quorum here on those dates Joe yeah it's one of the proposed change in the dates because I'm on vacation from six to the 14th who's under 30 years to draw this so I don't miss it that is the most yeah and then I'm out of state so I

just want to see if people were interested if we can just shift to the first Tuesday and the third Tuesday this is the third in the 17th ship one of them so heather so she thought she mentioned that the last meeting that she had a conference for at least one week during that month to

figure never just proposed it see this yeah I'm not aware of anyone else meeting Oh with that said, as long as we have a forum, I strongly encourage you to take it behind you at the booth. Yeah, yeah. We'll schedule it. We'll have kids in Durham or Christmas concerts or something.

Typically, if you're able to get a forum, we'll typically have the meeting. Yeah, and I know Heather's not here today. recall at the last meeting she mentioned having an issue too so that would at least be I don't know if it was the second meeting or the first or second meeting of October would be two of us out so I didn't know anyone else I mean

I'm available on the day of the current schedule dates and I didn't even know what the official process was like do I make a motion to move the meeting and that we discuss and vote right but I wasn't sure if there's listed reasons

for justification or there's any sort of precedent we knew that always yeah we move for all of us and we and then the old I have known about moving a meeting for folks not planning to be here a rich man has more history on that whether

everybody had you know school things the same night which happens who things holidays and if you know like for example a few days in that the last time I could think of that we had to like move a date was because maybe three or four days out we need to get a big nor'easter or something like that we elected

to move typically it's unless it's like we know upfront today that we're definitely not going to have a forum for the business of the town I am free that's typically how it works well I guess I would just move that we vote on moving the

meetings to the first Tuesday and the third Tuesdays of October so the October 3rd and October 17th or just to reschedule it sounds like we don't have any requirement what's the reason it sounds because i won't be able to make them i'd like to participate it sounds like we

don't have any policy dating that we can't move it so i'm going to make a motion i mean i'll second it for discussion uh i can't make the 17th would be difficult for me because i'll be in the middle of a multi-day trial yeah again i just get into discussion so that's fine but i would like to see

i mean i don't know and i don't know if heather's going to be around so i don't want to move it to the 17th just because as of right now that's gonna be I'm gonna try to come but I'm going to be very busy that way to the third I just don't know again if

there are other meetings if there's a policy I mean, we're asking to essentially move a meeting for one person. Right, and I wouldn't normally ask to move the meeting if it weren't for the fact that I was going to miss back-to-back and I could call at the last meeting. You know, someone's going to miss it. the motion i'll just not be here till see you on november hey old business we have union church previous improvements and process moving forward jerry all right thank you so if you just pick up this thing that i handed out to you we'll just kind of walk through it okay so we'll go back to

2019. So in 2019, there was a total of $67,269 in the restoration account. There's some worked on that year for $18,860. Here's the trio account for it, but it doesn't really say what it was for. I wasn't here, but that was used on the Union Church. Maybe y'all know

what it was for. I don't know. We had to excavate and do some gravel or excuse me, like a riprap in the back and replace a back wall in the back of the church. And how that got authorized was Kevin made a motion to accept the excavation work. So it didn't go to town meeting for a vote. For that. And Kevin and I had a conversation and I'll talk to you a little bit more about what has been done in the past and that. about that. So that then reduced the amount to $48,436. Okay. When we moved to 2020, that

$48,510 moved to $48,723. That's because of the interest that it accrues on the account. So there was some work, some various repairs done in November, or at least that's when the money got taken out of the count of 10,637.36. That's all of these repairs here. And there was a bunch.

Front stairs, labor, union church repairs, they're all right here. After that, it was down to 38. There you can take those. It went down to 38.119. Now, I don't know how that got authorized. I'm assuming the same way through this board so having a conversation with Kevin

because these comes out of like a capital reserve so when they're big ticket items like a truck he was saying that if you're buying a plow truck yeah we're gonna take that chunk of money we're gonna go to town meeting and get vote but these smaller repairs got authorized right here at this board

because you have that authority to do that and I stapled some papers on behind is to kind of explain what the law is on that. And it's the first page right here. If you just look at the bullet down below, it says, by law, municipal officers are the trustees of reserve accounts

and have the authority to spend money from the reserve accounts for a project or item falling within the scope of the account within the additional town vote. So technically, even to buy a truck, you don't have to go to town meeting to do that. but because it's a big ticket you folks chose to do it that way technically you don't have to

right exactly so these smaller ones got taken care of here the bigger ticket items you folks decided to go to town meeting and get approval for that so that's how that kind of worked okay um and then if we keep looking at the uh the account there's no activity in 2021

Except, at least from the account, at least from the bank, okay? But there was work done. It just never got taken out of the account, all right? For $767.48, it was labeled Painting Union Church. So that was done in 2021, but it never got taken out of the...

And you can see it on the second page. If you look at this, you'll see all the transactions that have happened. And you'll see in 21 when no money was taken out for those repairs. So I'm guessing that money came out of the general fund or whatever. All right. So that 38, that activity, other than the painting in 21, in 2022, the shingles got put on the roof to the tune of $16,850,

leaving a total of $21,433.42. But because of the interest rate between then and now, there is now $21,572.14, plus the $10,000, that's an operating plan. Just a quick question for my edification. I'm sorry. Quick question for my edification. At 2022-16-850, was that the same as the previous repairs?

It just had been approved by the Select Board without a ton? That I didn't. I'm pretty sure. Yeah. We need a new roof. Yeah. And part of the reasoning is when you have a leaky roof, you don't want to wait to tell me. No, no, I understand. I just want to clarify. So the people would just approve of those types of people. That's the difference. It could be 100% of that, but I'm pretty sure we approve it without the top. Yeah, I don't recall that at a time of the vote. We would ask for that.

So that's the rundown of what has transpired since 2019. And I think Joe had some questions. Yeah, the reason I wanted to put it on the discuss was to get a better understanding of the process of how we spend the funds or how they can be spent because I know that there's been some confusion about that from both

maybe people on the board and members of the public so I just asked if we could kind of go through this exercise and to me it seems like there are instances where we have approved up to you know almost twenty thousand dollars to have work done and i wasn't sure if there was a written

policy or anything that dictated like life safety issues the board this like board will approve without taking it to a town meeting it sounds like you know from a legal standpoint we have the authority so just for the act of transparency being more helpful with like everyone in town so

they know what the process looks like i figured we could kind of talk through it so because it seems like we thought that there isn't one process people came to town meeting ask funds figuring that the rest could be taken their reserve account and then it was like oh maybe that's not how it works I just want to make it a public discourse on on what the process is could be helpful to get everyone on the

same page to move confusion and frustration that's why I want to talk about tonight I wasn't sure if any of you all had insight to share on that appreciate this information no I mean if you're looking for like the answer yeah

well I don't necessarily have an answer but what I would tell you is like for example like the 18,000 my memory serves me the wall in the back was pretty bad I don't know Lois might really speak to better on that but the wall in the back

was pretty bad so when that was brought up we we had to act on that all these repairs like the roof itself I can just it was just time for repair so there's really no there's really no other rhyme or reason when if something is

discovered that it needs to be fixed then it gets fixed the slot board like for example we had an issue at Eureka Center heating system goes we don't we don't wait for a time yeah and I understand that and so based off my

understanding what Jerry shared with us the whole process of like at the time meeting this year someone asking for allocation of additional funds operating under the assumption that they could then ask the select board to take money from this restoration fund without a town meeting is correct it is legal

it's something we've done in the past so that's where I think our confusion is because I think some members of the town voted for that thinking that that's the way the process was going to work and then it seems like when we got to the to the point where we're making that decision in the last few weeks it was it well maybe that's not how it works but it sounds like that is without has worked in the past and it's been the discretion of the select board as to when we make the choice to allocate that's almost the discretion of the

board but what I would say is that and I if my memory serves me right your twenty one thousand five hundred seventy two dollars fourteen cents doesn't include the ten thousand that was added at this particular past town meeting correct

sorry say that won't walk me there's 21,572 dollars and 14 cents does not include the 10 no it does not it does not because the 10,000 didn't go into this particular fund because it was categorized as it was raised at the article level for the operating budget right so that's

different than doing right that didn't go through the capital process right so right which i understand so what i want to make sense i would have thought they would have had 31 000. they do they do it's just in two separate places the 10 is in one place the 21 is in another right so i

think for clarification is how to either not necessarily merge but why the two different accounts and why what triggers to access one account versus the other so my understanding based off what jerry's presented to us and what we have here is that the motion at the meeting to

add $10,000 and the person made the motion because they knew that the estimate was somewhere in the neighborhood of $30,000 and they had $20,000 on hand so they were operating under the assumption that they could take that $10,000 and then pull from this with our approval yes before for the

seal or repair so my understanding is that we have the authority to grant these funds to be spent in conjunction with that $10,000 to achieve something if the board deems it a permissible expense like we have in the past. If I understood you right let's say the sale was $30,000 and that $30,000 is in this account I'd say yeah absolutely I'm just not sure that's why I asked Jerry for the clarification of why the 10's in a different account. Because it was raised at the article level at town meeting. I get that. So that's where it stays. You can't unless you But raised to what? Raised to the operating? To help with the sales. So if the sills were to get done, I would pull that $10,000 first, and then I would pull from there.

So was it specific for the sills? Yes, it was to help with the sills. That was the article language. And so I think where the confusion fell was after the town meeting, my understanding was that they asked for $10,000 to go towards the sill,

knowing that it was in the ballpark of $30,000, and they already had $21,000. so rather than us just saying we're adding ten thousand to the restoration fund we are saying we're giving ten thousand dollars to go towards the sill and then the understanding was that the

balance would come from the restoration fund last month we get to that stage and it sounded like we said well we don't know if we have the authority to pull from that restoration fund without a town meeting but it sounds like from jerry's homework we have done it in the past and we do have that

authority so it just boils down to whether we think it's an appropriate application of those funds so I just wanted to clarify that because it seemed like there was a misunderstanding and then it's like what's the only way to get those funds to go back and say can we please add $10,000 to this account because that's

not what has been happening in the past and seems like it was kind of getting the process was kind of getting switched once we got to the final point now or down the trail now so I just want to clarify it's just a clarification I don't

think the process for necessarily is being switched but what what is needed is there's a lot of ambiguity of what amount of work needs to be done and what it actually cost to just say hey let's just go throw $30,000 or something the

issue was can we ask for $10,000 to go towards a cost and then make up the balance from the restoration fund that was the question regardless of whether the motion was to get $10,000 to go towards the sill with the understanding that the remainder of the remaining amount would come from the

Union Church restoration fund that was the motion and so then last month we were saying well we don't know if we can allocate that money from the restoration fund without a town meeting it sounds like we have done it in the past and we can so then that answers that question the next question would be is that what

we want to do so yes right and that's where you come into the hole in terms of spending if if we want to fix the sills and we can edit it will be covered by that amount we can spend the 10,000 first yeah and then whatever's in the

restoration account and that was the question at the last day and there was some question about that and I think it's yeah I think that's just I think what was helpful about this was we were having that discussion here we're all understanding so we're now on the same page yes well I'm good with let's

hypothetically if it's $31,000 to fix it so they have 31,000 yeah yeah where are we at with the report we're gonna do the site visit next Wednesday we go to tomorrow I think I need to be proven you know once that's done then we can get

hard bids and so forth yeah and but I think it's helpful now that we go into it knowing and if that heartbeat is above $10,000 it is appropriate for us to think of what I'm so yeah or do you have that authority that's what I just

want to clarify next week yeah next Wednesday at 10 o'clock new business overspent operating fund design is our next item this is part of my man I'll recall but as you know that the fine department overspend by but we got our honor we can't back you know we'll be having a Gen Con has come in the

next meeting to go over the audit but fire overspend by three thousand two $635 something to that amount so we gotta ask them we're gonna ask the residents for that so it was like what's the best way to do this so after several

calls really the best way to do it is to ask at the next town meeting what so I just kind of wanted to because there was question oh should we put it on the ballot for November no I shouldn't do that do special town meeting well you

don't want to go through a special town meeting for $3,000 so MMA and some others that I've talked to, some of my town manager colleagues said, yeah, just do it at the town meeting. That way you can explain why you're... I think we've had this with the fire. Yeah. Oh, with the fire that you had it before? Yeah, I want to say labor-wise we have to authorize. Was that my phrase? No, I think it was. I think I recall something like that.

So I just, I probably could have just made that aside of my report, but I just wanted to bring up that we have to remember to do that. That's all. Cool. Did the audit go down fine green up to say what that 3,000 and change yeah it's mostly fuel and that's

one thing that was that came in at the barrier we have to when we when we ask but I have to put it in state-wide the process question I have minutes like so that obviously was purchased so the boat at the town meeting is to just

reimburse a certain account from different funds no to raise it out of raising it it was fresh on my mind okay so this one I want to I want to take you to the last page of this that I handed out to you. So just to explain, so the warrant articles,

the warrant that we go to town meeting, this really is your fiscal policy. And unless there's an article in this that the town agrees that you have the authority to spend money outside of what's already been approved, then you don't have that authorization to raise $9,999 out of that undesignated fund.

So that vote that you did for the union church with a structural engineer really isn't valid because this didn't give you the authorization to do that. And if you read this, it's a main law. Basically, the last sentence, the municipal office had no inherent authority to spend unappropriated surplus. So that surplus is your undesignated fund. What did we earmark that we were going to spend the money on per the...

The structural engineer. Yeah, no, no, no, sorry. What account was earmarked that we said we were going to earmark that? Well, I believe it was the general fund, but there really isn't any general fund. It's undesignated fund. So we actually should have taken it out of this fund right here, the $10,000 and the $21,000.

yeah I remember I remember the discussion being we didn't want to use it but they did one because I said take out of the 10,000 that we raised right but I don't remember saying take it out of general maybe maybe I think that 10,000

was raised first the motion the town meeting was for something specific the sill so it's like I think our confusion was that we can't say we'll take that 10,000 the town approved for the sill and spend it on I don't think the

motions designated which fund it should come out of but we should find the fund that has some relevance to that I mean there is right well you have to go specific though I mean I think it's either going to come out of two places I mean we're doing technically this because of the

because of the problem with the SIM is why we're getting an engineer report so why it wouldn't come out of that 10,000 is beyond me but as long as it comes out of either the 10,000 that the I see that straight face as if you're going to put the sill, you want to make sure that

you're putting it on something that is going to structure the rules, you can go back and watch, but I did, I specifically said I want to make sure I get this right, let's map this out, because I wanted to take it out of the 10 too, because it was like, we need to take

it out of the 10, we raise 10 somewhere else, and we talked about it just being a shell game. The cleanest way to do it is take it out of that 10 that was raised. Because you can always go into the municipal capital account and give that $2,000 back to that account. You have that authority to do that in those reserve accounts. I think it's clean, but I also think it's $6,500 in the other, whether it comes out of that account or this... If it comes out of the collection of the $31,572, it really doesn't matter, as long as it's... So my question on that though is the $10,000 that was approved, If it's not spent by December on what it was approved for, then it doesn't get rolled over into that $21,000.

It goes back. So that's one of those things. It goes back into the general fund. Yeah, so that's one of those things that, like, we have to spend it out of, I mean, I know it seems silly, but it has to be spent out of that first, correct?

And I guess our question within me is, does that pass a straight face test, if that was designated for SIL, and we're saying before we do the SIL, we need to do some structural engineering, I mean, to me, If it passes the straight face test, it's like, if you hire me to do sheetrock and I pull the sheetrock off and see rotted studs, I'm going to back out and say, hey, we can't proceed, you know, so if it makes sense to me, I don't agree with that.

I think the intent, though, was to avoid using that money so that we could save that pool of money to do the repairs. If it came out to $30,000. That was the intent. Which is why I think the intent when we made the motion and voted on it was to try to take it from a different account.

I think we could take it out of a different account. We can't take it out of the undesignated account. We could take it out of another account. That's fine. If that's where you want it to come from. You can take it out of the Union Church account. You can take it out of the municipal capital account because that covers buildings.

I just need to recognize which one you want to take it out of. That's where I envisioned it coming out of a different account. Yeah, but it's kind of like, you know, my thing, I don't know, we're in the ballpark. I mean, right. I understand your point, Josh. If we take it out of that amount that's designated and then it comes out like, oh, you can put the sale on, it's not a problem, it's going to be $31,000.

If we took it out of that first $10,000, it's not there. Is that what you're saying? And essentially it would come out of the other kind of, I mean. Exactly. It doesn't, I mean, to me, personally, it doesn't matter. I think it was, I mean, you can see the reaction we've gotten in our discussions about this.

And it was the look I think we were going with. I mean, to me, where it comes from, because if the town has to pay for it, we're going to have to find a way to do it. So if it comes out of one of those two accounts, we'll have to find a different place to make up for it.

So when the bill comes in, whatever it's going to be, between $1,000 and $2,000, I'm going to pay it out of that $10,000, out of that line. And you folks can authorize moving money from the municipal account back to that if you'd like.

That's the cleanest way to do that. The cleanest way would be just pay it out of the municipal, I was going to ask. Kevin would disagree. Oh, Kevin would disagree? If Kevin disagrees, then I disagree with what? Because I'm sure he's got a reasoning spot, so I would... Because it's already kind of been raised, and it's there. There's other mechanisms in place to raise money back to the...

The question I want to ask, Tim, because I would imagine that people involved in the Union Church would ask this. It's $2,000, we take it out of that $10,000. It comes back and we say, yes, you can do the sale, it's going to be $31,000, but now they only have $29,000 between what's left from the $10,000 and what's left in their account.

And they say, well, we really want to get that done this year because if we don't spend the remainder of that $10,000, we lose it dude we didn't have the authority to backfill for them something in this portion we decided okay just want to make sure because i'm sure people are watching yeah they know that

this isn't taken up and then hamstring in later no at the end of the day that's why i was like it's six one half it really is the money's gonna come from the town slash taxpayers it's not like we got a federal grant to fix this no if it's true sometimes that happens we have to massage

I think if it's really six of one, half dozen of the other, whatever's the cleanest, that's fine by meeting. I just want to make sure that we don't get caught up at the end. We'll get a tank. If the project, if they have 31,000, whatever that total number is, 30,000, let's just call it 30,000,

and the project comes in 34,000, and it's deemed, we deem that, hey, this has to get done now, we're going to take 4,000 out of it, and we're going to get caught up. Yeah, but I understand. Yeah, I mean, that's what we've done technically in the past, so I mean, that's, but I think we're on the right track, getting that guy there, and then, you know, by that, we can formulate what has to be done.

Right, and we can pay that guy in the meantime, and that's why I wanted to take it out of the operating to begin with, it's just easier. I think sometimes, you know, and I could be wrong on this, but I think we get sometimes a little, especially from outside sources, it gets a little cavalier with, oh, it's going to cost X.

And we don't do the due diligence to really find out what X is prior to making the statement that it's only or it's going to cost up to X. We don't really know. And I think one thing we can learn from that is in the future, someone is asking for money to go towards something they have, like you said, that, oh, I get the ballpark of this, rather than earmarking it for that, just say, we'll put it in that reserve account if the town approves for it to go towards that later, because that could save us a whole lot of discussion.

Yeah, because if it's not spent in its earmark, it goes back, right? Whereas if someone ends up at meetings and says, we have this ballpark estimate, can we have X amount added to our reserve account? And then they start the process of, well, we didn't want to get an official quote, so we got the money put aside.

I think that just makes it cleaner for us. I would agree with that. That's ours of discussion. So faculty members, we have spent money on this building. Yeah. Quite to the... Yeah. So I just, one more point. Because I know we talked about this last year about a contingency fund,

and I know you were saying that would have taken care of some of this. So moving forward to the next budget, we need to talk about an article that we need to put in the warrant. Yeah. Yeah, I know. I know. But we need to educate because it's. I couldn't hear what you had said. You said contingency what? We contingency fund or money set aside that allows the board to pay bills that they didn't foresee coming.

And there's different ways that we can do that. We'll talk about that during the next season. To me, it's the same thing as putting money aside for the roads, for the vehicles that we need. Because, you know, we're all paying a percentage now, but if we have to borrow the money, we're paying that percentage plus the interest on it,

which is going to be as much or more than what we're paying anyway. Yeah, and even with great budgeting, there's going to be those things that pop up. I mean, if it's changing costs, it's more uncommon not to have that money aside than it is.

I mean, it's fundamental. I mean, that's what budgeting is what it is. So we've just got to educate. That's right. Absolutely. It's better to have it and not need it and need it and not have it. that's next on the agenda we have solid waste committee appointments unless

outside of that reporting period but i was able to get in after many emails uh but they got me in and i did the report so we're pretty good on that until the next report they come but do you since you're in now is that just gonna be seamless yeah it should be seamless i should be able to get

right in there and get that right um as you know i talking about the efficiency main grant to fix the landing. We got our application in. Denline was the 31st. It got in on the 31st, but most of the work really had to be done by the Enterprise Electrical Room in Lisbon. They're the ones that

did all the work. So they did the audit on all these buildings. And I haven't gotten the word back from Efficiency Mean on exactly how much our cost is going to be, how much the grant is going to be if you if we move forward on this and i'm not really sure how it's going to work

that project has to be completed by february of 2024 so that's you know which we're going to have to come up with the money up front and then they reimburse us with the grant so just a just a heads up on that so hopefully we hear soon on what that's going to cost and what it's going to save

us and that sort of thing but that was that was a little bit of work for the not for me Mine part was easy, but it was the electrician's part. They had to put in all the kilowatts with this and that. It took them a little bit, so hopefully we'll get good news.

It's something maybe the town won't do. Well, maybe not, but I've done some reason. Yeah. That makes sense. We'll overdo, I think. Yeah. I'll miss the fluttering. Yeah, they're pretty old. The guy from Enterprise Electric seems to think there'd be 100% reimbursement for this building.

because they're so old right fire maybe not so much it's a little newer public works has already got quite a few LEDs over there already so but but we also included the Eureka Center outside lighting to get all that so anyway be

information hopefully is that just lights yeah it's just it's retrofitting your lights parking lights out here but that doesn't do anything like sensors on the switches in the room to turn them off there's no motion or anything no no just your basic maybe

so hopefully there's plenty of your money left and it'll take care of us we'll see when that happens um i'm in the process um of getting a new lease on our copier that ended in march of this year we're in a market-based lease right now which isn't the best option for the town we've actually

paying taxes for the last six years on that so i can get us in a much better least a dollar buyback lease it should save us some money like looking at the numbers right now it's like about 30 or 40 percent because that's the lease when that's at least got older our copies color copies went up

we're paying like 10 cents a color copy now right now under one of the first bids i got The color copy is $0.05, and the black and white is a penny. We're paying like $1.9 now for black and white and $0.10 for copy for color.

It's the whole paying the taxes things. We shouldn't be paying tax on anything. We're a government. So I don't know how that happened, but it happened anyway. So I'm working on that. I don't know. I don't know if they're watching. I don't know as if they'll get the next bid. They know better than that. They should.

It's just like any government. You should pay tax. Yeah, I don't know. Not from them. You have a co-op. A state. Yeah, like when I do my sales and use tax, if I'm going to pay or something, I can go back in and say, hey, on such and such days, I paid this and that thing.

It takes about three weeks. But the state doesn't get back, you know, it's really good. the state will reimburse you for that is no no it's not it's just that one extra send a block that breaks the bridge so I'm I'm working on that so hopefully we'll have a copy

that's gonna save us that's really all I can really do at this point in here is try to find efficiencies like that that help reduce the cost and that's one of them other than that I don't have a whole lot more than exciting I'm not sure I'll have any questions of

things ball fields going to work they've done a lot of work out there they scrape whole infield today right so we've been working with them pretty good I think they're pretty happy with our responses to help with them when we can

so that's going pretty well yeah I'm not going to share any of Calvin or Chief's partner they'll talk to you next meeting but they're doing some good stuff too so the first two weeks of October I leave Saturday September 30th and I'll be back Monday the 15th whatever it is it's two weeks going to Iowa. For the whole two weeks? No, 10 days. Oh, that's great. Yeah, so I'll be back on the 60th.
