Right? in the others and the other mentions nothing of accessory properties. which you would think you'd want it in the growth district as well. Mhm. Well, it says yeah, it says in the growth district also.
you can build, right? No, leaves you out of the the resource protection. Yes. Okay. Leaves every everything out of resource protection pretty much. Okay. So, do we want to make a motion? Want me to craft something based on these criteria?
Sure. Um, shall have one has one main entrance and appears subordinate to the main entrance and it does not include open or enclosed outside stairwells above the first story. All those in favor, let's just do it part by part.
Yep. That's what I was trying to do. Yep. Very good. The main dwelling unit has the main dwelling unit is more than 1500 square ft of floor area and the accessory apartment does not exceed 50% of the floor area of the main dwelling.
I'll move to second that. All those in favor? I find that uh there is only one accessory apartment on the lot. It is part of the main residence attached to the main residence and and not um attached to the main residence by a a enclosed breezeway.
I'll second that. All those in favor in a conforming structure and is a conforming use and conforms to dimensional requirements. I'll second that. All those in favor. application. Uh I move to approve this conditional use application for an accessory apartment.
I'll second that. All those in favor? That's without conditions. Correct. No conditions. Don't believe we have any conditions. With no conditions. Okay. [laughter] So, are we are we all set? Thank you. Thanks for the time, guys.
Sorry to make it painful. We have to make a drama. Oh, we get to have the drama. Well, my whole family's watching on TV, so I can [laughter] They must have really nothing better to do than watch. Even my kids are watching.
Oh boy. See you guys. Thanks, guys. Have a good night. Thank you. Congratulations. Thanks. I want to see that puppy. Okay. Yeah. I'll stop down and see if should that be a condition. Right. [laughter] your next planning board meeting and whatnot at the bottom.
No other business. Okay. We don't have any other business. [laughter] Business. Next planning board meeting will be October 5th, 2016 at 7:00. Motion tojourn. I second. All those in favor? Well, there we go. We can shut that off, please.
I'm going to have to make sure I type this up before I can't read what I've written. [laughter] You can keep it for next time. He's known for his ears. Okay. video.
