I wanted to take uh correspondence off the consent agenda because we have a few different things to um talk about there. Any other? And uh I want to add an executive session at the end very a brief one. Uh we've received a couple of new code enforcement officer uh applications. Just to do a quick review of those and see if we want to um

information tech too. Yes. Do we have we have an application for that? Okay. We review the applications um and see if we want to uh schedule some interviews. So Okay. Any other changes? You had that change on Yep. minutes. Yep. um when we get there, we have the uh public comment uh first. So, I think we have a few people here with uh some stuff to say. Barry, do you want to start?

Well, actually, I was here because I knew they were coming to speak to you and then I don't m I don't wherever wants to go first. I think I think since I think you're I think we should start with you frankly and and then we can uh

go from there. Yeah, please. Yeah. Barry Baldwin running around Pond Road. I've been uh dealing with the Planet Board for 5 months uh on a subdivision application. Uh a bit more involved than it used to be, but I you know they they're trying to do their best and they're quite thorough. So I I went along. It's 5 months is a long time to get where we are now. But um there's a we got all through it pretty much and did the completedness. If if I say it wrong, you you can chime in, but the checklist for completedness. We did the sitewalk. Uh pretty much there except waiting for a stormwater management plan which has been filed. That's the only thing missing and we were looking good. And then I think we're done. And at the end of it, uh, the planning board, a couple of the planning board has an issue with the right of way or road frontage issue of, um, Granite Hill Farm Road, which has been decided by a previous planning

board uh, in 2012 and through the town attorney uh, through my attorney and the planner board and codes and we fought that stuff out for two or three is and finally got everybody on the same page where the town attorney agrees that it's a road frontage road I can pull permits up there building permits and uh planning board challenges the

I don't know if it's the right word comp competency of the town attorney to make these kind of decisions first of all I didn't bring that issue to the plan board that I informed them about the road I brought information and I brought actually uh Calvin I believe on his computer has um highlights of that meeting on 2012 that

where the decision was made that it is a road frontage road um what does that mean a road front a road frontage road means that you have it's a a road that qualifies under the Durham ordinances as a road frontage road meets the qualifications

meaning it's a town road or it's No it's a private road which meets the definition of road frontage. So therefore, you need 300 ft of frontage, the minimum 90,000 square ft to build. Okay? And there was an issue with a lot that I gave to my son that was on this side of the power line and that was only 30 ft but it was a separate lot and it's a separate lot of record and because it was so old and long before the ordinances that that was a 12 acre lot which is buildable too even with the 30 foot road. So what is the so what I mean cuz we're not that's not the role of the board of selectment to you know overrule or pass judgment or whatever of the planning board. So what are you asking for?

I realize that I was just trying to explain I don't know what okay I'm just explaining to you I'm looking for information. I'm not asking for a decision. Okay. Uh one of my questions is we've had issues you know what is the plan of this you know town moving forward. It's not just about me. this thing. Everybody deals with this, you know, and it's who do you go to when when things don't when somebody doesn't want I don't know. I don't want to say the wrong thing. I don't want to offend anybody. I'm not here to offend the planet board. I don't want to make enemies out of them. I'm just trying to understand what this deal what my options are. Where do I go from here? They actually said they didn't they want to I believe they came to ask for the selectman's blessing to hire another lawyer, a lawyer that's more experienced in road issues than with the town attorney. I I don't understand why we would go that route. If we have a

town attorney, we pay him. I would think we'd value his opinion or get another attorney not to question his judgment. And the other thing that I understand I'm not positive u that once a planning uh board minutes are accepted they become official or I don't know about law but they are supposedly

an official record of what was decided well they're officially you know if the planning board said yes you can do this and those minutes were accepted and everybody agreed it's supposed to be a done deal. Do we have those minutes? I mean, oh yeah,

do we have that? I have Well, I didn't bring all that because I decision. I have all that paperwork. So, is um and maybe someone from the planning board can chime in here, but are is what we've heard so far, right? Like you're it's the you're questioning the opinion of the town attorney in this matter.

Well, so I I don't know if you want me to wait until Mr. Baldwin's done. Well, we might need a little back and forth here. I think Okay. So, um, so Mr. Baldwin presented us the the opinion from his attorney and the opinion or the the response from the town attorney and it's not quite as black and white as Mr. Baldwin makes it sound. The the town attorney at the time is Curt Weber and he did not affirmatively say that this is a road that he didn't clarify the status of the road. Basically, this is an old discontinued county road.

Okay. So, it's it's not a public road. It may be a private road. It's not clear to us um who has rights in the road, whether it's a butters to the center line, whether it's a public um you know, the public has an easement over it. And that wasn't something that was clarified in the two attorneys opinions. Mr. Baldwin's attorney was very clear that he believed that this was sufficient and and Kurt Weber, the former town attorney, it it wasn't as black and white as that. Um we did read both letters.

Okay. And so that's where we are. And the issue with the former planning board, the issue that was in front of them was whether Mr. of Baldwin and put in an application for a back lot. Um, and the planning board basically decided they didn't have jurisdiction because it wasn't a back lot.

Okay. Can I can I stop you right there for a minute? Yep. That's fine. Okay. When I came to the planning board, when they made their decision on this, are you talking about back in like 2012 or whatever? Talking exactly about what she's talking about. 2012. The only way I could come in front of the clan board was some kind of you got to ask for something. You can't just come and tell your story. You could on the public opinion or whatever, public comment section, but I was they were there's confusion, Todd. You you've been around this thing forever, this back lot ordinance and all that. And there was confusion on it. So, I came to the planning board with two I wanted two permits of back lot. I knew they weren't back lots. I had to set in front of them and show them that they are not backlogs. That this I showed them that the town attorneys, my attorney, code enforcement, and the plan board all agreed after we hashed this

all out and it's all on tape. It's all in the minutes. The tape are much more clear than minutes. What month? Uh we're not going to excuse me. We're not going to get into all the details. That's why I didn't bring anything. I didn't want to overwhelm you with facts. I want to present the problem and if you want to look at it, you name what you want and I'll

So ultimately ultimately it's basically let me finish. The planning board did make a decision based on what the town attorney said, what my attorney said, what code enforcement believe and what the chair chair or and the whole planning board agreed and they didn't uh make an opinion. The reason I came to the planning board was with back lots. That's what I thought I had to do to get through the door, even though I knew it was wrong. Once they realized that, they're like, "Rust your B." It's like, "Well, Barry, what do you want?" I want building permits. Well, they're not back lots. Okay, then give me back my $200 and we all agree that is a road fronted road and I can draw a permit on the first lot, which I gave to my son, and I can draw one on the 100 acres.

May I ask your son's lot that keeps coming in question? Yeah. Yeah. Is his road frontage on this road in question? Yes, it is. It's 30 ft of road frontage, which is not enough. Not enough, but it's a a lot of record, which qualifies it as a billing lot. Billing buildable lot. Because it was a buildable lot.

It's non non-conforming of record. Thank you. What about the other lot? Is that entirety of road frontage on that road in question? You said there was two lots. It was It's on the other. There's a power used to be one lot. It was divided by the power line 400t strip. That's why we ended up on 12 acres on this side and then the rest of the property which was 98 acres.

So nobody currently has for lack of better words 300 ft of road frontage as their residence on this road in question. Oh yeah. Yeah. Yeah. But I think I don't think I you know I don't think the details of of that are as important as the what's the process for you to get for to resolve this. And it seems like that because ultimately the power is with the planning board.

I understand that and and if you're not liking what you're getting or hearing or disagree with what you're getting from the planning board then it's becomes a board of appeals matter. Okay. I realize this and that if that's the way it goes that's what I'm here to find out.

Y I'm not here to complain about what they did. I'm here to get information. I've got 5 months in it and I need to roll on that thing. I was planning to finish the road this year. So, I don't want to be tied up 3 4 months doing something that I've already done.

Has the planning board asked our town lawyer for uh clarification where you feel like the letter the earlier letter isn't as clear as you'd like it to be? Uh well, as you know, Kurt's retired, right? So, now we have Jack Conway. Um, and given the lack of detail in that one, the planning board would prefer to have one of an attorney who's an expert in roads. There are a couple of them who do paper streets and discontinued roads and this is their area of expertise.

The So, you haven't denied [cough] the application. So, Barry can't go to appeals board yet because you haven't made a decision, correct? So, so essentially our cons our concern is that you have to travel up Granite Hill Farm Road to get to this this new road that's being built in the subdivision.

Our concern is obviously if we approve the subdivision and 10 years down the road folks start fighting and it turns out that they don't have rights over this road and instead it belongs to the abutters and someone wants to be a jerk. There's also no maintenance agreement for this road. There's nothing. So, we want to make sure before we approve this um this subdivision that folks can actually get to their homes. And that's why we want an opinion saying yes, they have rights in this road. This is what we we've also would like to ask. Um are there any conditions we should consider on the subdivision approval such as a road maintenance agreement for Granite Hill Farm Road or anything else to ensure that folks can maintain that road as well as the subdivision road because the subdivision road itself isn't an issue. Um Barry has done all the plans for that and all the documents. It's really this one road and that's why we

want the attorney's opinion to say, "Yep, [clears throat] we're good. They have rights. they can access their lots forever and ever and we'll figure out the maintenance later or we have a real issue and folks that doesn't even mean that we say no but maybe we put conditions on that that that Mr. Baldwin needs to get an easement over it from the abutters or or whatever. We don't even know where we are until we have the attorney's opinion on that.

Okay. So, it's it's the road to get to the sub that helps. Yes. Can I just um I know we asked in the past from the town's attorney their interpretation. Can I just why what's the hesitation of just asking our our current attorney now what

um so Jack's not an expert in roads. Um it's going to take him longer to figure it out and this isn't something that is typical in his practice area. If that's the decision, we'll live with that. Um but we So is Jack's telling you to that that's really the only decision I think we have. Is Jack telling you that the town should seek another measure? I don't think they should.

We haven't gone to He's not He's not in the loop yet. Okay. But our our our attorney's office, are they saying, "Hey, we can't decipher this." You need They don't know about this. We haven't asked any attorney about this yet.

I think that we should ask our attorneys to take a look at all updated paperwork since he's got some of the paperwork and has had it from before. Unless he has it from the previous attorney. I don't know. It's the same firm should he should have. It's the same It's the same firm.

Same law. Yeah, it's the same law office. just the original is has retired and and Jack's taken over our part for the town. So, can I can I ask is it fair to say that you agree that the town attorney, present town attorney and my attorney can review what they've already done through that office and see if they agree. It's my opinion that they should review it and the fact that Jack doesn't think that he

can make that decision, he can refer us to our next what we should do after that. I do not believe that we should arbitrarily go out and hire a separate attorney without getting their information. we've already retained him for the town and he's I believe he's actually looked at it's been a while but he's looked at some stuff similar to that in the past

and it might be that if he if if we send it to the town attorney and and I don't think it would be inappropriate to say you know um you know this there's some particular expertise called for here if you if you don't feel that you're the guy you know perhaps he needs to bring in a consultant you know still under his um you banner if you will.

Okay. Who makes it who makes that call right away? You have to wait till No. No. Who makes who am which call? Makes the call to the attorney. So this has I think a planning board they want to represent the planning board on that case. So it' be us making

I think the planning board just has to go through the go to the town's attorney and say what do you do you feel comfortable making this decision or not? And if not then well yeah and just go from there. The attorneys can offer an opinion. It's the planning board that'll make a decision. Right.

Right. Exactly. But is the planning board okay with my attorney reviewing this with the office that they've already dealt with? Nothing to do. I think do whatever you want. I think Jack needs to reach out to actually Jack Clifford. Um,

then he can certainly do that. Yeah. Cuz I think ultimately where we're at with this is that the planning board uh wishes to consult an attorney. The board is at this point not willing, it sounds like, to go outside our normal attorney process. We'd ask the planning board to take it through our normal attorney process, see what comes back from that, and then it's still in the planning board's um jurisdiction. You know, they they will do whatever they're going to do and then if you still have an issue with that, then it becomes a board of appeals issue.

Has the planning board called our town attorney in the past? Directly? Not in the recent past. Not in the recent. I never did. Russ Jibo was I think the last one to call. Okay. I'm just wondering because I know usually we run that through our administrative assistant. That's why I asked

that's what I was getting. That's Yes. And that's why I was Well, I believe there is a budget that's afforded the piano board as legal. Who actually makes the call, right? Who actually makes the call? Usually goes through the administrative system.

I never did should be co as the administrator of the land use. That's good point. Okay, go ahead. Can you email me what you want? Sure. And I think we just like to be in the loop as well in case he has any questions or anything.

between with the planning board. And the other thing is um I'd like somebody to answer that question legally if the planning board agrees. When the planning board makes a decision, is that an official decision? It cannot be

I defer to the planner board. Ask them. I mean, we can pose. Yeah, that can answer. Am I do we not have a board of appeals process? Yes, we do. So, what are we talking doesn't get used? I mean, actually, they've had they've been fairly frequent in the last 6 eight months. They've had to approve.

So, so do we understand what the next steps are? the the planning board is going to get a letter with a list of concerns to Calvin and Calvin's going to arrange a correspondence with the attorney and then the planning board will will take it from there uh with Mr. Baltin.

So, um why don't you introduce yourself and and uh I don't know if everybody's had a chance to read uh your email, but you can um bring it up to speed.

Yeah. I can. So, uh thanks for for uh inviting me here uh to talk about the problem that we're having on Plower Mill. My name is Mike Berseron. Uh resident at uh 93. Did I say plumber mill? No, you said we live forever on plumber mill. So it's still in my head. Sorry. Cedar Pond Road. 93 Cedar Pond Road. And our our property has now that we are discovering notorious for having episodes of flooding during heavy heavy rains and weather. And the there is a small drainage brook that goes through our property. And uh with heavy weather, the u culvert we discovered across uh Cedar Pond Road actually backs up uh bad enough it floods our basement. And before we bought the property, actually I discovered it has a history of of doing the same thing. Fire department gets called, pumps it out. And so in in doing a little bit of uh looking into this a little bit more as far as trying to figure out what exactly we can do

with this with this episodic flooding, I discovered that the culverts that cross the road, let me back up a little bit. Uh we have three uh 40ft culverts crossing our driveway. How many? Uh, three. Three 24 by 40 foot 24

24 in x 40 foot culverts uh that cross our driveway. And those handle the the the runoff uh brook that sort of winds through our property as well as the the ditch that comes down the that side of the road. The next driveway over uh our neighbors at 85 have two 24 by 20

culverts and those generally tend to handle the flow relatively well. Next step down crossing Cedar Pond Road are two 24x 40 foot culverts. And in the past during heavy weather I've actually gone out sort of keeping an eye on everything. And it's the culverts that cross the road that are the first ones that top off for lack of a better description. Uh and once those top off, everything rapidly pretty, you know, pretty rapidly backs up to us. So looking at my my sort

of interpretation of the capacity of these culverts is our neighbors in between this whole thing have plenty of capacity because their culverts are short. uh the longer the culvert uh the the more or the less capacity uh a culvert has. So these 240 foot have

less capacity than our three and they seem to be the limiting factor not even accounting for the other runoff on the other side of the road. We're in a lower part not the lowest part of the road. Um, so these culverts crossing the road have to handle everything coming from us down our side of the road as well as what comes from the higher part of the road back down at it and they get overwhelmed uh pretty quickly. So,

uh, I'm here to ask for some help and I and I've tried I have uh spoken to to Calvin and I've never met him personally. Meet him. [laughter] Uh and we didn't we didn't have a chance to chance to connect. Um and with the urgency of the road work that's being done right now on Cedar Pond, um coming to to sort of look for help and and and support. I know it's really hard to do things rapidly. Uh, but I wanted to see hopefully we can do something about this by putting in a third or even a fourth

culvert of that of those same dimensions. That would um increase the capacity of that crossing so that it would take all water from every direction. So, what are the covers now? Diameter. They're they're all 24 inch. Everybody has 24inch culverts. There's [clears throat and cough] two 40footers going across Cedar Pond. Our neighbor has two 20footers which actually have four times the capacity of the 240footers and we have three 40footers.

this situation at all or I mean, we have no historic uh data that shows that we've ever had a problem with the road. I mean, I don't know what's happening upstream at your house. You can ask the fire chief if we how many times they pumped it out,

right? No, but that would be I know. I'm saying as far as I'm saying as far as the road, our what the town is responsible for, but never there's been no issues that I've ever heard heard of. So I I pretty typically all I'm looking

for is those culverts have been in there for 20 30 years and and historically they have never had a problem with the road. If if it's if there's some issue with how what elevation you put your house at upstream. I I don't really believe the town should be getting involved in in that. I think that should have been something that you would have had or your predecessor or somebody would have had an engineer or a site evaluator determine

that. I understand you have a problem and I just I just don't know that it's the town's position to fix it. Well, I having been in this house for uh 3 years and hearing stories from people who are familiar with this property. Certainly the property has not been there as long as the culvert the the crossing has and the

the sighting of the and the level of the foundation and the house you [clears throat] definitely plays into that. I can't disagree with that. However, what even with our our groundwork that we've tried to do with this, it still is creating a recurrent problem that does create expense for the town. If we have to call the fire department to get this pumped out there, I'm an understanding that it was a pre-existing condition. Uh, still the simplest most cost effective solution would be to increase the capacity, the flow capacity through that road.

What type of cover are the ones crossing the road? They're polyethylene. So, they're smooth bore. Smooth bore. Okay. What type of colors are smooth bore? Same type. Black ATV. Yep. Everybody I think everybody pretty much has the same thing.

Some people do have some corrugated metal and that Yeah. How old is your house? I'd say 16 yearsish maybe. Give or take. Bill, maybe I can interject something here. [clears throat] Calvin, have you shot any grades on that house?

Okay, Mike. I got you. I got you. Mike, when your house the water comes in from when since you've been living there. Is the water coming through your walk out? Yes. Because I'm not an engineer, so let's let's make that very clear. But um you know where my house is, right? Um I live basically across the road from you.

Yeah. So the elevation of my lot per se is what I shot and that's really all I'm speaking of. Yeah. When I built my house, I had to put about 2 ft of potato rock underneath there to get above the water table. Mhm. So what I'm getting at is that water table's really close.

Yes. If you shoot the bottom elevation of your door Mhm. I think you're within inches of that water table. I have not done that. I can't answer that question. I'll be happy to help you out as a neighbor. As a neighbor, I'll be happy to look at that.

You got a If you got a spare transit hanging around, that'd be kind of interesting to do. Maybe possibly borrow one. Um I don't, but I did back in the day when I built right if it the basement itself is dry except when this spills over. And that includes the

peripheral drainage around the foundation is dry. So we know it may be I don't know what it is, but the point is that the the foundation is above the water table and we're we're trying to uh the normal. Yes. Yes. Yes. Yes. We're trying to reduce the risk of having these repetitive floodings.

Do you have given the situation that it is? Is it a sump pump in your basement or what is the setup? Yeah, that's the next step. We have portable goodness. I I I only say that I when your house was for sale back, I have a friend, he actually lives on Timber. I actually we looked at that house. He was entertaining. So, we went through that house pretty thoroughly. Um and the first recommendation cuz we had somebody over there look at it was um to get rid of that water problem would be to seal your um your um walk out door.

And we do that. you maybe put some windows up there or something and then frog seal that with like a like a very heavy coating and then fix the grade so the water slopes away from the house because I I'm not certain and I by all means Calvin is the expert and maybe the guy to the right of me can answer this but it's very hard to alleviate the water table and once you inc once that water starts pouring I'm sure this happens like when we really get

maybe every two years when it really raining pretty heavily and that water table's going to raise and if if your house is at any low. You can put three cell pumps down there. I don't think it's going to help you much. Yeah, it would have to be pretty high capacity to keep up with that.

So, I think the key question though is what if any responsibility does the town have um with regard to the caller sitter crossing the road and if we do have some sort of you know responsibility obligation is now the time to do something while there's work being done on that road. The problem is this that even if we wanted to do something, we're exempt from NRPA permitting if we do in kind of in kind if we're just replacing what's there. But the minute I change the volume of water,

I'm impacting somebody else downstream. Uh and and and I lose that exemption and then it's got to go through a full peritting process. Mainstream. I don't I haven't even looked, but I don't think it would be. I don't think it would be but it is

but it would still be it's still a stream and it runs I think it runs all year. No, it dries up from time to time. It can depending on the depending on the year you get the torrential. Is this in the subdivision on Cedar Pond?

Is it in subdivision? No, no, no. It's not in country lane. It's on It's actually on Cedar Pond. It's on Cedar Pond near the river. No. Okay. Up from the river. is a channelized deep channelized meandering stream channel

but it's you know there's nothing inhibiting that. I mean, you got the wide widened out so that it will take as much flow as possible and it come cuz there are some things you can do to increase capacity cuz did you um you're probably a better engineer than I am doctor [laughter]

letter and and your calculations and so forth um look good. Generally, we use Manny's equation when we're and it's and we treat covers as open channel flow as opposed to a pressurized flow. So, I don't think it's an 8 to one difference based on length. Actually, most times length only really matters with friction

in in a culvert usually. Okay. Right. Um that's assuming everything's perfect. And smooth board pipe actually you figure essentially zero for your friction coefficient. So, I don't think it should be it's not an eight time difference. Now, I'm not saying that there's not some effect for us,

right? Um, and you have he there's two in the road and you have three crossing your property or you have No, we have three 24. I mean, that's just simple math. It ain't going to take [laughter] Right. Right. Okay. Three above it, two.

Yeah. Well, it get it got a little tricky when when our we were trying to figure out if if our neighbor at 85 uh had similar capacity. Okay. And you know laminer flow being what it is that length does make a difference when those culvers top out.

You're talking about the accidents. Okay. So, but it's as fascinating as the engineering discussion is, it's really it's it's what's can we do anything is the town's role here. And I'm hearing from Calvin that I think permitting is I think you're changing changing that's definitely that meets the definition for streams of mineral channel to me. I think we're going to I don't think we will be able to touch that without permitting in place which sometime

that's a longer process. It's probably outside the window of when that road work's happening anyway, right? Favor sitting on the road now. Yeah. So, just drove by that tonight. Well, you can affect the stream, but can you add a smaller 12-in cover upstream that would intercept before it goes over something like that?

I get that if if a if if another if another culvert were to do it across the road between um our and our neighbors driveway to take that volume uh that would probably do it. So you're saying your house is here. There's another house here. So here's the stream crossing the road.

Yeah. So you're the second house back. Yes. Okay. The first one has how many? Two 20s. You got three. Yeah. Three going into two. 24s, but that's on private property. I can't go on your neighbor's property. Maybe if your neighbor was willing to add

No, it comes right through our neighbors and right into ours. So when we get back up, the neighbors culverts because they're shorter don't have

Oh, cuz now it's flowing back towards your place. Well, it it backs up. It It doesn't It doesn't It flows fine through the neighbors culverts. It backs up at the road culverts and just keeps piling on top of that. The neighbors culverts continue to have fairly decent flow because they're shorter. And yours are upstream of the neighbors.

Ours are upream. It's ours neighbors road. I mean, we could shoot some elevations. See, you know, that's something that I can't I can't tell you how many folks that we put in when back in my day when building. I don't want to digress here, but

I can't tell you. Everybody wants a walk out basement, but not all lots are suitable to walk out basements. And what happens is sometimes people get what they want and then there's sometimes there's repercussions later on down the road. But I think the simplest approach to see if the culvert theory my gut is if you do add that third culvert I still think you're going to have an issue when it rains.

I agree. If that if that door is below Yeah. where that water level is going to raise Mhm. So let's shoot some elevator. That's what I mean. Let's shoot an elevator. That's the only way to really know. The point is the the water level does not raise up to the level of the basement floor if it has plenty of flow through. It only raises up high enough to flood when it backs up from those road culverts. So if there was increased capacity u downhill of our three

Yeah. that would prevent or at least drastically reduce the backup. If your property is at all going towards your house, I have to agree to rich. I had a pool in my house for 20 something years. We took it out a couple years ago. Before I took that pool out, I had rarely ever any problems with my cellar. Since I took it out, we didn't get it built up the way it was. There's a little pocket there. Now we get a lot of rain. I get water in around the bulkhead. Now I've got to fix it to drain the other way. I never had that problem before.

As soon as I changed that ground, that's what happened. Yeah. I I like I said, not on the thing, but you know, you know where you know me, man. I I'll help anybody. Anybody knows me to help I'm sure, but I can't do anything on the talent capacity, but I'll be more than happy to go over there and we can do the math. You know what I mean? So, I think but it will it percolates up through the floor. Yeah, it will. So, it doesn't. And whether we we we could put a bulkhead there. We could wall that off. We could seal it. We're still going to have water percolating up through that floor.

Well, again, if your drains are lower than the uh if your drains are lower than the um the water table, when that water table raises, and it will raise when the rain comes in. Yes. Boom. You can dig out underneath your thing. Look for mottling. If there's mottling underneath, let's say 2 ft below or a foot below, and that's always wet. And then when it rains, that water increases up to, let's say, above the top of your drains, you're going to flood your basement. There's not there's not really much There are no drains in the basement. So what

you're saying there's no perimeter drains around your basement. There are no perimeter drains. Yes. Yeah, that's what I mean by that. You get above that inside. You wouldn't know the inside. Only extra to my knowledge. Well,

they could be tied in under the ti. I haven't dug in there. But I don't I'll be happy. I don't know what the but this is the even even putting that up, we wind up with the same thing. So yeah. So but I think if I if I'm interpreting your original email, you're thinking, hey, I got this water problem. They're working on the road. Can they just throw another culvert in? Problem solved hopefully. But I think it sounds like

the simplest solution. Yeah. But uh for it sounds like that's not really within the town's perview to do that. It sounds like a pretty involved u permitting process. It's not as simple as maybe we'd all like it to be. Well, however, however, my understanding is that there would be there's less likelihood of a permitting process needed if a culvert was placed across the road at another location.

That's what it's not in the stream, right? Just a just an overflow culvert the road to the other for ditching. Then the the other issue you said that the neighbor if he added a culvert to the neighbors, which you said you can't add to the neighbors.

No, that neighbors aren't a problem. So, but what I'm saying is maybe you could ask the neighbor if you could hire a contractor to put a culvert in there and see if that alleviates a problem. It will. It will not. I've already I've already looked at that. The neighbors are not an issue. They are not a limiting

uh factor in the flow there. No, go ahead. The thing is I just I don't know what's downstream. I don't know where I don't know if that how that impacts houses down below. If that's going to create more of a problem for someone downstream that we then become responsible for. That's why storm water management the stand storm waters

studies and engineers study all that stuff and I don't want to create a problem right if you can't just throw one in there to fix yours if downstream is going to cause another one then there'll be somebody else in here there's no housing between that road and the river at that low spot

it goes into that it goes across that across that land yeah so we're we're I'm going to move us along so we're not going to solve this tonight and so but I would encourage you you know having a conversation with Calvin and and you know generously volunteered uh

as a neighbor neighbor help his wife's a lovely lady. Just what what can be I know that can be done on the state road without right regular roll. And then we got the stop signs. And actually, we even had stop ahead signs. Yeah, I was gonna say I thought there was some stop ahead signs.

Something that I noticed today as I was crossing over, run around to Pond Road to Route 9 to go over to Rabbit Road, driving my husband's big old ugly truck. I had to go an inch out because those bushes are so far out past that memorial. You cannot see that hill by where the corn truck was supposed to be. And then I kept on going up to Rabbit Road. It crossed Route 9, went all the way down Rabbit Road and again where the Royalsboro Inn is, those bushes are so overgrown. Sneak out a little bit so I could make sure no traffic was coming.

Is it Is it on the Is that on the state side? So I I [clears throat] go called DOT the other day and I mean a week ago it Oh yeah, I know it was that much in a week. I'm happy to go out in a match just who' you contact at DOT. [laughter] He's the guy in charge of all these roads here.

See in the topsome office? I never was office. I just text him a call on the telephone. He shows up next. So is Route 9 a state road or state aid road? So we don't plow it or anything. We do plow. I think it's bamboo. I think it just the Japanese notweed, but he'll get you in touch with the right person. If not, I guess my concern was I think it warrants a little bit of looking into, but there's a couple of things we can do. We can definitely paint a stop bar if that'll help.

The signs on Rabbit Road are actually new, the stop ahead, and those do help. Um, and then the next thing that we can do, we can trim the bushes, we can paint the stop bar, whatever, if we decide we want to. Yeah, I we did before. I think we should have it there again.

The the last resort is would be if we do really want a light, the selectman can petition to the state to put a light up. Question for you. You know that little when you come over that big hump that goes from Durham into Brunswick and you see the flashing light with there's a slow crossing.

So, they don't have to go get state permission from us possibly, but the state's going to say you're going to bear the cost of it and you're going to pay for it.

Um, they do have a process where they'll put lights up at dangerous intersections and I think we end up paying the electricity or something, but I I don't know how it works, but I've done that and tops them before. study on those and they are going to put a stop light at the uh blinking light in I don't know center but they didn't think this one met the criteria whatever they use for their

but when did they do it cuz it's been four accidents since just in the last few months yeah I mean the one that happened last week where the guy was on route nine Yeah and got cleaned out I mean he's he's on the verge of you know he walked away from the accident now he's on the verge of death

so that was a case of stupidity though. The the guy coming off Rabbit Road just went and you're going to get some of that. They do that on both. They can't legislate that. I had a pulling glass cop pull right up in front of me. He got halfway out, noticed me. He looked the other way and drove off.

Yeah, I'll give you just a quick rundown actually in in in all um openness this he's actually a coworker slashfriend of mine that um but his son went through a pretty tough road with some uh with cancer the last couple years and fortunately he's actually looking like he's come through and going to be fine but Um, essentially there's a push to uh

by a 10-year-old girl who has cancer who's actually outlived her life expectancy so far to raise awareness for childhood cancer. And um what they want to do is get the state to proclaim September as childhood cancer awareness month. And so they they've requested the governor do a proclamation, which I've done that before. It's not always very easy to get. Um, but they figured if they could get as many towns in support of it as possible that would help the case. And so they've asked and they they essentially sent a an example proclamation. Um, and I could read it. I don't know how people feel about it or if um I mean I don't personally I don't think there's an issue. I think why not? It's it's it's helping raise money, helping raise awareness and um I don't think there's any financial considerations for the town. So, I think it's a good thing to do. Um,

did everybody have a chance to read through that? Do you guys have a copy of the sample proclamation? I don't do that. I read it. I don't think I have a copy. We don't have I mean, I could read it out for the minutes or for the record if you like. It's not too long, but says the state of Maine is going gold in the month of September to support childhood cancer awareness. Whereas cancer is the leading cause of death by disease among US children and is detected in more than 15,000 of our country's sons and daughters every year. And whereas in the state of Maine, cancer affects more than 50 new children and families annually where more than 400 children are undergoing treatment currently and where and where we are ranked in the top range of incidents of all cancers at 468.3 per 100,000 people. And whereas September is nationally recognized as childhood cancer awareness month. And whereas thanks to ongoing advances in

research and treatment, the 5-year survival rate for all childhood cancers has climbed from less than 50% to 80% over the last several decades. And whereas innovative studies are leading to real breakthroughs reminding us of the importance of supporting scientific discovery and moving closer to finding cures, though much work remains to be done. And whereas one in five children diagnosed will not survive during National Childhood Cancer Awareness Month, we remember the many children who have been taken from us too soon and we extend our support to all those who continue to battle this illness with incredible strength and courage. Um, and I think what we uh will respond to this gentleman that we will um the idea was to perhaps we should uh when um Ruth gets back since she's the one that ran the numbers and did uh the comparison that we uh touch base with her and uh get the most up-to-date numbers possible because I know she's she has edited them at least once since town meeting um which brought the uh projected um savings down about $80,000 from what was presented at town meeting. So, um we will get clear clarified numbers from her and then we can respond um to this

citizen with uh this is why we're asking questions and this is what we found out. So, I'm not really sure why we keep I think we should do that, but I'm not really sure why we keep going back to this project that's started over a year ago and it's pretty much finished. I mean,

To my knowledge that's not a accidentprone intersection, but that whole corridor from Brunswick to Gray uh where it crosses Route 9, 136 and 125, I'd be

willing to bet that accounts for 20% of our vehicle accidents in the town. It uh and I think actually at one point in time I prepared a list that uh if you travel that route, you can see numerous crosses. It's not just intersections, it's speed related as well. Um, it's a really straight stretch in a community that doesn't have law enforcement.

So, the other day I did see a state [clears throat] trooper on on Quick Meeting House Road and he was he was busy. Yeah. Well, I'm sure he was doing a good business because it actually you you'll think about that quarter. It's a nice straight shot at uh

Well, there's a state trooper that lives on where in Brunswick. It's called Durham Road there and he drives through there every day. [clears throat] So, that he's going to want to put that out there and say any anything we can do to cut down on it cuz it uh I

I don't I don't think it's just driver and attentiveness. that I think it's speed as well and the fact that you know I I know 90% of the time coming through the town of Durham I can travel at whatever speed I choose to get away with it

I'm sure they're going to try to market their wares, but it uh it's really to just kind of give us an overview of the industry, where the industry's at, what the industry requirements are. Um changes

it. Uh same thing on the 24th only that 24th one will actually be focused on the fire apparatus part of it. So uh 1900, what is that? 7 7 o'clock. So that's the same time the special town meeting is at. Yeah. [clears throat] 7 o'clock.

So I can't make that one because I got a previous engagement, but if you'd like, I can make the next one. Okay, good. And town meeting is going to be shorter than that meeting. So I may be able with that note. I may be able to make that [laughter] like stall for like 10 minutes.

It's it's working. Pretty pleased with how it's going. Uh [clears throat] I think within by I think once we get to September or so we've got two people we interviewed from outside the department to bring on to do pdeium coverage. Uh we have one new member that signed up for the department as well as we have two or three existing members that are completing licensing and stuff. So I I

think when we by the time we get into August we're yeah the gaps are going to continue to go down. So I I don't think we'll have it all alleviated come September, but I think we'll be very close to being there. So seems to be working very well and it morale and enthusiasm is definitely up within the department and stuff and I think a lot of it is a credit to the the stipens for the coverage and the commitment. Uh you know there's a little bit of a reward there for actually giving that type of commitment. So, any thoughts on because I'm looking especially Saturdays, you know, it's like a lot of empty slots like [clears throat]

Yeah. Well, my thoughts on Saturdays, my hopes are on Saturdays is right now I don't have the PDM coverage to start filling Saturdays and it'd be difficult to say, well, okay, this Saturday we're going to do PDM next Saturday. So, it'd be difficult to bounce back and forth and coordinate those two lists. My hopes are is that by the time we roll around to if not in August, September, Saturday switch so that daytime coverage is done with PDM and a driver because if you look at that list, you'll see a name on there. If it doesn't have a a two something number, a 213 or a car number, there's not an EMS license. They're just a driver. I usually can get a driver to sign up on most of the shifts. It's the EMS licenses that don't have. So, I need more EMS licenses and a few more prettier people. So, I'm thinking by then and that's Yeah, I think by September we'll start to see those weekends. They won't be perfected,

but I think we'll start to see the effects of the weekends. I hope. And would you expect are we going to have once we come back around to summer again next year, you think you'll have the same? No, I don't think so. No. Okay.

No, I I think this is actually building the system. Okay. Um, it's kind [clears throat] of I think this is a result of building the system. I actually think a lot of the systems out there, one of the things we didn't require is we didn't require that you have to be a paramedic. The pertium market is drained of paramedic. Paramedics can pretty much go wherever they want. Um, and so they're going to go with a, you know, otherwise in personal preference, they're going to go with the highest bidder. where our system allows for a basic who's somebody trying to break in to find a slaughter. I I don't think we'll have a major problem. We might see it down a little bit in the summer, but I don't think it'll be a lot like a lot of services experience. So, I think it's going to work well as we progress. So, I'm pleased with where it's at at this point. I'll put it that way. [clears throat]

basic pumps class. We have aerial operations just for our aerial ladder and just for our members scheduled to start in August. It'll go through August and September. It's uh for 12 people unfortunately is all I can put through it. Um it doesn't include driving. It just includes setting and operation of the aerial device. We're actually on tap to sometime during the winter months as long as they have the program will probably be one of the pilot communities for the advanced fire officer class. So hoping we can get people through there that would actually give those that took the basic fire officer last spring and winter would actually give them an opportunity to get certified as fire officer one and two. So we build on that program. Um the NIS I'm not going to repeat all that that's on there at the in for the NIMS but that basically was my previous report. The only addition to that, and I don't know, you may have

discussed it, was uh Joanne Pman, the county AMA director. The last time I talked to you, I said I'd found the PowerPoint presentation. And in a nutshell, they prefer to have be the ones that come out to do it. Uh and she said she had come out. I I told her that you guys typically meet every other Tuesday. And that my observation from previous boards, I don't know where you guys are at, was that previous boards would usually try to fill in the empty Tuesdays if they had to do a different Tuesday. So anyway, she put out that she would be more than willing to come down here and do it for the the board here at the station. August 1st or August 15th, her first choice, I think.

Are those August? Are those off Tuesdays or are those are meeting Tuesdays? What are those are regular meeting Tuesdays or No, those should be your off days. How long does How long does she anticipate? Maybe. Oh, two hours. Oh, okay. So, it's not like we could do it in a 30-minute workshop before

This PowerPoint actually is a homeland security grant cuz this is listed in our emergency action plan is the emergency operations center. So anyways, it the the packet that's going around is in reference to the 2017 uh homeland security grant. We believe receive

need one more. Yeah. No, I we received preliminary approval um for the purchase of 12 Motorola radios, $4,256. Homeland Security grants are fully funded. All we have to do is accept them. we have to pay upfront and they're reimbursed, but they're fully funded grants. It uh were put together on the the cover. It uh I was going to call Ruth and hit her, but I [clears throat] guess that idea didn't work. But [laughter] it uh was I need to submit a letter to go with the packet saying that hey, we we support this. It needs to be signed by the department head and the head of the community chair of the select department

names on there but I wasn't exactly sure who had taken the chair's position name to me every day. I [clears throat] think it chair of the board of selectment. Do you want to make a motion to authorize Kevin to sign it and it should be do we have actually gave you as part of the packet is I gave you the notice a copy and the

we didn't really make can we just have him sign it as consent or do we need to official motion We're we're accepting we're accepting grant funds. Yeah, you're accepting a grant and authorizing hope signature because if you read the the paperwork, it says I have to send the packet up with my signature in the

I don't know if Roose had it, but they are offering a flu clinic to come to the town office, fire department, Eureka, whatever, and provide a flu clinic for um, town employees and members.

Is there family members? Um I just don't know how many of the fire department would be. Do you guys get your flu shots? Typically when we do our in December we do our respiratory exams and our annual medical stuff and I offer flu shots but only the members only. Um

yeah would be for town employees don't take it in the first place. Do we pay for that though? No, this this they said they process insurance and for this is something if it were for people who don't have insurance, they would offer a discounted rate.

I just didn't know if there was any It's a business. It's a commercial solicitation for flu shots. Our insurance covers it. You just go and get it. Yeah. You just give them your insurance card and they process the paper.

Yeah. Yeah. But it isn't for like the whole town. It's just for the town employees. But I don't know. I I think I would my sense would be to pass because I I I I don't think it's any better opportunity than you could get on your own. Going into right aid, walking in

walk and get it at your convenience. Right. So I think I think their think focus is is trying to make it convenient, but we don't have Well, when it was like you went to work, you got your flu shot, you went to work. But we don't have that big of a staff here. I just didn't know the fire department if they had other means because you've got quite a you know you've got the biggest

US health works does that program the first Saturday in December they come in and do all our respiratory exams and TV titers if if people want them offer the flu shots as well but typically I think I might have eight to 10

out of all the people that you have yeah cuz I mean there's only three here only has I didn't think that there would be any big numbers unless the fire department had any. That's it. That was it. Okay. All right. So, upcoming meetings and town news. We have regular selectman's meeting scheduled for Tuesday, July 25th at 6:30 p.m. That's 18:30, I believe. Uh

and Tuesday, August 8th, 2017, also at 6:30 p.m. And I would make note that on July 17th, which is a Monday, at 700 p.m. at the Eureka Center, is a special town meeting. And the purpose of that town meeting is basically to allow funds uh to be used uh from the capital improvement budget and public works uh to support a grant to complete some culvert work on uh Auburn Panel Road. Um the uh grant covers the vast majority of the expense uh but we feel like we need to have a little bit of a cushion just in case we go over uh the estimate. Um it will not result in any appropriation or increase in taxes. It's purely uh a procedural uh vote to allow the funds to be used uh from the capital improvement account in public work. So anyway, the town we have to have a special town meeting uh to do that because the town has to uh allow for um capital improvement funds uh funds to be spent. So that's that's what that meeting is

all about. When is that funds are there? We're not raising nothing. Fun are there. It's just permission to use. When is that meeting? July 17th at 700 p.m. at the Eureka Center. That's Monday night. Monday night. Yeah, that's the vote. Next Monday, week from yesterday.

Will we be Maybe he just said that. Will we be voting on it then? Also, yeah, it's regular town meeting. It'll be a moderator. Same format. Same format. We don't expect as big of a turnout, which is why it's at the arena center.
