This is a machine transcript, not a record of what was said. YouTube's speech recognition produced it. It mishears local names (Royalsborough, Runaround Pond), garbles figures, and drops short words, including the "not" in "the motion does not carry". Use it to find the moment, then click the timestamp and listen. Where the summary and this transcript disagree, the recording settles it.

turn us on. I'd like to call to order the June 7th meeting of the Durham Planning Board. And we do have a quorum with three members. And we'll start with the pledge of allegiance. United States of America. and to the republic for which it stands. One nation under God, indivisible, with liberty and justice for all.

of minutes from the May 10th meeting. Yeah. Four. Good number. Five number four. Is he four? I don't know. No, we need three out of three. Yeah, she's we've got four now. Four. Is it four? No. Okay. All right. meeting. I was not. So, I will abstain from voting on the minutes.

Um, them. Juliet have to vote on them. So glad you made it. Sorry, I was trying to squeeze too many things in a day. Let you have a minute to look at the minutes. look at numbers. Did anyone else check those? the check. Oh, to compare.

Yeah, I didn't do that. They're all of Mindy's list. Okay, I guess motion. I can check real quick. 32 33 34 36 Yep, it is. 45 49 50 51 52 53 54. Yep. Okay, agree. Make a motion to approve the minutes. Ready? Second that. All those in favor?

continuing business, Sir Baldwin and the Mineral Springs Estate Subdivision application. Come on up. Hello. Hopefully, we're a little bit closer here this time. I just got these from my lawyer today. if you would like uh they're the warranty deed or copy of a deed and the road maintenance agreements.

Okay. And I only came up with six cuz I killed two printers today. Ran out of ankle both of them. Oh man. You want this in front of us. Yeah, you take questions out. checklist. anything that you wanted to highlight before we kind of go through the list again.

just go down through the list again. Yeah, whatever you want to proceed. I have the updated version or your response from 510. Okay. Have that same copy. Yep. was 25 25 the utility easement on the plan provisions for water supply disposal telephone and other utility services on the site.

plan shows what we need. little bit. looking up. Um you'll see you'll see a line type called EGU. Yep. And uh that's coordinated with the detail. Typically they'll run the whole utility bank in one trench. Uh phone power and cable um all walk the same line. So depending on who's providing coverage, right?

Yep. I think call that complete. I would call that complete. rivers, stream beds, brooks, wetlands, vernal pools adjacent structure uh adjacent to the subdivision. So what we had asked was that you had gone go back to the gentleman who had done your surveying and get some information on that. And you have a letter here it looks like y

from the surveyor that talks about what was surveyed and and that there was I think we talked about there was a missing line on the right hand side of the road up right where the near where the vernal pool that lot that's got a small building with envelope and he did uh provide that line to us as well so it's shown on our plans.

10:07

Okay. Yeah. or the on lot three. Yeah, there's two line types. The dotted lines on the right and then seems to line. I probably should use the same line type, but we Okay. Yeah. Sometimes it means two different versions, but

Yeah. You had a sharp eye on that last time, so let you process that one. Um, yeah, I am. I'm fine. If it um makes you feel any better, I I walked the site pretty well with with Barry as we were we on another item we'll get to in later down the line. And I'm not a You don't need a license to delineate wetlands in Maine, but I I've been around enough sites

over like 15,000 square feet of Yeah. impact. Yeah. Yep. And um uh looked like that line was kind of spot on. I mean, you can really kind of tell where the the wetland bed was, but yeah. What about um so I see the dotted line

this way on the western right here. Right. That looks like a stream buffer. And then the this line that line is the edge of wetlands. Yep. All right. on that side. Yeah. And was there is there any proposed impacts even temporary to the wetland from that road construction?

Not currently. Nope. I believe if you look at all the grading is on our plan. Yeah. The LOD is that dark with a hatch. So it shows it out of the wetland. Yes. So um and the rightway is completely out of the wetland as well. So

Yep. And there was no stream found under where you're proposing to extend that culvert. No. No. call it seven complete. is 29. Site plan location size existing of sewers, water mains, culverts, drainageways on or adjacent to property be subdivided.

with inverts and sizes has details for drainage. there in a detail for utilities. owners with home lots. 15in HDP new. Yep. Julia, do you agree? Yeah. easements or restrictions. Oops, I'm sorry. Wrong one. That one's already complete. 32. Uh, all right. Next one. Yeah. All right. Make sure. Too many list and too many pieces of paper here. No.

Any portion of the subdivision is a floodprone area. The site plan shows the boundaries of the hazard areas. The 100redyear flood plane elevation as depicted in the flood pain flood plane insurance maps. That one should be up. That's always shown on the plat plan.

Okay. This is Yeah, that is on the new plan. location of Brook yes yeah. So that was So, Mr. Kavich tried to interpret off from the FEMA overlay, I guess. Yeah, that's the that's the only way to do it. Yep. Okay. Let's say that's complete.

15:15

to the pro of division that have been identified as high or moderate value wildlife reef habitat by the main department of inland fisheries wildlife or within the comprehensive plan of Durham Ma actually we we did get the response from them um early this week um I didn't print out because unusual natural areas should be coming in next week. I talked to her. She said it was on a desk that maybe even later this week. So, I figure instead of giving you half of it, we'll wait till I get everything and we'll just turn it in.

Okay. Thanks. Maybe make that a condition just that we received those or something. What was that? I'm sorry. What did the What was the response? The response was no. Uh we're we're we're all set on uh the uh wildlife and

unusual natural areas. I looked on the GIS database and I didn't see anything in there. So, they're just going to verify. That's all they do. They they check the database. Yeah. Then they send you the the standard literature. They list like, "Oh, but if you find anything, please let us know." type of thing.

Right. Right. So, I I mean, I would be okay with making that a condition to submit submit that. I think um so you can move forward with the Let's see if there's other things. If he's got to come back next month, then we don't get that far, but you know, assuming everything else, but within the condition that you would send us the documentation that you have.

And I Yeah. And I think I went through this checklist prior and I I I think Yeah. If there's like a couple of things like that that I that you're willing to make conditional, I think you can get to the sidewalk portion after this meeting. So, if we can get there.

Yep. not to throw a wrench and things, but um it'd be a little weird to make it conditional when we're considering whether it's complete. It'd be a condition when we're considering approval. I'm fine with with them submitting it later.

No, you mean? But yeah, so that's a It would still be No. Oh, complete right now, right? Yeah. So, we say incomplete and then talk about it being a condition later, right? Oh, no. It wouldn't be a condition meeting, right? You can only impose a condition on a permit,

right? You can't put impose a condition on a completeness. Okay. So, what do we do? Market incomplete for now. Okay. All right. Right. So, 33 is incomplete. 32 and 33. Right. No, 32. 32 is good. 33 and 34. So, 34. You said that's who you're waiting to hear from. And 34. Okay. Yes. So, 33. So three and 33 and 34 still incomplete.

Correct. 36, right? Divided street plan. I have to read the whole thing. Plan view profile typical cross-sections da That is what was what did we say last time? Um, we wanted the turn from the existing street included on there, the culvert detail.

Mhm. And um indicating that the construction entrance is temporary. you know, I mean, I think he had it with him last time, but it came in the day of and we didn't really have any chance to get our eyeballs on it. Did revise it based on some of our other feedback though, which was great.

You can't unfortunately the you can't quite you can see the two the edge of gravel lines on the on the road leading up to Barry's property. And that's that's all we could that's all the you know guess use your imagination that'll all be blended in as part of the final project when he

constructs No. All right. Gravel. to knock the dirt off the tires before you go into the show on the edge of his property where he's doing the work. We we'll know that he'll actually probably put that down at the where he starts reconstructing

right the uh the access way probably. So Yeah, I think it says temporary on the detail. This the BMP. It's Yeah. Okay. Yes. Correct. Yes. Applicant has provided description of the proposed ownership improvements. Management of all facilities. Improvements will be privately owned and maintained, including streets, open space, drainage facilities, recreational areas, including common ducks, community association documents, that

21:00

Can I just ask a question? If we just got the proposed deed today, how did you guys mark 38 complete? That was all taken care of. What they were on 45. There's a note on my response that basically looking for the road maintenance agreement with a sample deed attached was the only thing missing.

The simple deed us for transfer of the new lots 38. Okay. I see the existing. Gotcha. His ownership's 38. Gotcha. Okay. You thought you got us, didn't you? No, I was just kind of confused. Miss the meeting and you miss everything.

is. So, um I think this is complete. My one few comments would be uh these people probably want an easement over the road and utility easements. That's not included in your sample deed. Okay. It's on the plan though, isn't it? It's part of the subdivision plan,

right? But you they don't want it in their in their deep. That's That's an issue for your lawyer. And I I can add it. Um Sorry, what was that? Add what? Over lawyer. H I I just recommended that folks who are getting these deeds are going to want deed easements over the road and utilities easement and all of that. um in their deeds.

Well, I believe yeah, it's it's stated in the road maintenance agreement, isn't it? That they do have those rights to of what they call it uh egress and ingress. Number two, it says utilities, but it probably should be in the deed. It should be in the body of the deed.

Yeah. And they're just a little bit different. Um they do different things. Also, road rate property isn't defined in the maintenance agreement. Now, what is it exactly? Can you say it again in the So, on the on the deed, you'll want to make clear what what easements, what rights the the purchasers have in the road. Um,

So, is that enough? I think it's complete. I think I'm not even sure if that's something we'd look at when we got to the criteria, but since we're looking at it, so I think 45 is complete. Are you guys okay with that? 47.

complete cost assessment of the development including a time schedule for construction, anticipated beginning completion dates and sufficient capacity to meet air quality, water quality, pollution control standards and other standards and criteria contained wherein

dorm land use. I had uh you have the letter already that we submitted time schedule and cost projections and I again I brought a statement which shows my balance ran out from the second one I think as you can see but I have two if you'd like to look at it

super close uh 25 to 35 okay 25 to 35 Right. I have the cost estimate is I already own the land on the proposed subdivision. I have crushed gravel on site to build the road and anticipated the project cost 25 to 35 and have the money available in my savings account. Estimated uh numbers may seem a bit low but uh I own the necessary equipment and already have the material for the project on site.

information we're missing. So timeline is the one. Well, the timeline I can't give you until it gets finalized. How about like approximately how many I want to I still Excuse me. Well, as soon as this thing is approved, I'm going for it and I want to get the road done before it freezes.

So how many months you think? Six months. Six months. Yep. I have 1215 as my completion date. Okay. Put my hand on that. Poor conduction frozen ground. So we'll say it takes approximately 6 months. Yeah. To build. Yeah. It won't take that long.

No more than 6 months. Yeah. Everything's right there. So it's okay. I forgotten it was this here. Okay. I'm good. Complete. Okay. Applicants provided a storm water management plan prepared by licensed professional engineer in accordance with the storm water management for main best management practices main department environmental protection. The board may wave the submission of restor requirement proposed subdivision will not involve creating changes with change drainage in addition impervious services as roofs driveways less than 5% of the area of the subdivision.

27:00

it it turns out that he does Barry does need a storm water permit because he's in a watershed most at risk which is when around pond. I had when I first looked at it, I was looking at I didn't have it my I wasn't tied into exactly where it was and I thought it was going right to the Androsken River. So,

um we have a pre-app with the D. I'm just waiting to hear back from them and then I have the storm water permit ready to file. I just have to have the preapp first and then uh we're doing it all through buffers. Um, typically with phosphorus management when you're meeting the phosphorus requirements in subdivisions, uh, the D's really kind of gotten away from any kind of structural measure because no one maintains them and buffers are just real easy and they're really, really cheap to build, really easy to design. So, there'll be a buffer management plan um, as part of that storm water plan that goes to the D. The town doesn't get a copy of that permit when I submit it. So, that's the answer to that one. Although I'm looking at this um uh waiver provision. I I think how big you lot 49 acres.

I can't remember how much is left. Let's see. I assume we're real close to that 5% if you assume a standard house footprint of like 2200 square feet and and driveway. So what's the total area of of no of um of the imper of impervious area? So the road is uh 40,000 42,500

square feet roughly just under an acre. So it's just under an acre and then uh if you got one two three four five lots um figure 8,000 square feet impervious per lot that's two acres. So if you were but excuse me doesn't that rule state that uh any uh impervious area created

by one person. So that's for the state not for this is just for I was just saying it was it was a way to okay you know sometimes the state takes a little while to permit things. It was a way to just get around that completed issue. But

so you you've written up a storm water management plan. Yeah. Well, we have you haven't submitted it yet. No, because I have to have the preapp first. You do the preapp. Y planreport. Yeah, it's a exactly right. It's a it's a it's a written report uh as well as uh you know documents in the plan that shows we're treating um you know at least 75% of the road which is a linear portion of a project, storm water project.

Um and it'll show the buffers. Yep. You'll provide the buffers to the Yep. DP. Yep. And and then they'll the buffers actually end up showing up on the recorded plat plan as well, so people know where they are and so we're at or under the 5%.

Well, I think it's you're hovering real close. So, right since he has to do the report for the state. Yeah, I'm going to say since you got to do the report anyways for this date, you just got to get us submit copy to us after you do your preapp.

Okay. So, should we do this similar to what we did with the Okay. So, incomplete. Yep. Applicants provided erosion control and sedimentation plan according with the main erosion and sediment control handbook. Best BMP practices has provided that sheet

which is sheet 300. You know the only thing I'm just picking up on now and it makes me mad cuz I remember drawing in the little check hand diamonds on this plan for Barry is that I must have turned them off before we sent them to the printer cuz they really make a mess of things, you know. You got this little black, but uh that's the only thing missing.

Yeah. the mo notes make it such that you have to go out there and inspect it. They get put in anyway. So, yeah, I think the details in there. It's just right. And typically the detail tells you, you know, if your ditch slope is X, then you need check dams every, you know, Y amount of feet. So,

right. I would say that the erosion and sedimentation control is complete. Agreed. Okay. So, is this one of those that we're waiting? Yeah, it's the same thing. 1951. Yep. We're waiting for this is Yep. The incompletes again. Repeat.

Estimating the type of vehicle traffic Is that on your plan or the other one? Somebody you were doing that. Yeah, I think I was supposed to do that. What do you know? You didn't. Well, I could tell you what it is. It's 10 10 trips per lot. So,

32:13

yes. I don't know. 10 trips per lot um per per day. Per day per day. Uh no erosion sedimentation control yet. All lots sheet commanders, right? Yeah. So that's just it manual is is 10 daily trips per single family. Okay.

Yep. trip generation. So, it needs to be on which plan? It's not a plan. It's just a statement. Just a little statement. Oh, it's just a letter for like a little letter. Yep. Here's the number of houses we're doing. Here's the number of vehicles per house, trips per day.

Okay. Thank you. 50 51. Are those going to stay incomplete? Yes. 53. The applicant has provided a list of infrastructure improvements with cost estimates prior to the sale of lots to be completed by professional experience preparing such information evidence that this will repeat again which we

so what we had what we had asked for was a list of materials available with cost estimates for that. Yeah. like where the 35,000 would how that adds up with what will be required for construction like it's going to be you know you're going to spend

how many yards you're looking for volume of materials like a cost estimate of how many yards and do you need uh Barry to prepare that or do you need me to prepare that is that a letter that's a letter that's a letter statement yeah

I would think the one does say a professional Oh, sorry. I'm a professional. Mr. Baldwin could consider himself a professional. This is the business that he is a pin. You're not an engineer. Oh, sorry. Yeah. Okay. Letter.

So, we're going to leave that one incomplete. Yeah. I guess since he has a someone he's paying to be his professional next to him. 50 was 53, right? Yeah. Check. So 54 applicant has provided copies of applicable state approvals permits. So

So you're getting a storm water permit, not an permit. Right. So here's one thing I struggle with our checklist because we're not going to consider any of his application until he has his permit back from main D. Well, I think that's what we were getting to earlier is that we can continue on and be subject to

Yeah, because so he can ask for a waiver for any of this. Right. Right. But aside from even the waiver, it's a good point like and that is I mean that is other communities do do it that way and I as a project manager I always struggle with that because it adds on top of the state's delay then we start processing. It it's unfortunate that I I kind of got involved, you know, sort of mid mid-stream because, you know, that would have been one of the first things that

if we knew the the timing of that, but you know, um I would be fine with saying like a a statement saying uh the permit would be received prior to the start of construction, which is what a lot of municipalities final approval. So we

not not final approval just start of construction. So we could approve it condition of approval. Yeah. Construction can't start until but this board deems the application is complete and meets the criteria. We can't deem the application as complete

because it's written here right now. It says that we have to have copies of all applicable permits. So right. So I think we can I think so this is our completeness checklist. Right. and we can wave any of these completeness requirements. Doesn't mean we're waving the the final test for the approval criteria. We're just waving the application requirements. So, I think if Mr. Baldwin wanted to handr write a note or you did saying we've applied for a state permit. We'll we'll get it to you,

right? When it comes to the and then we can say all right that that application criteria is waved that we don't need it before we move to the next step but we will need it prior to con whatever we decide but we can decide that later.

Yeah. And we can make that a condition of the approval when we get there saying it must be in hand before construction starts. We're all seeing the same, but you're seeing it more clear. All right. So, we mark that as it incomplete still.

So, you're going to ask for a waiver on that one or so on 54 then we're incomplete. When you get into we're going to ask for a completeness waiver of completeness. 534. You're going to request waiverss. Uh just 54. 54. So, what I don't have my ordinance. Can we um can we schedule a sitewalk?

37:29

Not until we accept the application. Is complete. That's why we got hung up with trying to do it. That's why I think you have to wave anything that's incomplete. as we can't wave it unless you request us to wave it to write a real quick

write it right. You know what if we So we have another application which happens to be mine. But what if we just table this until after we took the next application and you wrote a waiver request for all the ones that are outstanding right now.

Yeah, that's what why don't we Yeah. Yeah, you guys can write it right now. Yeah. Okay. But wait, so going back to the waiver thing. So, we're asking him only to wave or or he's deciding to wave only 54 and not any of the others.

No, I I mean I think you're going to all and I would put that in your waiver request cuz I don't feel comfortable just waving it. Put in your waiver request. We've applied for the permit. You know, we've done the calculations on the

on the vehicle and we you know, I've talked to IFNW and I'm wait and I checked the things. So, give us a reason why we want to wave each one. We're doing a waiver on all of them. All of the income fees. So, there's some I think there's another issue that has to be brought up and that is that there's still some some application fees that are outstanding. Is that true?

$100 per lot. Initially, you had three lots and now you've added you've gone to eight. You But I came in and paid. Did you pay for the extras when I at your suggestion? When I decided to go with the whole thing, I did. I came in and paid

uh I'll check on that. Yeah. Okay. I did. I came in and paid for the extra lots. Did you get a receipt? Yes. Okay. Do you have it with you? That must have been after I talked to you. That must have been after No, I don't.

That's okay. That's I'll check. We'll get it. But I did come in and pay the extra money. Okay. When I realized there was extra lots. Can we But I'll check. So, do we want a motion to table this to give them make a motion

10 minutes to go write out a requ waiver request? You think we're only going to spend 10 minutes on your 20? Yeah, it's super fast. Do that. I can do it 10. Okay. All right. So, I'm going to make a motion to table this for a minute. 10 minutes, 20, whatever it takes.

Thank you. You have you have the checklist. You know which one? Second her motion. Second. All those in favor applicant? Thank god THAT YOU SHOWED UP. I WAS REAL MAD. I was like going to march down your house be like John you didn't hear that Calvin's also good.

Sorry. I'm spread out. That's what I do. Spread out. Yeah. Okay. You were leaving me. Nothing here. Do it on your own. You're on the hot seat by yourself, right? This your No. Yes. Guys, for those who haven't met, this is my husband, Ben. Hello. Um, so we own property down on snow snow road which is a little den and dirt road uh between Davis and Stack Pole. Uh we got 10 acres. Most of it's in fields and it's been in fields for as long as probably since the 70s. Um it was farmed at one point. The area is actually in resource protection. So our house is actually grandfathered and it also sits up on a little bit of a hill. But that's why we're here today is because it is in resource protection. So, in order to bring in fill or do any of that, we need a conditional use permit. What we're proposing to do is basically excavate a 100x60 ft rectangle

and back fill it with gravel and stone dust. Eventually, we will bring in horses. Um, and mud is a very bad thing with horses. So, this will just provide appropriate drainage. We're actually The property is really flat. We're actually not going to not really going to change the drainage. Um, and I think I sort of in my cover letter hit all of the sort of questions that you need to ask. And I was going to write your proposed findings and conclusions, but I didn't because our approval criteria are mess.

make you an application checklist. Right. Ah, see, look at that. So, you're just going to need our um the approval checklist maybe from Calvin, Yeah. I would say it's in the Yeah. me to get those? You have green cards? Sure.

43:02

Yeah. Yeah. What country are you from? We can work. We can work here. Not a country where we're building out. Sorry, it's not very official looking. Yeah. She was the only one that's actually a physical neighbor. So we walked over and spoke to her.

Yeah. Yeah, we're basically surrounded by nothing. Um, the back side of us, yeah, it's awesome. Back side of us is 400 acres of um, basically logging land. One side of us is property the state took when they redid the road. One side is owned by um

by a family that they can't build on because it's resource protection. Um, and then across the way are some very nice elderly neighbors who also have horses. How many acres is it? We have 10. We have 10. I can't figure where you are exactly. Still you said snow road.

Mhm. Off 136. Mhm. Dead ends. You're on that section of road. Yeah. First house on the right. First house on the Yeah. So, you got the swamp that you pass and then we're the one right next to swamp. Julia on 48 is where it talks about the requirements for okay filling and what's so resource protection if you get over 200

24 cubic yards you have to get a conditional use permit Yep. All right. Do you want to read it, John? Sure. I mark it off. Owner's name, address, and name of the engineer or surveyor. Both preparing the plan. See, attached plan exhibit A.

plan. Yes. And we've um asked for a waiver of having a professional, a design professional do it. I'm just trucking in some dirt. Where are you guys putting the dirt? It's going to be. So, if you flip to the second page.

Yeah, it got messy. Yep, there it is. I thought it was a rebub. Yep. It got really messy when I tried to put it all on one, so I did a sort of before and after. Yeah. So, the first page is what it currently looks like. And who owns this property?

Uh, the Tanner family, Robert Tanner. Yep. Okay. And that's the property that they have been trying to build on. And for years. of this project wave the requirement to have a professional surveyor and accept you have to make does have to be an official motion.

sitting on this side. I will make it a motion just to be sure. I will make a motion that we wave the requirement for a professional engineer or surveyor for this application. I'll second that. All those in favor? We go. All right.

Do you um not have any like streams or wetlands on your property? No, there's not. It's all dry. Huh. Uh it's low, so it's soupy in the in the spring. It's just squishy. Um, but there's no So, there's a a brook that runs out back, but it's way out back. And then there's a like a it was man-made, like a backfill area, but we're more than 250 away from that. Y

and so those are the the two water bodies that Okay. And the neighbor Tanner. Nothing right there. No. No. property owners signed return receipts or acknowledgement. That's complete. location of the site within the town. That is exhibit. She didn't label exhibit.

Sorry. C must is that C? This is C. Oh, that's my fault. I was right. I was supposed to say exhibit C. Does it really upper right hand corner? Oh jeez. I thought we had a There it is. I thought I was in trouble. You had one job.

I would say that is complete. Complete boundaries of all contiguous property under the control of the owner or applicant regardless of whether it is part of part is being developed at this time. There is none Yep. Zoning classifications of the property. The property appears to be entirely in resource protection.

48:03

Okay, this would say that's complete. Bearing and distances of all property lines of the property to be develop be developed in the source of this information. Exhibit A. The information is taken from a warranty deed recorded in county argens countyogen county. We're going to say today registry deeds.

Complete locations of all building setbacks. No buildings proposed. See exhibit A for setbacks for existing buildings and proposed sidewalk. Say that is complete. Mhm. We have asked for a waiver for ground floor elevations because we're not impacting house or any other structures.

Gotcha. So, location dimensions are ground floor elevations of all existing proposed buildings on the site. I make a motion that we wave the requirement for elevations not applicable for improvements. I'll second that. All those in favor.

parking lots, parking and loading areas and walkways and existing and proposed. We got it. Complete. Location of intersecting roadways within 450 ft of the site. There's just the one. It's all the clerks. Yep. Complete. Complete. Except for dwelling units not shown using a common subsurface disposal. Location dimensions of water supplies, waste water disposal, soil, soil test.

Uh looks like the applicant has requested we wave this requirement. There is no waste water generated. Make a motion that we wave this because there will be no waste water generated by the project. Second that. All those in favor?

Mindy, you on the second? Julia. I did. Location of open drainage courses, wetlands, stands of trees, and other natural features with a description of such features to be retained in any new landscaping plan. the trees. Um, as we talked about earlier, there are no there are no open drainage courses or streams or anything like that. We're not taking any trees down.

Yeah. And we're not doing anything today. No tree removal. No. Complete. Complete. Agree. Direction of drainage across the site, both existing and proposed. Yes. Location dimensions of existing proposed signs. None. So complete.

Mhm. Location and dimensions of any existing easements and copies of existing covenants or added restrictions. They are none. Complete. Complete. Location and type of exterior lighting. this time. Um, so this is just an application for

the amount of fill, right? This has nothing to do with correct what horse facilities you guys might need or whatever. This we're not right. So any So we just need it for the fill. Any structures we need can be permitted by Calvin,

right? Um, and I think the use is just a it's either agricultural or it's just our residential use which is already grandfathered on the lot. So yeah, so it's just the fill. All right. Save is complete. Quantity, location, storage and containment of hazardous materials or petroleum based products exceeding 50 gallons.

So classification of manure is not hazardous Yep. Utility plan showing uh plan showing an addition provisions for water, wastewater disposal, nature, electrical, telephone and other utility services. There are none proposed at this time complete.

Complete. Planning schedule key to the site plan indicating general varieties of trees, shrubs, and other plants. None proposed. Complete. Complete. Copies applicable state approvals. Permits including but not limited to any applicable state highway entrance permit should be none required. Complete

anticipated beginning completion dates. Beginning and completion dates. Actually uh yeah that part should be done by the end of June. I asked a contractor friend about getting the shelters built after the site worked by the end of June and I almost gave him a heart attack.

53:21

But um no one's building anything anytime soon. Everybody's so busy. It's crazy. I know a guy. No, I know a guy. Best friend. All right, I think we're complete. development time schedule financial capacity. There is a estimate for the work from an excavator

provided. There's an exhibit E. He totally hacked your name. No A. No A and no B. Very hand. ending name. All right. I would say that's complete. Uh, not yet. Make a motion to find that the application is complete. Do we have any approval criteria printed out or

Well, we usually have the checklist which I assumed somebody. Gavin, did you print out conditional use checklist for approval criteria? And boy, You have a copy. Yes. Application checklist. Yes. think we need the approval checklist. We don't have one.

Approval criteria. That's page 79, right? Oh, that's subject. I'm sorry. Hold on. Approval. Page 5. Page 54. This it. You got a blank one. Yeah. you want to make a couple copies? I don't think we Oh, we did have one. I didn't know we ever had one at this.

Do you want back? Sorry. No, no, no. I had it from another meeting. Yeah. Is it the same? there's this one too. Well, I know, but we need to have some type of documentation in the end. Otherwise, somebody's going to do a lot of writing.

Yep. There's this one. Different. This is the application checklist. Oh, right. Sorry. Yep. You're right. Application. live somewhere. Mhm. Accessible. Well, we now have a new website. Wonder. I was going to say is there a way to is there anything

the website's awesome by the way the new one I think it's an improvement sure is there any kind of internet or something that we can I have no idea put documents on and then planning you know so um as an aside I represent my the ZVA

in Portland and I do all their decision forms and they'll do some conditional use permits and things like that do you know how many approval criteria they H three like five. Yeah. And I was going through ours. I was like, "Holy."

And then Yeah. There's 15 and then there's another. But we use conditional use for so such a broad range of things. Everything here is conditional use almost. That's the crazy part. I think it has one, but we still just have to go through it.

I know. That's the hard part. an accessory to resident, you're pretty much conditional use. It seems like here Mhm. Yep. Well, and some of them are duplicative. Like if you look between the approval criteria and the condition of the performance

58:31

performance standard, right? They totally need to be integrated. Yes, they do. I think we started work on that, but we never quite finished. We just need to tear it up and start over. Really what we need. Yeah. Yeah. And we need some res we need some resources other than us trying to do it as side side things too, I think.

Yeah. But the comp plan is using all of our money that was set aside for that. Come on. We had a budget for it last year. Well, and we didn't use our budget previously. Who had the original? I did. Thank you. Do you have any Thank you. these. I'll pass to hers.

Thank you. There we go. along if you could. No. Was it by her to follow along? Sure. Do you want to keep reading, John, or do you want somebody else to do it? Sure. I want to keep reading. You're so good at it, right? so engaged. All right. Approval criteria. Uh following criteria used by the planning board in judging applications for conditional use shall serve as a minimum requirements for approval of the conditional use. I'm not going to read the rest of the paragraph. This project will not will result in undue

will not result in undue water or air pollution. cause water or air pollution due to its location and scale. You guys have the same initial. Hm. Uh, has sufficient water available for foreseeable needs in the proposed use?

This criteria shall be used in our application. I would move that that is not applicable for this development. I'll second that. All in favor? Sorry. soil erosion or reduction in the capacity of the land to hold water. So dangerous or unhealthy conditions may result. I would I will say that this condition has been met. It is a flat site and the developed area is a small percentage of the parcel.

Just writing. She's busy. Okay. All right. Uh will not cause highway or public road congestion or unsafe conditions with respect to the highway or public road existing or proposed. I will make a motion that it is not applicable for this land development project.

No, I was just wondering is it not applicable or just complete because it is going to cause construction vehicles, right? Just not going to be excess. Uh yeah, we won't they won't be in the but they won't be in the road,

but like driving to your site like you know it's going to be some construction like one or whatever. But you know what I mean? It's notable. I'm f I'm fine. I will retract my wave if it makes you feel better. And I will say that we find that the project will not cause highway or public road congestion. It'll have temporary traffic for the construction of the project only.

I'll second that. Okay. All those in favor. disposal in conformity with main state plumbing code and other regula regulations. I will move that that is not applicable for this land improvement project. Second that. All those in favor

the proposed development have adequate fire protection. I will motion that that is not applicable for this development. Let's look at that land filling. All those in favor the scenic or natural beauty of the area aesthetics, historic sites or rare or irreplaceable natural areas or any dare wintering areas identified by the department of fisheries, wildlife or other agencies rights behalf physical access barriers water. I will find that this project does not cause an under undue adverse effect on any of those

1:03:46

things. I'll second that. All those in favor comprehensive plan and all other applicable town ordinances. That's such a weird one. I will move that this is in conformance with town's comprehensive plan and other ordinances.

Second that. All those in favor? adequate financial technical capacity to meet the standards required by this ordinance. I will move that we find that the applicant has adequate financial and technical capabilities, has a qualified contractor for the landfilling and has demonstrated financial capacity.

Second. All those in favor. 250 ft of any pond, lake, stream, river waters, it will not adversely affect the quality of such body of water unreasonably. I move that we find that this project will not adversely impact bodies of water.

I think it is more than 250 ft from the river, right? Oh, we're like 800 ft from the river. Yep. I mean, I don't think they have anything. Maybe you could find something you classify as a stream. Not even within 250 probably.

No. N. So, well, it's not going to impact them. It's complete. So, do we motion? Yep. I was in vote. I don't know that we officially voted. There we go. Uh, yeah. pretty much John John motion Juliet second down. This is a

I'll give you this checklist too. This one's simple. Uh will not alone or in conjunction with existing activities adversely affect the quality or quantity of groundwater. I move that we find that this project will not uh adversely affect the quality or quantity of groundwater. I'll

second that. Those in favor FEMA maps flood insurance whether the site is proposed in a floodprone area proposed site use conditional plot plan. because we are they are not building a not proposing uh actually you are in the future though. So,

well, so the property is most of the property is in the flood plane, right? And the structures, which I'll work through with Calvin under a flood plane ordinance, I can build a 500 foot accessory structure as long as you meet certain criteria.

So, that's I'll work that through on the building side. Um, and they will meet the they'll meet the exception, right, for accessory structures in our flood plane ordinance, right? I don't know if that makes sense. Yeah. So it's within the flood flood plane.

Um so I So I I would I I guess my motion is to say it is complete. The applicant's construction will construction of an accessory structure will be in compliance with Durham flood plane ordinance. This application doesn't involve any structures.

It it doesn't. But so what so what if there was no structure if there was if we were just looking at this increase of fill which is what we're doing right so it's in the flood plane who cares right like is there like it's um do you know what I mean um

we're putting dirt in the flood plane right after we take dirt out right because I think this is number 12 is specific almost for a structure or for something else other And right well that's why I started to say there's no structure but

well it's like two part cuz part the first part is determine if it's in a floodprone area so that part's complete but then the part about the structure is not applicable right and usually it's one foot flood plane elevation here 3 ft but that's the lowest floor elevation needs to be 3 ft

is your house in the flood plane no they basically dumped a bunch of dirt and built the house on top of it and we have a lma for the house actually right so I I wonder where that line is like from your house like a big circle around.

You can actually see it on the uh actually I think it's on here. You can So you have to bring the horses inside your house. No, you can't see it on Actually, there was a story the people across the road said like back in the 80s when it flooded they had to swim the horses up the road.

Really? They swam them all the way up to where the bend is. The people have a farm up there. Uhhuh. But um just reading the the rest of that approval criteria, it says needs to include a condition of plot approval requiring that principal structures. I'm fine with that condition. If you want to

1:08:54

I'm not building another house. I can't build another house on that lot. So, right approval. So, if you guys want to make that a condition, that's that's fine by me. like maybe a condition. You're said you're working with Calvin on the structures portion.

We will. So like um I guess it was way I started to say it was but I don't know if we want to bring that into this one. You know the rest of it. Yeah. I don't know. At this point we could just say it's all right. So we just whatever you want

move the find that we that this project as proposed for the land filling to create a paddic does not include the is not principal structure does not include principal structure second all's in favor so is it going to be complete or in

complete right incomplete complete complete um will not have adverse impact on spawning grounds for fish, aquatic life, birds, and other wildlife habitat. I move that this area being developed will not have an adverse impact on spawning grounds for fish, aquatic life, birds, and other wildlife habitat.

I'll second that. All in favor? The grubs will be pissed. Right. I feel nice, too. uh will not cause noise, odor, glare, vibration to disturb the peaceful enjoyment of the adjacent property. I move that we find this project will not cause noise, odor, or glare or vibration to disturb the adjacent properties.

I'll second that. All those in favor? ability of the town to provide municipal and governmental or educational services. I move to find that this project will not provide any burden on the town for delivery of services. Your horses aren't going to go to school.

You know, like a therapy pony like I'll second that one. All those in favor? It's been a long day. I'm only sure if you use here did a great job. Thank you. Um Sure, why not? I move to find that this application for Phil is complete and approved. No,

it's been to affirm it. I move to approve this conditional use permit. Thank you. I'll second that. All those in favor. Thanks, guys. All right. The buildings at some point. Yeah. Guys, back up. Good to meet you. Have a good night.

Take care. Bye. All right. Welcome back to the table. Thanks. We're here sitting on the other side. Welcome back. Used to bowl. You want me to pass so someone can read it? Yeah. Should I read it in or Yeah. Whoever wants to read it.

Duramine from Mineral Springs Estates. Waiver request. Dear members of the planning board, we humbly request the following waiverss to completeness for the above referenced application with the understanding that these items will be required prior to approval or as conditions of approval. Item number 33,

Department of Inland Fisheries and Wildlife. Number 34, awaiting response from the Department of Inland Fisheries and Wildlife. Number 48, awaiting approval of storm water permit from the main D. 52. Awaiting memo from engineer.

Engineer. What about um wait 48 to 52? What about 50? They're on there. We just put them last cuz we Oh, okay. Sorry. Oh, sorry. Uh from the engineer, it's going to be less than 100 daily trips or greater than less than.

Okay. 53 awaiting list cost estimate from the engineer. 54 C number 48 50 C number 33 and 51 C number 34. So 50 sorry. Okay. C number 54 was C which one? 48. 48. Okay. Yep. 54. That's the storm water permit. 54 is the one of uh providing copies of applicable state approvals and permits. So that's the storm. So 48 was the one about storm water. So we're still awaiting the storm water and they have the 501 at the end of it.

1:14:27

Yeah. Still awaiting from Cool. So what if I added a note that they will all be provided before we set this for hearing? before we what before we set this for hearing or before this goes to hearing. So we schedule a sitewalk and then hearing or sitewalk and hearing together

set typically like two months or one month for the sitewalk and then another month or is it can it be quicker than that? I think we can do them back to back. Right. So you have everything by next except the permits, right? So you'll have copies of the only thing you probably won't have back is a stormwater permit approval but you'll have a copy of the permanent. So

how long will it take for you to get the approval? You think they're they're pushing out 60 days and that's you know so 60 days from the preapp meeting. So I got that that will go through. Do we need to have the permit in hand or just the permit application?

Can I copy that letter? I mean I think yes. Yeah, absolutely. Can we make ask them to write on it first here? Yeah. Hold on. Wait a second. He may not be done. They may need to edit that. Can you just add it? We'll provide everything before next month or something or everything will be provided except for the permits before the public hearing or something like that. Um applicant will provide

Okay, perfect. Provide uh all correspondence hearing. We do on the subdivision prior to No, I don't think we need to have a p what's it say? So, a public hearing is where we take public comment. Okay. We need to deliberate at least in open session.

The sitewalkite public hearing. That is a public hearing. It's a public Yeah, it's a public meeting. Yeah. So, we need to notice that, right? But neither one is required. But I think we're saying that we should do it. But it's not required.

Public hearing. Public hearing. Going once. Going twice. Wait hearing. that street. So I can't imagine too many people are going to show up over here to a hearing. I wouldn't think so. Yeah. It would be the people that you sent your green cards to,

right? Well, I mean, anybody could come to guess. Yeah. So, do we want to do a motion to have a set the hearing and a sitewalk for the July meeting? I think we need to which is on the floor. Oh, did we not do that? A lot of times do we got to make a motion? We have to make a motion on those waiverss.

Oh, sorry. Gosh. Catch back up. A lot of people will do a lot of boys will do them like on the weekend or Saturday morning workshop if sometimes do I don't requirements. I was going to say you need the letter it up the letter. Okay. See, I almost messed it up and then you almost messed it up. I know, right? Right.

Thank you. I'm getting ahead of myself. Replacements for us. Please. Yes, please. No. Scratch that. I will tell you that if No, I won't say that on the record. Uh, never mind. I'll tell you that. I think I have in writing that you said you would stay one year. I did, but you know, if I couldn't bring my horse home, I might have to buy a new property elsewhere. So, but it's a good thing you guys rented my permit. So, I'm good.

I may have some lots for SALE I know. Some nice size ones, too. Well, I guess the neighbor is getting that big piece, huh? Oh, thank you. motion to wave requirements question. Not at all. Thank you. We thought Truffles was writing.

1:19:30

Yeah, he's got it. Yes, I'm seated. Okay. I'm going to make a motion to wave requirements 33, 34, 48, 52, 53, 54, 50, and 51 based on the uh written request of the applicant who has also promised to provide the required information prior to public hearing.

Second. All those in favor? And now I'm going to make a motion to find that the application's complete. I will second that. All those in favor? And now I'm going to make a motion that we set a sitewalk and a public hearing on this.

Um, could you slow down on your motion? Sure. The next meeting will be the 5th of July. No. Right. I mean, you could do it soon if you wanted to. Um, yeah, we could we have to do it within 30 days of the finding it complete, but we also have to

give seven days prior for notice. So, we need to do we can't do it within one week, right? And it has to be no more than 30 days. We do it within a couple of weeks so that next meeting will actually be back to talk about

talk about the project again. So, what about either the week before, which is the week of the 26th, or like the 6th or 7th of July? I would vote for the week the 28th. Okay. My preference. What does the 28th look like for folks?

28th is a Wednesday. Yes. Does that conflict? Shouldn't the 5th is our meeting? Right. But that's the date. I don't think we want to have it on the 5th. Yeah. Are we decide to change the meeting date? I don't think I'm going to be able to make it on the fifth.

So I think I don't want to make it on the fifth. I think we should reschedule the fifth meeting. Right. No, that's why I'm thinking instead of the 5th, we meet. Do the 28th 12th. We meet. Well, we have to hear this within 30 days.

30 days when the application completes. So can't we do the site meeting and then do Oh. Oh. Whoa. Whoa. Right. Sorry. So we do the 28th and then we don't meet on the 5th. Doesn't the public hearing have to be at a regular schedule?

So why can't we do sitewalk and hearing at the same time? Yeah, that's what I prefer to do. Walk right before the hearing. Yep. So do the sitewalk at How long is it going to take us? Half an hour. If that I mean there's a road and that's it.

Yeah. There's there's a road halfway up and then you can you can walk up and you can see where it's going to end cuz it's kind of the rightway has been cleared. Okay. So do all that on the 28th. So what if we did sitewalk at 6:30

and then have a meeting public hearing at 7:30 and our regular meeting it's what 15 minutes or so you get back and forth between say 7:30. Say 7:15 I would I would say because the conditions of the road but the road commissioner is within striking distance.

Yeah. Hey, you got to go B. Yeah, I think that would probably work. 7:30. 6 Well, 6:30 for the sitewalk, 7:30 for the I can do a 6 sitewalk, though. But I can be back by 6. Does that work for you? Mhm. All right. So, I'm going to make a motion to hold the sitewalk on June 28th, 2017 beginning at 6 o'clock

at the premises. Yes. at 7 p.m. Yep. I can make that a separate motion if that's easier or the same. Just combine them. All right. And then a public hearing. I move that the public hearingification will also be held on June 28th at 7:00

at the town office. Yes. why. What are these guys doing? And who's going to second that? Mindy. Sure. I'll second that. All those in favor? So, we'll meet at the site at 6. Yes. Yep. So, so why why aren't we doing this the public hearing the night of the mixed meeting after that?

Because we don't want to come on July 5th, right? We have to do it within 30 days. Skip that meeting. We have to do it within 30 days. Not the sidewalk was a public hearing. It's treated as a public hearing. It's and or. So, you can do either or or both. I think we're going to do both

1:24:33

of conservative approach. Yeah. And it has to be within 30 days, right? and he's going to notify his three neighbors and Okay. Yeah. It'll be there'll be a notice on the website maybe or something for this, right? Typically, the night you start to hear the application, there would be a public

there'll be a notice in the paper as well. We're just bumping it up a week for my regular meeting just for the holiday. You know, it's right after July 4th. It might be hard for people to have a meeting July 5th. Is that is the plan? Yeah.

I'm just to know. Yeah. So, we will meet on the 28th instead of July 5th. And that'll be this whole it'll be an entire hearing for this application, right? Including the public hearing section, correct? Okay. All right. Oh, so you're saying we'll have a planning board meeting,

right? Oh, that's what I'm hearing. On the 28th as well, right? Okay. That will be our regular meeting. You mean if there's other business? Yeah. I don't Yeah, I don't think we can do that. Take other business on this. I don't think we can do No, no, no. So, planning board meeting either we'll have it on another night or we won't have it until what do we what do we want to do with a July?

It's still I mean it's still a regular it's still a planning board meeting. We just have a public hearing as portion of the but if somebody wants to put an application in then we would tell them that we have a meeting until August.

Good luck. If you want to sit here we're going to table your application because you don't have anything really pending. You can have a quick half hour meeting 20-minut meeting on the 12th and be gone. closer we get to mid July, the the higher the likelihood is that I won't be here just right.

When's your due date? July 18th. So I I mean my preference would be June 28th is our our next meeting and then following that would be Yeah, that's fine as long as we as long as that's okay. Like we just what let the public know or something like in case anyone's sending in an application and they don't get it in on time, I guess.

I don't know how that goes. Can we do that? Or you just let them turn it in a week. You know, you waved the two week sub requirements. So, you can still hit the same submitt date, just you're heard a week earlier. Yeah. Tell you don't foresee anything coming in, but heard of anything cross bridge when we get to it.

I have a 50 subdivision, right? Handle it. Right. Right. We They're all going to come clocking in and say how easy this was. Right. Well, they're only applications are only due a week before, right? No, they're due 10 days before or

Yeah, 10 regular days. Yes. Okay. So, how does that change when they're due? So, I'm just thinking so if our our meeting was going to be the 5th. So, 10 days before that is the 20th, whatever that is, 26th, 23rd. And then if we have the meeting on the 28th, they'd have to get it in by the 18th.

I mean, the alternative would be be cancelceled July's meeting and be going to August. So, it's really I know I've been kicked down the road by many a planning board who said we have a major application and Oh, really? We you're we're not going to be able to

state law. You can't guarantee a spot on the agenda if you have to get to it. Yeah, I've been on both sides of that. A lot of municipalities actually sometimes don't have meetings because I know uh uh Kibbunk is post their meeting would have been in that first week of July and they're just they kicked it down to two weeks later because they had the option of having a second meeting. So

yeah. Okay. Um applications would need to be due the 19th of June the 28th was our meeting. Yeah. Yeah. And today is the se seventh, right? So I'm I'm good with whatever we want you guys want to do. I don't know. Calvin, do you know of anyone that you're working with right now?

We get it on the calendar and so we'll make the applications due the 19th uh with the next meeting the 28th. And I will notice no meeting for July 5th. Will we convene in August? Perfect. Right. Sounds great. So, we're actually

as long as as long as my vice chair is willing to run the August meeting. Sure. Let's just bring the baby. We get Brian back so we can have a I was going to say if I'm not here, you're going to need more people. Oh, yeah.

So, we're done with Mr. Baldwin now? We are. You're free. Thank you guys. Thank you guys. We'll see you on the 28th. Waiting for you. Nice. So, how Calvin, have you heard anybody who might be interested in coming over here as an alternate onto this board? Because we will be really short if these um

we will have we'll put that on. Yes. Yeah. And August is the summer time could be a hard time too to guarantee that everyone's vacations and Yeah. I bet somebody plan Thank you. would come if we kind of advertised it. But they would have to be appointed sworn in.

1:29:49

Yeah. Well, yeah, they have to go through the They have to go through the selectment. But yeah, if we could get a notice out that we should try to fill. Should I do that or should somebody else do that? Wasn't um Jill going to get that.

Why don't you email Ruth? Yeah, directly. That would be awesome if you could do that. I will if you want me to. I can do it. Okay. But I think we ought to get that out. You thinking like in the eblast or Yeah. anything she can get out there somewhere

because we're at the point we have zero alternates. I'd like to see some of those electronic boards with Lisman has tell us when their meetings are they need like outside on the street or something. It's not allowed in our ordinance.

I was going to say I'm pretty sure we're allowed to put those up. We have to change it. the pending the sitewalk and approval. I don't think anything is going to change on the plan. Should I or can I should I bring a myar in case that's final approval? Is that a time for final approval? How does that work?

I think that's the goal is we'll consider it. So, okay. So, I should have a myar. I would bring the myar. Yeah. Okay. Thank you. Cross your fingers. And that's when we go through the subdivision approval. Oh, that's right.

During that performance criteria. Yeah. That's That's going to be a long It's going to be a very long, right? So, it's a good thing we might not have any other business. Yes, it would be very good. What have you got, Julie? That's

subdivision criteria. That's what you printed out last time. Durham planning board subdivision. I know you had mentioned, Jill, you wanted to maybe tweak it, the formatting, but Okay, I have that one. Yes, that came from you.

Well, the other Well, if you want to look at this one, we got it right here. This is this is so on the June 28th we'll need a we'll need an approval criteria form you had mentioned wanting to to change the formatting yeah and I talked to I'm going to make a copy of this

and I talked to Calvin I don't have Excel or whatever I need in my computer that's why I cannot draw these I could things I could get I could email it to you but if you don't have Excel you can I don't have So, okay. And we can get you accepted.

Yeah. Isn't it expensive? No. Really? So, so we went through just so you guys want to look at this. We went through the subdivision submission requirements. Finish that. And then next is final approval and filing which that should come later. So, you skip that. And then approval criteria is page 79.

But I think before you do the approval criteria, I think we need to do the performance standards and design. So kind of goes together. We have to do them together essentially. I think in the order is next you would move to performance status and design

approval criteria pretty much references the performance standards. It's the what we've had a problem with our this ordinance is that they're kind of it it's a pain to have to go through both lists because they overlap and they're they're repetitive through the state standards.

What we do with this section where it says that aggregate base that uh the aggregate base should be and it gives you a s We just we just have to evaluate the information we have and go through all of that criteria. Right. So if it doesn't meet the performance standards and

so what how do we determine what page are you looking at? He's using gravel on site. I mean how do we so I I've already anticipated my my approach when you go through that is I'm going to say that a condition is that he submits he's still processing manufactured gravel. he submits to submits his civ analysis and the same thing with his compaction results.

Okay. And what we during construction because you can't I mean you can spec that he's using that but he'll need to provide testing materials. So and then because you have all this other criteria it's going to be section 401.

We're going to have to go through all of it. Are we are we doing paving? I'm not until you build more than four units based on our curtain ordinance right now. He said no paving. He's proposing any favor. No, he's not. So,

but the ordinance says when he develop builds past the three. So, that's that's certainly a a hurdle we'll have to go. I mean, these there's going to be a lot of questions. Yeah. And that maybe he should be prepared for too, I guess. Right.

He's he's aware. He's aware. He made reference to it. Our our first one here. So, we got to go through each one of these. Yeah. And and state statute. Mhm. I gave it well we have to go through these criteria as well which most of the

so yeah it'll be tell you I mean I think that this document you gave us last time Jill will cover it covers it I think the last time I talked to you you were concerned about the formatting and yeah but um but I mean I think it does the job

as long as it works for your purposes. Oh, yeah. Okay. Um, I just can't make the boxes. That's okay. We don't need it in a table format unless someone else wants to volunteer to put in a table format. If you do give I was going to say if I could just email her a template, she could just change it back and forth. She wants to make checklist. She doesn't know. So,

we can do a chart in Word, but I'm okay with this format. Yeah. Thank you. I mean, I'm okay, too. I suppose at at some point, I mean, I we have a lot of different forms floating around. At some point, it would be nice to standardize them and make them accessible, but I'm not sure that's something we need to tackle before June 28th.

No, probably not. This is my agenda. I think we type? Calvin and I went through them earlier. Yeah. So, which ones you you just want the um Do you just want for the subdivision? Uhhuh. I mean, the performance criteria is so lengthy that I don't think trying to put it in a form is going to be helpful for anybody.

You want to just follow the book? I think we're going to have to, but we're going to need a checklist so we don't so we know where what we did, right? Yeah. You're going to need a checklist. Do we need a performance? We don't generally have a performance criteria checklist. Usually, it's just the approval criteria.

It would be a lot easier. Incorporates both. I think it's going to be easier to have. I mean, some of these some of I mean, number 10 is I mean, number eight is like an entire page long. how we incorporate that into a checklist.

Well, why can't we just say you just make a checklist like one, two, three, check, check, check, check. That's it. Don't even see. Don't put all the Don't put the text. Just write the header. Maybe pollution, air quality, water, traffic, road.

Yeah. I mean, so I mean, the road construction is like pages long. So, you could just have number one, the proposed subdivision will not result in undue water or air pollution. And that's one criteria, you know. already But that's already what the approval criteria.

Yeah. Well, and that's exactly the problem. These are all defective. Though they're not in the same order, they're not. That's the right final approval for the other stuff. So, right now, until we change the ordinance, we have to do both, right?

Yeah. And we have to have a checklist for both. I think it's going to be hard to keep track of where we're at if we don't. I think we just have to. So, it looks way to keep that. It looks like there's a map or one of us can just do a checklist.

Looks like there's, you know, just make one during No, stop. Maybe 22. I don't know. 22 says planned unit developments, which is going to be NA. Yeah, we don't have a PUD. None of it's in a any of it in a maybe 21. So, there's like 20. Well, somehow we lost 18. Oh, they're right there. There's like 20. It looks like maybe 20ish. So, maybe just a list.

I have the same word. You want me to make a sheet? I have the Cuz I have the ordinance in. I would like you to retype. I bootleged it out of words. So, I copy and paste, watch TV, and make a list. I'll do it. Yay. Motion.

Second. Hang on. Hang on. We haven't voted yet. Hang on. The chairwoman has comments. Oh, okay. See, it's at the end. Next meeting, June 28th. No. July 5th meeting. Applications due June 19th. That's my installment. Now I move to adjourn. Second. All's in favor.
