want to talk about that do I do let's hold it till the end though because we got a bunch of people it's all set to go okay uh in that case we'll go ahead and get started thank everybody for coming welcome to the March 6th 2024 regular meeting of the Durham planning board um and so we will
start with a roll call and determination of a quorum uh we actually have six members one alternate so we have uh five voting members so Mr Hutchinson Mr Pon myself John talet Juliet kaplinger Brian lenois are voting members and Mark dur is our uh is an alternate so uh thank you guys all for coming so we have a quorum uh amendments to the agenda are there any seeing none we'll move on to acceptance of the minutes of the prior meetings February 7th 2024 any questions comments if not I would be happy to take a motion to approve or disapprove prer accept them as presented move second I'll second moved and second it any other uh discussion seeing none if you uh agree please raise a hand you're voting yes the only uh question I have is when will these minutes be posted on the website what's customarily when do that happen I am not sure what the protocol is what Kim Kimberly is putting on the website so I'll look into that okay yeah
just very good she's she's been very responsive so yes she has she has but a good question okay acceptance of the minutes we're down to number four informational exchange on non agenda items we will start with Town officials Mr and I forgot to mention Mr thebarge is our town planner Mr thebarge if you would kick it off and I do just want to start out by apologizing to the public for the mixup on the meeting space uh over the last couple of weeks been a lot of transition here with all of the public meetings being moved over here uh the meeting room over at the Town Offices was changed to to an office so it's been kind of a transition and we kind of dropped the ball on notifications and the CMP notice that went out two weeks ago did indicate that the meeting would be over there so our apologies for the up on that uh in terms of uh issues to report to you um I did
want to point out that the of appeals has held two hearings on appeals of the resource Protection District map uh in the last couple of months uh in January they granted a variance for a lot that was in process when the map was revised the people had already started it taken certain actions to establish a lot and then the map went into effect before they could finish it in terms of the legal uh parameters or process for getting the documents recorded and everything so the board of appeals gave them the variance on that and then uh on February 28th uh a property on runaround Pawn Road appealed the determination based on Provisions in the ordinance where they can uh accept field verified information to say that the boundary is not where it's shown on the zoning map a more precise location and it did have a substantial adjustment and that's based on uh their uh conferring with beginning with
habitat inland fisheries and wildlife and uh really looking at that whole beginning with habitat six plus co-occurrence designation which is one of our criteria so Inland Fishers and Wildlife is going to generate a more precise map for durm they're actually in process of doing that and are going to send it to the town and we'll be talking to the Conservation Commission and you folks about possibly looking at doing a refinement of that part part of the resource Protection District for next year's town meeting and in the meantime anybody who has property that's affected by it can go through that same process of appealing to the board of appeals for an interpretation uh if they can provide evidence that uh their property or portions of it are not don't meet the criteria for resource protection uh and then finally just a reminder that next Wednesday there is a public hearing uh here on the draft
amendments to the L use ordinance dealing with housing density and diversity dealing with the uh solar energy standards and also with the fee schedule so that'll be uh next next Wednesday at a special plan we're meeting for the public hearing for that that's it any com say can I um I would
love to talk more about the um resource protection and the board of appeals maybe at the end could we add some discussion to the end sure if we have depending if we have time or if not next I would just love to hear more about what you're hearing at that school yeah sooner I guess sooner rather than later because our agendas are filling fast so
absolutely and George is assisting them them being the appeals board along with Alan plumber so I think they're they're working well together and appeals board uh is doing a good job any other questions comments about such
things we were one of the few towns that adopted that um habitat we're the only town in M that has used the co-occurrence map as a basic okay be interested to see if the department of Inland Fisheries um want to how other towns will see that as a as a goal future and we will kind of building on that we'll kind of go through the same process we went through last year in terms of amendments to the land use ordinance so we'll poll ourselves see what kind of changes or what things we would like to have worked on and then we'll get with conservation and appeals and and somebody else so we'll go through that process again uh this year this coming year anything else yeah pardon me CMP okay that's this as good a time as any uh there's a lot more on the agenda I'm talking about what's on the agenda so I know but your agenda is different than a lot of ours but the only agenda that matters this evening is the one
that we posted for this this board meeting yeah but yes so I'm about to get into that that discussion so okay but we have two other things so residents who have public comment that is not not on the agenda and before you start let me just say that uh during the discussion this evening there is no public comment being taken so before you throw anything at me uh one of the things we will discuss as a board is do we want to have a public hearing at our next meeting we have to give uh I don't know s 10 days so if the this group wants to have a public
all yeah fading here okay they may have not changed that fading you can borrow mine so I'm sorry uh technical issues so this evening we're not going to take public comments on the CMP project but this is a time I plan to inquiry the board do we want to do a public hearing on the CMP these three items at our next meeting I see one head shaking yes I'll I'll make a motion that we do have a public hearing on the CMP transition line a waste of time application okay we have a motion is there a second we have a motion in a second any further discussion seeing none all favor of holding a public hearing uh at our Fe excuse me April meeting please raise a hand okay so we will have a formal public hearing at our I'm not sure what day the April meeting is so really have any questions I just wanted to know what they was planning on doing there's no question okay well it's a simple answer you know yeah okay we we're not going to
keep getting and I appreciate your concern but this is not the Forum to have uh conversations a from CMP coming down to this meeting and on the agenda take any questions I don't have any questions I want to know what they're doing what they're planning sir they're going to be doing a presentation
we are public hearing okay so that any other comments on things not on tonight's agenda from any non-residents who have uh comments about uh things that are not on tonight's there is no continuing business will'll new move on to new business so uh before
us tonight is a CMP uh application for three things one is conditional use second is a completeness review of the site plan review application and this third is a substantive review of the site plan application so what I propose to the board is that what we do is uh we
go through the uh conditional use application and we let uh the applicant uh talk about their application for conditional use Mr thebarge will join in and then we can discuss that we will not take a vote this evening on the conditional use or the completeness or the site plan if we get through it all we'll do that after the public hearing next month is everybody okay with that that concept and that way we when we do our votes next month will have taken into consideration public input so there seem to be a desire to keep this thing moving so oh please are we gonna hear from George first maybe explaining what we are able to like review what we have jurisdiction to review Authority versus what we what we're not i' i' be happy to go ahead started off briefing yeah so I did provide in the agenda notes kind of an over review of the project and the process for review um they are proposing uh to uh do
removal and replacement of existing poles as well as installation of new poles to facilitate an upgrade to the service lines on the Westerly Corridor that runs north and south uh the project uh only requires conditional use review under our uh zoning regulations for the portions that are either within the state mandated Shoreland zon or the town's resource Protection District uh everywhere else it's a straight up it's a permitted use and they don't require any planning Board review for the use uh the applicant uh also will need
uh as part of the planning Board review a review of the flood plane aspects wherever they're working in the flood plane uh and so they will also need a flood plane permit from the code officer and the things they typically look at you know usually that's with buildings being built in flood plane they want to make sure they're flood proof uh and then also make sure that any filling is done is is part of the development is not push flooding somewhere else so there really isn't a lot involved here in terms of the flood plane management regulations but they technically need uh permit from the code officer and uh the planning board needs to consider that as part of the old review process um the they have provided an extensive packet there's 700 pages of document uh in this binder which you also received as a uh pdf version digital uh and in narrative in section five of The Narrative they've addressed the site
plan review criteria and standards and they are requesting uh three waivers on the submission requirements and I'll ask them to clarify as I understand that they're looking at uh not being required to do a boundary survey for the entire power line quarter all of their work is going to be uh on the polls pretty much toward the centers of the of the uh easement or land that they own going up through there so they'll make a case that they shouldn't have to provide a boundary survey of the entire Corridor uh which is the project location um they're also going to be looking at uh just the scale trying to standard scale for for a site plan is one in goes 100 feet uh with this length of this Corridor uh if they put it at that scale it'll be you know across the room so they're looking for a reasonable scale they've given you some cut sheets in this uh in this binder that kind of shows the and so that's one thing you'll
have to look at uh and then there was a third one that is skipping me oh it's also where the you have a plan where the planning board signs off uh that was the third part that they're looking for uh section six of their narrative explains how the application conforms to the flood plane management standards exhibit one uh is one of the uh tabs in here and that's their site plan review checklist and all the forms that go with it uh for site plan and condition use uh
and the waiver requests for those three waivers that I mentioned uh exhibit two contains all the permits uh one of the requirements of site plan review is that if you need state permits you have to give documentation uh that that that those have been issued or will be issued so they've uh they've gotten permits from the main Public Utilities Commission from uh the D and from the land use Planning Commission obviously that's another part of the state doesn't involve you uh and exhibit three is documentation of right title or interest to conduct the proposed work uh they provided deeds and easements for the whole Corridor uh exhibit four is those air photo overlays that show the pole locations and some of the resources that are causing uh the reviews of shorel zoning and flood plane and resource protection uh and actually the scale according to those is 1 inch equals 250 ft so we should clarify what scale they're asking
approval of exhibit five is a cross-sectional view of the power line uh at select locations and exhibit six is the post construction vegetation management plan exhibit seven is the Environmental guidelines which seem to be kind of standard procedures that they use and have been approved by D and other Regulatory Agencies for conducting work in Wetland areas and streams uh
proximity exhibit 8 is a standard uh the standard measures that CMP requires of all its contractors in working in those areas uh in terms of protecting against accidental spills of chemicals from vehicles and Machinery into the environment and these kind of tie into some of the conditional use criteria in terms of it can't cause environmental damage or public health risks uh exhibit nine is a letter from aeng grid that addresses Financial capacity of them to do this project and keeping with the regulations and the improved plans that's both for conditional use as well as for site plan review uh exhibit 11 is a compilation of deed restrictions easements and rights of ways and other incumbrances another requirement exhibit 12 is a memorandum of agreement between CMP and federal uh a state agencies on how it will meet historic preservation guidelines again the site plan review standards require them to indicate that
they've contacted such agencies but Durham's planning board does not review anything to do with historic preservation exhibit 13 is the list of abutters and and the abutter notification letter and due to the volume of this application uh we posted that application as a separate document from your agenda packet uh and I did include draft letters of a complete application for plan review and letters of an incomplete uh application and if you uh decide that you the requested waivers do not meet the standards or if they're missing any other information uh that you see as being required then you would give them an incomplete letter give them uh a list of deficiencies that they have to address uh then they would come back for a completeness review Once you determine that the application is complete you have 60 days to Rend your decision um and then finally uh we did mention uh
you you mentioned having a public hearing on the application at the next month's meeting uh you should also discuss and decide where do you feel you need to do a site walk for any or all portions of this project site okay we'll hold on the site walk decision till we we look and see what what they present any other questions or any questions at all from Mr
applicant to uh come forward um so a couple of couple of things first off I guess I I should start with I received a notice as an utter uh I don't my property doesn't touch the power line uh nor am I financially um involved in the power line project or any CMP stuff so uh I don't feel the need to recuse myself unless somebody Mark as our alternate really wants my you're not adjacent I'm not adjacent there's a there's a parcel or whatever yeah I'm within the 500t window there are properties between my property and the uh power line I'm fine with that also fine seeing none sorry Mark you're still okay okay so those are my two
things so Mr C um I just wanted to give you a couple things these are the receipts from the butters list and this is the application check thank you just want to make sure you have and please before you get a couple of things would you if you're going to talk from over there which is fine you can sit right there or you can sit there but please speak into the uh mic for me please and start with your name address and what your role in this project is um thanks for having me tonight uh my name is Sam rice I'm the pering specialist I'm with Burns McDonald on behalf of CMP um I've been working on this project for a few years um so I have a good handle on things so tonight uh we're here to talk about the 115 KV transmission line section 62 rebuild and then also the 115 KV transmission line section 64 rate um so real quick it's as far as a rebuild versus a rate um a rebuild includes replacing all the poles and
then a rate is more so targeted where some poles are going to remain some poles are going to be replaced some poles might have some maintenance as far as the hardware goes um and then also things like um new guy anchors which are basically those kind of uh uh wires that you see um to the ground to the transmission line poles and then also um cross braces which basically are just support for the the the um transmission line poles themselves um so how do I
this guy right here all right uh with me tonight behind me um we have uh Jerry Mory he's uh the director of uh permanent in compliance for CMP we also have Adam Marquee he's the project manager for CMP um Lisa gilberth with Pierce outwood serving as legal council um Troy thibo um who is with Berns McDonald serving as a public involvement specialist um on this segment of the project but also other segments then myself I'm the permanent specialist for B McDonald on behalf of
is proposing to uh rebuild section 62 and rate section 60 uh excuse me uh rebuild section 62 and uh rer section 64 um some of this might be redundant to what um Mr thear was saying but the projects is considered an essential service under the land use ordinance um and requires site plan review and conditional use approval from the planning board um but also includes um flood plane approval from the code enforcement officer and review by the planning board and when you're talking about you'll show us um the Aerials or something that shows what a 62 and a 64 is ye yes yeah so those so just whenever you're ready I just want sure um so this
this map that is on the right side this is basically um if you go to ex the first page of it and it'll show kind of the the way the transmission line goes for approximately 4 and2 miles um between Auburn and pel um and then the the project itself is entirely located within an existing Corridor um because the the the lines themselves are already actually existing in that transmission line Corridor um it'll be built entirely on land that is already owned in fee by CMP and then it won't be needing to be widened at all it's just going to be in that Corridor so on not you don't need to get any additional easements or like it's all within it's yeah yep
after I'm done but um so the project concludes uh replacing 49 poles in section 62 and then also 16 polls on Section 64 those polls will have an average height of 71 feet uh the project also crosses three uh resource protection districts which are runaround Brook a tributary to runaround Brook and also a unnamed uh excuse me uh Libby Brook and then uh there's also the limited residential district with it uh as a result of a wetland um three poles within that limited residential district will need to be replaced those are already existing polls that we're merely replacing and then also one poll will receive maintenance um and then in Durham the project also CL crosses uh three flood Hazard areas which are the same as the the resource Protection District those are Libby Brook an unnamed tributary to runaround Brook and runaround Brook itself um no polls are actually going to be placed in that flood Hazard area um
and then the project itself crosses the rural um residential and Agricultural and also the resource protection land use districts and then U you know as far as the the land landcape that the the transmission line Corridor crosses it's largely forced land in a few agricultural areas so I don't know I'm going to hop up for this one but um this on the right side pointer on oh is pointer red button red button let's try okay cool um so I believe it's exhibit five in your um application packages are the cross sections what this is is basically if you standing out on the right of way it would be your view um I know I know it's pretty tough to see on this one but I'll do my best and then you can call on EX five oh I'm sorry yep
I forgot about that um so on the right side um if we see this poll right here this is um transmission line section 3026 that's an existing transmission line that's not included as part of the project it's going to remain in place um and then man I can't I can't I can't see that but I think that's um does anybody can I borrow that actually cool thank you so much uh so section 64 is in the middle um that will be our R-rated uh transmission line and then on the left side is section 62 so up top here is basically what is currently existing out in the right of way and then this this cross section is a little bit different in the middle it's you're going to be seeing what is permitted at the state and federal level the reason why that is the way it is is we actually have a permit modification that's before the United States Army Corps and uh state of Maine the reason why that's happening is there was a
study um as as part of the iso New England interconnection agreement and we've tweaked um the design to accommodate that study um so ISO New England is the basically the bulk energy supplier Corporation for all of New England um so we in conjunction with them are making sure we cross our te's and Dot our eyes with our design um so this is our proposed at the bottom um that's what's before you tonight and also before the state and federal government um so section um 64 is
actually going to be brought in closer to the center line than it currently exists right now out in the transmission line and then um the other transmission line I forget if it's I think it's 62 is in the middle um does that make sense to everyone yeah can I ask you what is the difference between what has already been permitted and what you're asking to be permitted so originally yeah sure so I believe uh
they used to be both rebuilds and now section 64 is a rate and then I think we changed the uh the transmission line pole configurations from monop Pole to um uh H frames I think correct me if I'm wrong Adam that's exactly so currently at the top like same I'm saying section 64 in the middle is the H frame configuration so if you just skip down to the bottom it stays in the same center line so we can reate that as it currently and then like s said2 come closer to it
sing so the location from what has already per has is the same like the poll locations and all uh they've TW they've tweaked but again that's that's being that's all being being reviewed with the core and the mdp yeah for sure a very high level team going to speak okay understood understood y just okay
just at at a very high level because you know I'm a lawyer not an engineer so I think about it name and address yes Lisa Gilbreth I'm with Pierce Atwood I reside in Yarmouth I work in Portland um um so a very high level um the top is existing the middle is initially CMP thought that they had to rebuild both lines so that's what they got permitted at the core and at the D um but then ISO New England conducted their interconnection studies to see what needed to happen um to these upgrades to interconnect to the existing system and they determined that they didn't need to rebuild the middle line they just needed to rer it so that's replacement of what's already there um you know replacement or maintenance on existing lines rather than a rebuild and so that's why you see the change and that change is already before the D in the core for their approval the change is the bottom the CH the change is what
we're asking for Durham's approval because that is what will be constructed and so that's what's before this this board and the D and the core okay and may I ask this is crossing several different communities it's the same throughout other right not just in Durham
throughout yeah so for all of line 62 and all of line 64 these are the that's what they're asking for in um Auburn and pel as well what I recommend is you keep if if you got the tap the copy or whatever you keep this handy because shortly you're going to show us the Aerials and I think 62 and 64 make a lot more sense when you talk with the Aerials in front of you sure sure um so some some high level information as far as the project and Durham there's going to be two single poles and then two double poles and what double poles is is basically a single pole is a tangent pole it's just you know you're regular if you see them on the side of the road granted a little bit bigger on a transmission line but single pole and then uh two double poles will be install in Wetlands resulting in approximately 91.4 s square fet of permanent disturbance so uh unfortunately when you have such a large linear project you're going to
probably run into unfortunately some some impacts of Natural Resources this project has been designed to impact natural resources to the least extent practicable unfortunately the 91.4 S squ ft is just a result of you know the linear nature and the the large size of the project um so in areas where access
doesn't currently already exist and is readily available will be um installing temporary accessways which will allow construction contractors to get in and do the work in the right of way um and then temp uh Timber mats will be used to cross wetlands and fully span streams in order to protect those natural resources so with that being said there's not going to be any instream work meaning below the you know ordinary high water mark you're not going to see us putting anything in the Stream there's no poles nothing like that um and then temporary accessways and temporary structure pad areas which are basically the area surrounding you know the pole because the crews have to get in there and large equipment has to get in there those will be restored to preconstruction conditions and revegetated um it may take a year or two with the you know the the um vegetation growth as far as growing Seasons but
it's going to look extremely Sim similar to what's already out there um and then Construction in Durham is anticipated begin in May of this year and then complete by May a certificate of public convenience and necessity uh from the MPC on May 3rd 2019 and then also got our site location of development and natural resource protection act permits from the main Department of Environmental Protection on May 11th 2020 um and then also United States Army Corps Engineers um issued their rivers and harbors act section 10 and clean water section 44 permits on November 6th of 2020 um that being said we do have a few permits we're chasing down um the project is in process of obtaining MDOT utility location permits and MDOT driveway entrance permits as well as um driveway entrance permits here in the town of Durham um obviously separate from we're doing here tonight uh and then also in that kind of same vein we're also
separately going to um and pursuing the building permit with the town's building inspector um my colleague will be doing that separately um and then also as we were talking about earlier we do have a minor revision application from the the state of Maine um and the United States Army Corps and that was submitted in December um so with all that being said we're not going to be doing any construction until we have all the necessary permits so that is my presentation not so fast uh do you have
the uh the green the Aerials with that stuff do you have them on a computer somewhere I can put them on please George sure because I think that helps the discussion absolutely are we have questions please um do you think that you'll know where your Crossings will be before our April public hearing when you say Crossings um your public when you're getting into the property as far as our access Ray yeah yeah so those are depicted on exhibit four that's George has got to put it up yeah yeah we can walk through every page of those if you'd like so so when do you expect to have approval on those Crossings before our April public hearing we will have I'm confused where so so as far as you said that you said there you were still waiting for approvals on oh right oh you're talking about as far as um the the driveway entrance permits so that could happen any day between now and when we go to construction but what what we're
planning on is exactly what is depicted in your Maps yeah I'm just expecting that to be a question from the public where these are and have they been uh approved right yep so so you know again we're fully planning on what is depicted in okay the maps and have well mot has no when you talk M do driveway permits you're talking along about State highways um town roads I think some town roads are and my colleague Adam um has someone working separately on this I'm not actually the one pursuing the MDOT permits but uh I believe some are maintained by by the state that aren't necessarily you know routes I guess per se because if there's anything on the town that has to go through Public Works Public Works director right and that's what we what we said we're we're also pursuing um driveway entrance permits so that will cover that yep okay and those are shown on on the figures yes yeah yeah so uh just before I show those uh slides
that show the actual power line just to show this slide that I prepared today to illustrate zoning uh so as you look along the corridor this is an overlay of the zoning map so these are the areas that are Shoreland zoning U the Orange is uh lied residential and the red is resource protection and then the green is the uh Durham resource protection which includes wetlands and uh so these are the areas that are affected in terms of Z and uh conditional use reviews so now I'll pull up the
every all I think it's 11 of them uh Pages if I'm not mistaken of uh that areial that we're looking at so maybe some representatives and in particular the ones where you're Crossing flood plane and where your uh the resource protection areas uh just Jerry Mory I live in Rockport Main and you're with CMP I'm sorry you're with CMP I am and I just wanted to clarify the driveway situation so um the driveways onto the right of way are existing roads or drive entrances from those roads onto the onto the uh transmission line RightWay and um the reason they require dot uh driveway entrance permit for state or state aid roads is because dot requires a permit when you go from a an existing use which is an operation and maintenance driveway onto the RightWay to a construction use we're not changing the driveways or creating new ones we're using the existing entrances that we would use for operations and maintenance but we're
simply using them for construction during the rebuild and the Rite got it so there's no new ones proposed and is this a requirement just because of your utility it's a requirement because of a change of use from onm maintenance to construction because that's the way do regulates y that's very helpful to me thank you thank you do we want to I don't know if this is going to help anybody turn off the lights I'm actually having trouble seeing that myself I have pretty good Vision get the one that's not right in front of me yeah um that didn't work so yeah that's
that's nice so um as George said I think we actually had in our application that there these are one 1 in by 200 but it appears that it's actually sure um 1 in by 250 so um these plans again they're because the project is such an atypical project it's not like you know your your regular development these types of maps not only for CMP but you know other utilities are very normal as far as the proportion goes um so what we have here um up on the top I don't know if I can see okay can everyone see that yeah so this is section 62 um and then very very faintly you can see section the existing section 62 out here and what we're going to be doing is taking that line and basically pulling sure um pulling this transmission line into the center of the right of way um and then where you see kind of this is where we have planned aess roads um again everything that we did here was designed to mitigate against Natural
resource impact so we went through as you can see here this this Wetland there's just a a tight it kind of tightens up here so we put the the axis Road in here um to mitigate impacts to that Wetland um so let's before you leave that one to so I think if you're looking at your the book or you're on your computers if and I want to make sure understand that where you're taking the 62 out the the existing line 62 m is
that the one you're removing we are rebuilding that which one are you destroying uh we are demolishing the existing 62 pulling it over and rebuilding it that's okay I so that's what I meant so because the reason what I point trying to point out here is that on the pictures you will see a line 62 and where the where I believe the pole is there's a yellow circle with a black dot and that in the legend that says destroyed yes yep so I just want to make sure that if you look at that you can find out look at that in which one so on there I would assume it's the topmost one if you see the little yellow circles with the black dot that line is moving and where the black and correct me if I'm wrong where the black dot is that pole is going away yes sir okay
yep any other questions while we're on this page and let us know if there's uh the W where did you hit the wetlands and the the resource protection areas sure I don't think it's so just before we move every you see this this line green polygon here that's a wetland yeah and where you impact them where you going at um because not every map or do you impact them right so you can see we have um an access way right here um that's going to be going into I think that's uh pole 6239 uh again we're going to be using Timber matting it's very typical to use that and what that does is it displaces the weight over farther distance than you know if you were to just take your equipment and and go over it um so it's it's much better for natural resources to kind of displace that um and again a
lot of the stuff as far as temper impacts if you give it a growing season or two it's going to look the same way that it does out there right now um let me try to and if if um you have anything or want me to stop yeah the what there's like map 10 I think has the wetlands where you're putting poles and where you're actually impacting the Wetland sure and then there's a historical structure somewhere in there that you're going to fence around and protect yeah if you remember where that it show know where that is um so here we're at the uh The Limited residential district there we go um so we have have poll 6252 uh poll
6254 um and again we have you know these are these are um already existing polls that already reside within that um and we just there's no way for us to really engineer around this because of the SAG and and the the pole Heights that would be required to not put poles in there it's just not it's not practicable uh does that make sense to
everyone um and some of these you're going to see if you're you know as you continue to look at our application you'll see these red dots for poles and those are our maintenance structures again you know that might be replacing certain Hardware components might be adding a cross arm and might be adding a guywire um but the pole itself will actually still be there so all of the structures in section 64 have already been surveyed so you know which ones are corain yep
because you're telling us you don't have to do some stuff because they're not structures so you're talking about poles right uh yes there there yeah yep temporary Wetland impacts here um just going District I honestly offand could not tell you what water body that is um it looks like it might be runaround brook or liby Brook um because it's is it l

clarify that just because something's in Shoreland zon doesn't mean it's in a wetland so the Shoreland zoning limited residential district extends uh 250 ft from uh the emergent Wetlands so that may not be Wetland at all that they put the bow in yeah except in the in your verbi it says specifically I think that it's there are some there are the four of them that the way I read it and that's what I'm asking actually go into the ground inside the Wetland inside the Wetland or inside the Shoreland zoning District I'm sorry Shoreland zoning but the Wetland is inside that trying to clarify I was clarifying that just because something is in the limited residential district that doesn't mean it's a wetland it's it's actually a buffer for wetland so the chairman was trying to verify which of them are in wetlands and which are in just in resource in The Limited resid shild District I think 6279 is the only one in

important is that if it's shown on the map and we know know where it is and you're out there work somebody's out there working in the wrong Wetlands we can say that's not what you told us does that make sense sure so that's that gives our our uh CEO code enforcement guy uh some knowledge on where you should be uh working where you're working or not one thing that might help an interpretation is to use a get rid of the air photo base they've got that just a base that just has a um typical mapping background might make some of these features stand out better so you're saying not a satellite right use a use a map base instead of the satellite photo and it would still have show the wetlands and all that other stuff that'll show up the wetlands and everything much
um shely one second so we have a direct response to essential Services I just wanted to read this it's on page um 4-7 of our application package so um these are the this group is within the uh land use standards um specifically we're going to talk about item K here um considering the project is an essential service so it says where feasible the in installation of essential service shall be limited to existing public ways and existing service corridors obviously here um when you know proposing these rebuilds and rates um will be wholly located within the cmp's existing transmission line Corridor um on land and CMP owns um so and then number one
two it says the installation of essential Services other than road side distribution lines is not allowed and a resource Protection District except to provide services to affirmative use within said District or except where the applicant demonstrates there's no reasonable alternative that exists where allowed such structures and Facilities shall be located so as to minimize any adverse effects on surrounding uses and resources including visual impacts so our response to that um includes you know the the cmp's existing maintained transmission L for or crosses the RP and LR districts in Durham po 64197 hey Sam would you hold that thought because what we're what we're going to do is going to walk through our conditional uh you conditional use requirements and when we get to whatever that one was we'll discuss it sure rather than bounce around if you don't mind y absolutely so sorry for not saying that
earlier is there anything else in general that you want to bring up or the board would like to ask John did you get your answer questions about where the nhpa location is the what I'm sorry the historical yeah I don't uh I'm I'm hoping that he will and hope hopeing assuming is not a method but that he'll provide that next time there's a historical structure you're going to put fence around what we're trying to do is identify oh you're yeah the histor not this evening but yeah uh one one quick thing again we I'll get the numbers for you but I was just down on page 4-12 um for number four criteria for
issuance of the storeline zoning permit um and it talks about spawning grounds fish Aquatic Life for or other wildlife habitat so there we do talk about specifically in the LR District hold on to it we'll get to it okay all right so if you would all right yeah so we I've been asking a bunch of questions that that threw off your presentation and I apologize that's all right so what what I recommend we do now is go through the the first step is the conditional use application we go through the criteria for that we're not going to vote to approve it tonight or disapprove it whichever um but if if we could have if we have any questions as we're going through these uh that would let the applicant prepare uh will hear the public comments next month go back through them see if there's any other discussion we want to have on conditional use and then vote on conditional use and the same with site plan waivers and all the
other so I don't see any head shaken no so um it looks to me like we you've got everything many things written out here nicely on page 4-1 of your application and so we don't need to re read all of that if you provided a lot of information on public health and so on and so forth but if you could just kind of give us the bullets on why you think there is no public health impact don't need to read that page and a half um at a high level you know that
you've got in your application you've got just got us some summarizing want you to summarize these pages of sure um you know cmp's designs here are you know designed to have certain electrical codes and make sure that they're you know adhering to Industry standards as far as safety um make sure making sure that they have adequate clearance requirements um you know they do uh fouryear uh uh vegetation maintenance that will continue um that's pretty much an industry standard in that ballpark as far as maintaining um capable species which are trees that can grow into the conductor Zone you obviously don't want you know trees growing in and causing um you know they call them uh I forget the word encroachments uh so um you know the the projects designed with those safety adherences um and this one's a asking about air and water quality and sewage sure um you know there's no you know uh sewage disposal is part part of the
project air quality you know as far as construction goes it's really just you know we're we're going to be in there doing the construction it's not totally different than what's happening on the adjacent side streets um and then um what was the other one you asking about sorry uh air quality water quality and you know water quality we're going to be following um environmental guide lines that were you know put together in in concert with the Department of Environmental Protection um I believe that's uh ex it it's seven or eight um so you know
that's that's how we'll be uh mitigating against environmental concerns okay number two is traffic safety impacts um you know as far as traffic goes the the project itself you know at its core once we're out of construction doesn't really impact construction with exception to you know momentary um you know maintenance activities that are already happening on the existing transmission line um you know as far as um you know the construction goes we're going to make sure you know when we're in the field we're we're maintaining sight distances when we're exiting and entering the right of way um you know we'll have SP and like that okay do you have a lay down area like for Bri of ways yeah as I
actually that's a great question I would um you know I'm more than happy to find further information after this meeting about that I don't specifically it's not depicted on this map I wonder do you bring the polls in like one by one or big drops or how that uh Adam would you like to question sure
name and address the and who you work for Adam CAG this project here thanks for having us tonight um I guess you know within the RightWay itself we'll have different staging areas so we'll put a poll here we'll put some insulators you know all usually on pads or or the access pads that we buil as far as lay down yard it's usually on site so we're still working with the contractor to to to get that
is is Health refueling you have a statement in there that you're not going to do it within 100 feet of uh a stream uh so my question is what do you do for a refueling site do you bring in a fuel truck and do you somehow protect that you know put a it's called secondary containment um so it's a protection against you know leaves and so forth on the ground so bring it in with a fuel truck uh when you need it or you have fuel fuel Sor
okay similar type of question if a if a a maintenance vehicle breaks down blows in oil line what's the process there same thing double containment what I mean the process uh is to clean it up immediately right um we do have process in place where you know we have to report that to the state then a certain amount of time clean it up um so yeah the same thing if you spill any Hazard material on supposed to be call same I didn't see that in the do you have a process so there's the environmental control requirements um I believe uh give me one second I can find which um Environmental
and eight is environmental control which is probably what you want dispose of it properly yes absolutely questions so that's traffic uh Public Safety impact Safety problems the again the project is located within an existing transmission line Corridor um not going to be any different than than what's there you know shouldn't be causing any public safety impacts any questions the next one is environmental impacts kind of hit that one yep again we're going to be managing the right of way um as far as erosion sediment control requirements we have environmental inspectors that are out there and also the state fund or we CMP funds third party inspectors as far as the state goes so it's not you know not everyone's I guess in some words playing on cmp's team we also have you know someone that's working for the state kind of checkouts okay any questions folks scale and intensity of use um again the the transmission line
Corridor occurs in an existing transmission line Corridor um you know it exceeds the standard with regard to you know uses in neighborhoods in the project crosses with respect to physical size visual impact and reducing the footprint based on your crosssection number three we didn't write that in the application I don't think uh but I was just about to say that you know we actually are bringing it in further from the the side so I think arguably you know it's less intensive because it's towards the towards the the center the right way so you you would allow further natural growth to occur based on your that uh I
don't believe will be the case but I you know arguably as far as you know distance from lot lines you know I think it's less intensive but it'll still be the full width of the right away will still be managed actually question are your polls getting taller I you know to be honest with you I don't know what is the existing poll height in the right way I'm more than happy to get that for next meeting than you overall they're
be and it's going to 880 71 on average 71 and to go on y and I will get you the average po lights for the existing for next in your writings or on the the whatever so was the average mon or the monopole height in the cross-section was 80 80 that's what I saw I'm not as C now as some people think I am uh I took so just so where you know where I got my average it was from the most latest um it's a a whole

sure that we provide you with everything that is necessary as far as that um you know and again it's it's being built entirely within the existing trans Corridor so not concern about that uh financial and Technical ability um again we we have a pretty big Comon eque there as far as you know uh cmps and Aon grids you know technical expertise as far as um you know transmission line distribution um you know and Associated support facilities um well equipped to build this project as far as Financial capacity as well and Technical does he any good he's very good I assure you yeah yep very good sir
okay any questions on that I was actually pointing at yours but uh sorry uh okay financial and then compliance with land uh be compliance with land use ordinance standards you know as far as waivers we've requested and certain certain ones we requested as far as the land use or the the survey as far as a um license surveyor because you we're
going to get to those next okay so for those that you've got waivers after we finish um conditional use sure um so we reference other sections that kind of overlap with this further um you know article L sections 99.1 9.1 3G and
7.4 B of the conditional use ordinance um so this kind of there's a redundancy here with other sections okay there's probably a lot of that while I get into the next one as well okay uh land use standards I think were minimum lot standards I don't think that's applies to this case principal and accessory structures this is my comment that what you really meant to say were polls not structures right um so by definition the polls themselves are not considered structures in land use ordinance
as we're going through this it's not safe to assume that any of it is approval uh pears docks Wars and other structures um the same argument that the polls are not a structure so the the project itself is I mentioned earlier it doesn't have any in streamwork um also the the poles themselves are not considered structures um you know we're not going to be interfering with anything as far as sore access and any of that um on the transmission lines and um you
know uh it's not going to adversely affect the surrounding character and uses of the area because it's already in an existing transmission quarter okay and D through G Campground parking areas roads and driveways well let's go through some I'm you're not going to let people camp on there you laugh but you know with the pipeline went in there some of the folks from Texas wanted to camp on uh my father-in-law's land so campgrounds parking areas where where are you going to park going to park inside the um you know away sometimes we'll have overnight parking in some cases um you know we work with the state of main we have something called a field adjustment request as far as anything that needs to be approved by e 3 pis and in some cases
um you know the project manager for the state of main again nothing everything is permanent on this project I can assure you and then what is an EI and a 3pi an EI is an environmental inspector that is um employed by CMP and then a 3pi is um a person who is employed by the state
of Maine um in United States Army Corps but um is funded by CMP that makes sense so they're basically there's check there's checks checks and balances yeah okay um roads and driveways I diverted you from the discussion you show on on your drawings the roads where you're getting off of a durm Road onto your right of way sure but um by definition they're not actually roads they're temporary access ways so they don't meet the definition if you if you look your stuff is correct gotcha y so it's not appli and you clean that if you put gravel down you cleaning that up when you're done uh yes sir the the project is going to be restored to preconstruction conditions or better or better in some cases uh signs yeah there's not not applicable we won't have any signs storm water to run off um so we'll be adhering to environmental guidelines which are in exhibit seven um again we we're carefully planning the project to
you know be cited Haron harmoniously within the existing land um and you know we'll be out there installing our you know uh erosion sediment controls to make sure that we're not impacting any you know natural resources and you said that threei and and two e or whatever they do they look at that stuff yes sir yep they make sure that they're um before you start work somebody will do a preconstruction brief and and come and look at yeah and they make sure that you know if they're not you know if if like for say you know a silt fence falls down they make sure that they go back up and they're operating as intended and designed
okay any questions or uh septic and mineral you're not mining for anything while you're out there no sir lithium or anything okay septic waste disposal doesn't apply yeah uh you consider uh explain the essential Services piece sure so the the project itself is defined as an essential service um so I'll walk through these so it says where feasible the installation of essential Services shall be limited to existing public LS and existing service corridors as we've been discussing the transmission line is wholly located within an existing Corridor um and it'll be you know constructed on land that CMP owns in fee and also that the transmission line Corridor doesn't need to be expanded to you know site the project itself um and then uh it says the in
your ordinance says the installation of essential Services other than roadside distribution lines is not allowed in a resource protection um District except to provide services to a permanent use within s District RCT or accept the applicant demonstrates that no reasonable alternative exists um so I'll stop there we again we've design this project to the maximum extent practicable to mitigate against you know natural resources you know with that in mind considering it's such a large project some of that just you know it's a design you know um issue that we just can't overcome um so again it's been designed to to take care of that as much as we possibly can um and then it says where allowed such structures and Facilities shall be located so as to minimize any adverse impacts on surrounding uses and resources including visual impacts um so in our response we
mentioned that poll number 64 197 which is an existing pole that is partially located within the RP district will receive maintenance um that's insulation of a cross brace which is basically you know the if you see some transmission lines that have an X it's basically rigidity to the structure um and then the so basically with that the the project actually isn't being installed because it's already there at that pole location we're just really kind of bulking up that structure and I might have been mistaken when I said there were other poles that were being installed in Wetlands or whatever so if you would just tell us next time that absolutely that I was wrong but say say it in a nice way yeah no no I hear you but you know just because they're in Wetland doesn't mean they're actually in a Shoreland Zone District okay so basically what what happens is there's certain for an LR District it depends on municipalities
but there's a certain cut off some are some are 10 acres in size that a wetland would have an LR um or limited residential district associated with that one of yours did hit that I don't know offand what that is but it we had our GIS analyst go over everything and throw a buffer on that way because it met your definition of a shoreline Zone as far as living resal residential district goes and then the RP districts are associated with runaround Brook tributary to runaround Brook and Libby Brook okay so there's some wet ones that do you know what I mean they're not necessarily associated with The Limited residential district because they're not hitting that you know that um Milestone I guess and then the other ones are associated with the streams gotcha okay and just point those out next absolutely absolutely uh agricultural Ender harvesting you're not doing any of that no um so I think the a discussion you we
got into it although I I don't want to assume that you're just going to keep doing what you're doing so for clearing of vegetation so you gave it just kind of summarize your explanations so it's again we're managing the right of way um for capable species which are trees that can grow into the conductor Zone it's something that not only CMP does but all all the other you know Utilities in New England do to make sure that you know not only are we you know serving our customers make sure that we're not having allies where we should be but also you know as far as safety concerns you know fires um stuff like that and that you know not only in the the right ofo but there's also Hazard trees that we take care of as well and I think a question that I have and probably some others going to have is you talked about uh mechanical cutting so it sounds like somebody does some clearing chainsaw whatever it may
be but you also some do some vegetative spraying so that will probably be a a question sure for sure yep those environmentally is it is it just like DDT that's left over or what do you use um I guess that was an insecticide there you know the the herbicides that are put out there are licensed by the state of main I'm not well versed and what exactly those are but we can have that information for you at the next meeting it may come up to have it available but we won't be doing any mechanical you will not but you know somebody's going to ask you how do you maintain it so D that question or
questions about dead trees or vegetation removal it's EPA approved also not just state of name approved I think re revation is is a big deal uh what do you plan to what what do you plan to do and when do you plan to do it because if it's this time of year you're probably not going to do it immediately if in January how does that work so you're talking about as far as revegetating like the immediate areas around you're going to when you drive over that uh you know right of way you're going to tear before we leave the site we'll make sure that it's um stabilized as far as erion sediment controls the the the transmission line Corridor currently exists in a scrub sharp habitat which is basically you're taking out capable species that you know can grow into cond conductor zone so that will naturally re rate so you're not going to do any so you're going in you're going to you're going to put in a new pole and whatever
truck or whatever delivers it's going to leave tracks we will stabilize the site with erosion siment controls and make sure it stabilized before leing okay and if grass or nothing grows you come back in a year and six months and we'll see we'll see it before we leave okay and then what if it doesn't grow we'll come back and you again I mean I recognize that it's not a golf course but I mean no 100 and it is really more areas along a stream or the wetlands that you pull the silt fence up or you do something like that and the grass hasn't grown so that's my concern is how do we know you know before all that happens the grass is grown well we'll have again we'll have the E and 3pi out there that will be the eyes and ears in the field Mak making sure that the site is stabilized again the 3pi is not working for CNP they're working for um you know the agencies so they follow up when you drive away your last truck drives out
they come back later and look to see they make sure that the site is stabilized before we you know leave okay so stabilized to me means grass has grown which is not going to be the same day you drive okay that's what I'm try to get to that's probably theer in your erosion control stuff yeah erosion and sedimentation control uh yeah so again we're adhering to the environmental guidelines that we've provided you and I think it's exhibit seven um so you know we'll make sure that we're you know installing our proper um erosion Cent controls you know such as you know um silt fences uh you know a SES uh water
bars you know just making sure that we're slowing down velocities you know decreasing and eliminating segmentation into you know protected at your resources and so on and so forth do you provide your Roos control requirements to your uh contractor they signed for it y I mean so they would keep it on site uh because you're not you're asking to not provide plans is what I'm understanding so how do if I'm your contractor how do I know where you want s fence those will be installed you
know they'll do a walk down they they'll understand what they're looking at and then they'll design that in the field as far as you know where the you know Sil fences and the water bars and stuff like that are going and the three CI third party inspector I was about to say c3p or whatever was all right so somebody's going to inspect that after you guys are done or approve it and inspect it MH
uh I guess the next one is soil on page 4-10 410 you gave us words there so what you're saying is it's not required right it's not an intensive land use um and it doesn't require subsurface uh waste to full so it doesn't require a soil um soil report in your opinion we
could we do have the ability to ask for it if we want I'm not saying we will but okay water quality um you know the Project's not going to deposit um on or into the ground as far as discharge of you know any pollutant to the water of the state um you know we're going to be using the um vegetation management plan as far as
um you know maintaining vegetation going forward um you know we're going to use the selective herbicides it's not just like a you know it's not a I forget the the word for it's not like a m a misting it's very you know targeted when we're using it it's not like all over the place um so it's going to be like a um you know license applic by the state and it's going to be a backpack you know push sprayer something that you would use at home to you know if you're cutting a tree you would just spray it at the the base of it so it doesn't grow back so it's not like we're going out there um you know transmitting it in the air I guess um and then we're not using the herbicides within 100 foot riparian buffers um within the RP District um that I talked about
and we're not issuing a shorel land zoning permit and the only that's in conditional use the only thing that we're considering is those areas where you are in resource protection sure as far as conditional use yes that's correct but obviously when site plan will so this is going to this is overlapping the site plan discussions but a lot of that you know the a lot of the stuff that we're talking about not only applies for what we're doing in these areas but we're doing that project wide so it might help you
um okay do we want to go through the the criteria for the shorel zoning permit much of it overlaps what we've already talked about in terms of Public Health water pollution is there anything that we want them to be prepared for next time or that we need an answer on I'm asking the board now
historic piece so you you mentioned that you saw something I did some were in there and I apologize I don't have it marked but uh there was a discussion about there is one historical site but you're going to put a fence around it and you won't ride run over it it's up on Gran Gran Farm Road North really I know we are that if you just kind of those kinds of things if you could highlight on your uh the plans that you're doing where you cross flood plane um so on and so
5.14 historical resources so somewhere in here you did uh on page 3-4 e survey identified One S that is eligible for nhpa recommendation yeah I don't think I think the re if I can remember correctly we don't like publicize that because we don't want people it's it's a sensitive resource you know you can you know other sites i' say I'm not saying it's this one but you know say there's like um you know historically where um you know Native Americans were that people can go and try to I don't know if this is right word but plunder the area try to find the artifacts so we just the the mhpc knows the information they knows what we're doing the field everyone that should really know what's going not to say that you should know but you know what I mean as far as you know protecting it I guess okay but you're going to put the fence around it at 100 ft I think what it said okay not crossing any stone walls
tearing down any schools or churches and when we're doing to disturbance in that area we'll have an arist on site as a preparation okay before I forget this is a good time we do have a code enforcement guy who's very good to work with so as you're hitting these sensitive areas please keep in Alan Plummer keep it posted and you should probably sooner rather in later reach out to him introduce yourselves he the fire chief and the road commissioner I've asked for their comments on this sure before our next
what about the fire chief there's some language here about talking about emergency procedures and not working with the work fire chief to you going to reach out they they were going to reach out for training and things yeah we'll do that we wanted to get in here and have a conversation with you folks first but we'll be reaching out to have you know offer to to work with them and make sure that they know everything that's going on I would do that maybe before the next meeting both he and the road commission are good people they they will work with you on that I don't know but that's that is a good uh a good thing to thank you I will do that we will do

much more blown up and there would be significantly more pages to to it so I guess we respectfully know request that you would consider the exhibit 4 that we provided here tonight okay again we're not going to vote on it thoughts do we have any questions for uh the applicant on why not or if it's any consolation we
do provide the similar scale to other municipalities and it's not okay hey well thank you you missed 100% of the shots you take right it makes complete sense to me it does to me too the scale well I would say that you're getting positive reviews from at least some of the people here okay okay so that is one of your waivers your second waiver um and we just want you to be prepared to give us the information that might be needed to get your if sure if first off we got to approve conditional use next month and then we would go to site if we do that we' go to site plan waivers then we go to site plan review so and what's your second waiver so um these go kind of hand inand it's the development plan being certified for a professional land surveyor and then a formal boundary survey you know considering that we're working entirely within the full you know area of the right of way we're actually you know pushing it closer to
the middle the amount of work that goes into that kind of survey that's large of a scale is pretty large and we're just respectfully asking you know to you know forgo that exercise and and what would you offer in L of uh we you know like the reason I asked is 15 you know how down there how does a code enforcement guy know what to go look at which polls are being removed or 20 years from now how you you know that kind so it's more of a it's more of a we're talking about a boundary survey as far as the the right of way it's not NE necessarily the as buil as far as where the poles are located that make sense so you're talking about here just about this the surveyed we're talking about the limits you know okay the strip away yeah thoughts how I would think they would been have been an original survey many many many years ago right we have I mean we have plans of the right of way but again this requires us to go out and do
it again fact that the only thing getting really moved around is moving in 60 feet from the border I don't see a problem I agree there's no expansion I guess the only thing would be like recertifying what land zoning but I don't think we want to have anyone do so those so the this again the the surveys themselves we did survey the right away as far as Wetlands go you know the vernal pools you know those natural sources and and the streams and such those have been delineated this is more so just talking about you know the it's more of a property survey if that makes sense okay and then your next one sure
um so that's those are really that was really two of them and then it's the signature space on the plan um we can you know put something together as far as the Bings of fact for you to sign it's just on the map it's kind of takes up space I guess
thought on that I think it would be good and maybe it's your 11 pages of aerial uh photographs but something again that says this this is what we're planning to do out there it doesn't have to be a lot more detail in my mind than what you've already provided us and I like George's idea of taking off the aerial so it's a little bit cleaner to read sure is there any problem with providing that I guess in Li of the going back to the site plan I get that's what I was trying to so you're basically so let me let me back what I what I think he said uh so we're taking the base layer which is satellite we're switching that out for you know a topographical kind of kind of map and then you would also like maybe a a comment box in the bottom right hand cor stating you know this is what CNP is proposing as far as design you know in the field and signatures on that suggestion okay they have those sheets modified version so they come out
like a plan map they can be exhibits to the notice of reference these that's that's what I'm thinking yes so you would take go ahead with no signatures like what is this waiver requested to remove the signature block is that it's just it's just you know it's it's a requirement on the the plan normally you have a site and on that like a subdivision plan there a signature block and you all sign it we're talking about for this particular project is have the notice of decision finds a fact and then there's going to be conditions of approval and they will refer to these sheets going to be similar to the ones that are in your packet so be more of a plan as opposed to anir over and so be sheets one through four are those be attached to the notice of decision so the court officer everybody else will see this is what and if we wanted to we could sign you do the do the signature block on the notice of decision if we want to have
something with the with our there I'm looking for some kind of and I think George your idea is good which is these cleaned up so that they're they're easy to read by taking the satellite imagery off and that way the codes or if somebody says what you know was that supposed to be there five years from now you can take this out and say yes you know that versus just the findings of fact which have no there are 20 more polls they there's 20 more
what we discussed as conditions we're leaning towards you know we're we seem to be okay with the waivers at this one without isn't it approval no I no I right I just have a comment on um cleaning up the drawings I agree with the the signature stuff um but I think
during public hearing it's good to have the satellite view for public to see because I think it's nice for orando owner to say there's my house there's my edge of land it's it gets diluted when you take that out of the I would agree would you like me uh what I can do is I can actually add the mapbook we can just I can do I would recommend that we actually do the presentation again for the public hearing then what I can do is I can add the mapbook right at the end and just go straight into that and I can I'm more than happy to go I'll go through every page talking
I think that's good because that when we get into a site plan that matters and in the going back to the conditional approval to get that what we're approving is those areas that are in resource protection or LR so to kind of separate those or at least identify them was going through and say you know these are the areas that need conditional approval the polls the whatever you want to call them the lot those sections of the lines that need conditional use
approval it make am I saying that clearly enough uh and then ask the board too is because what we're for conditional use correct me if I'm wrong we're we're approving the the lines that go through the U shorel Zone Shoreland zoning thank you but but there's also site plan review which is the separate separate issue so for the first one is you've got
um holes whatever that are going to be in resource protection Shoreland zoning or limited uh residential so you're saying basically two map books one is specific to just those sections that we can circumvent the entire transmission line we're concentrating on rpn LR districts or somehow identified on on these these things like a call out box something like that some some way where it's clear that when we vote if we vote to approve or we vote to disapprove we can c Clearly say we approved it sounds like four polles that are in resource
protection charl zon right so if it's not conditional use you have that by right right we can also you know in the find is a fact that can be written out explicitly to a t to make sure that you know it can also say it in language we'll draw it up 62-39 or whatever it may be correct yeah you can do that as well thoughts on what we'd like to see I guess I'm trying to break out the conditional use approval get

the C yes if this is so this is the site yes the site checklist includes the submission requirements of which they asking for the three labers which IND on that uh so you can skim down through and just see if there's anything else missing and then the actual review standard start on page four of the checklist we go down through the utilization of the site the road system vehicular access into the site h16d is internal filler
circulation e16 ising design 8.6 f is utilities 8.6g is lighting design standards H is signage j i is fire fire protection J is buffering K is historical which is what we discussed all again overlap of financial capacity and then technical as well so uh for each of these and again these site plan review standards are really designed for a commercial construction project typical shopping center you know food store looks at the lighting of the parking lots the parking area so the site plan review standards are very limited in terms of applicability to a project like this so I think what theant has done you can do your review focus on those relevants just mentioned these others have and notable I like that so I think the first thing to do is uh go through the review checklist and see which is the um things that they have either provided or that they've asked for a waiver on and see if there's anything in here um and again
the site plan there is no big site plan there is what do we want to do we want to use the aerial the mapbook as the applicant calls it what do we want to do there so we can kind of go I don't we don't need to go by line by line but is there anything on these that uh leap out at you to say hey I'd like to see um whatever it is uh for instance C 10 the second page page two of that checklist on C10 C point10 they are providing 5- foot topography but not two foot uh for C7
you said um no like onsite staging areas loading areas things like that everything's going to be done off proposed driveways parking loading areas walkways and circulation so driveways aren't um you know applicable because the project doesn't have by definition driveways um we don't have I guess as far as lay down areas I would defer to as far as'll staging
so basically use that off downard yeah so showing lay down areas is that is are you do is that a TBD for you or so you don't have those right now I'm sorry not lay down areas not the outsite but whatever you said about like inside that you would have areas where you would be stuff whatever you call that yeah well I lay down here whatever you want to it's not something that typically is done this far in advance of construction that makes sense it's not really it's not like a design feature per se it's just they got to get out there and like figure out you know what the landscape where they can fit it in as far as um where the structures are the structure preparation areas are but they're I can assure you they're not going to be in any area that they should
of what you're talking about you said bring a pole in said so you g to bring in two or three polls set these pull them over here so you're not or you're not GNA every day you're not going to bring in okay we're working on 69-3 we're going to bring that poll and then are you going to bring like three days worth of work five days worth of
something okay so what you're say asking for is to be determined on that is that is that something we you don't normally ask like building a self-development where they're going to yeah I'm station area is storage to be like we're working on again the loading areas being discussed in this checklist would be like a factory Lo down those sorts of things
and it definitely that fits more maybe with the commercial one um I am concerned about uh access onto your site whatever you little dashed yellow lines on your drawings you have those you I mean you're asking not to show them but in fact you've got them there may not be a driveway but it's an entrance drive so maybe on that map
version you could put those access points on they already are they already are they're already there okay so it's just it's it's we're very infering definitions are everything and these accessways are not driveways per your definition so and it's the same thing with structured we're very particular as far as give me long enough and I'll find something that'll come we're we're trying to be nice so if we can do that because I think the reason it's important is our road Comm is going to take a look at it and he's if there's a TR if if in his mind there's a and I know there's not a lot of traffic pulling in out of there but there may be a place that it makes no sense to have so let me back up what is what are you really asking okay so conditional use one of the criteria is the safety Public Safety and vular access so
we just did a campground on or road with a 50 mph speed limit they were going to be put in RVs backing in going out so we require the site distances to be measured to make sure you would be safe so if you have big trucks that are going to be coming in crane trucks or whatever the access points could be considered important from the public safety standpoint and so the board could ask questions about where are those points that's that's the issue and then you've already provided them I mean they're what you've shown us is in my mind okay
in terms of the information there what I'd like to do is have the road commissioner say look it you know that's not that's not the right place you know he he'll give us feedback and say the access on stackpole road at Libby Brook that's not a good one because uh I'm not saying it isn't but and you're talking about just the means of erress into just getting in and out y something more than have doesn't to be concrete you've already done it I guess what I'm saying yeah and we and we can um provide the the mapbook and an email more more than happy to we can do a you know yeah sure
yeah I mean if if it's not there in public safety the you've already done it so the answer is yes so it seems fairly simple to change in the computer from not appic to yes you've provided it unless I'm mistaken It's s C7 what's that I think there's only a couple oh no there's going in and out of that right away there's several I mean if you each map there's probably a couple of them I

George is that I don't see the reason to do it because it's not a permanent you know we're not talking about like if you were doing this work subdivision in the have to put man systems just for a septic Storm from the roof the that comes off the roof thead hole so they have to build trees them can be done through forested buffers but sometimes they put in driveway Wells that treat the phosphor coming off the driveway so that's not what we're talking about right there 20 square foot It's associated with phosphorous management plan and my Project's not
vehicular access into the site um we talked about it the road I'll ask the road commissioner George will ask him to um seems the key ones would be and then stock Road um access you've got pel uh Royals Bor doesn't cross that's that's
Auburn Pono whichever pend you're on there that's a fairly significant Road [Music] make it to the top of graned he'll even find a historical structure but I didn't say that stuff there and our road commissioner will look at it and hopefully give us same with a fire guy will give us feedback before the next uh
